My guest today is Anna Towns, 00:01:09.14\00:01:12.56 a United States Veterans Administration accredited 00:01:12.59\00:01:16.65 attorney.. that's a long title. I have to tell our viewers 00:01:27.92\00:01:33.88 that you and I go way, way back, I met you, when I was an intern, 00:01:33.92\00:01:39.85 you were already a Social Worker and I was an 00:01:39.88\00:01:42.26 intern... getting my Master's in Social Work, 00:01:42.29\00:01:44.58 and I met you at my internship site... 00:01:44.61\00:01:47.96 Yes... I know... it's amazing we go back a long time... 00:02:15.69\00:02:19.70 We won't say how long ago... but... it's been a long time... 00:02:19.73\00:02:23.71 and now... you're an attorney... doing this wonderful work... 00:02:23.75\00:02:28.05 tell us about what you're doing. Well, Yvonne, what I'm doing now 00:02:28.08\00:02:32.35 is actually representing veterans in their 00:02:32.39\00:02:36.12 service-connected disabilities and their requests for 00:02:36.16\00:02:39.13 compensation for their disabilities... 00:02:39.16\00:02:42.06 and this is quite a challenging area as you indicated 00:02:42.10\00:02:45.77 in the opening... there is such a backlog of 00:02:45.80\00:02:49.44 VA cases that are pending now, in fact, I think, 00:02:49.48\00:02:53.05 the statistic is that as of this month is more than a million... 00:02:53.08\00:02:56.65 however, that does not even account for all of the veterans 00:02:56.69\00:03:00.41 who are suffering with disabilities and are not even 00:03:00.45\00:03:02.74 yet in the system... My... more than a million? 00:03:02.78\00:03:07.56 More than a million, pending, VA claim cases... 00:03:07.59\00:03:11.92 Yes... as of this month... So AT, when the veterans 00:03:11.95\00:03:16.77 come home... and they apply... they have to wait for almost a 00:03:16.81\00:03:22.90 year... even sometimes... to find out that they need 00:03:22.94\00:03:26.25 additional information sent... is that true? 00:03:26.29\00:03:28.77 Yes... when veterans come home, particularly those with 00:03:28.80\00:03:32.77 known disabilities... of course PTSD is one of the 00:03:32.81\00:03:35.94 main ones or many other disabilities that they may have, 00:03:35.97\00:03:39.32 that may have been determined or diagnosed while they were 00:03:39.35\00:03:42.91 in the military, thereafter, or even a couple years after that 00:03:42.95\00:03:46.48 when they come home and learn that they are 00:03:46.51\00:03:50.72 suffering from a disability... then, they go to their regional 00:03:50.76\00:03:53.54 office and make an application, and that's when the wait begins. 00:03:53.58\00:03:57.34 It could take a year... usually, upon your initial 00:03:57.37\00:04:01.50 application... the VA will immediately inform the veteran 00:04:01.54\00:04:06.07 that it will be within a year that that they will receive 00:04:06.11\00:04:09.89 a decision on their case... and sometimes, 00:04:09.92\00:04:12.82 it's longer than that as you indicated... 00:04:12.86\00:04:15.69 when they then receive their documentation from the VA 00:04:15.72\00:04:19.57 regarding that claim, after a year, it generally is asking for 00:04:19.60\00:04:23.99 additional information... My!... 00:04:24.02\00:04:27.88 And then the veteran is given a year to respond... 00:04:27.91\00:04:30.26 and again... when they submit the response, 00:04:30.29\00:04:32.90 the VA is again... so you can see that the whole 00:04:32.93\00:04:35.35 process could be years before the veteran actually 00:04:35.39\00:04:38.69 receives a decision on their claim. 00:04:38.73\00:04:41.56 And so, in the meantime, that veteran is without 00:04:41.73\00:04:45.01 assistance... correct? Yes! very definitely... 00:04:45.04\00:04:48.29 many of them are homeless, many of them, of course, 00:04:48.32\00:04:51.04 turn to drugs and of course you know, 00:04:51.08\00:04:52.57 with the veterans... there's a high rate of suicide.. 00:04:52.61\00:04:56.07 so... it's such a critical area that, I think, has just not 00:04:56.10\00:05:00.19 gotten the focus that it needs, of course, you know, 00:05:00.22\00:05:02.89 I am glad to say that the President has really made this.. 00:05:02.92\00:05:06.20 one of his top priorities... to make certain that veterans 00:05:06.24\00:05:09.13 receive the services that they need... but it seems that 00:05:09.17\00:05:12.02 there is something... in the system... 00:05:12.06\00:05:14.04 that is keeping it from running smoothly.. for veterans. 00:05:14.08\00:05:19.06 That's what I was going to ask, Why is.. we know the bureaucracy 00:05:19.09\00:05:24.70 tends to take longer and run less smoothly... 00:05:24.73\00:05:28.97 but why is it taking so long to be responsive to this 00:05:29.01\00:05:35.01 segment of society? Yes... well... it is quite a 00:05:35.05\00:05:38.81 process for the VA to make the determination as to 00:05:38.84\00:05:42.57 whether the disability is service-connected 00:05:42.60\00:05:45.45 and then... after that's decided they have to determine 00:05:45.49\00:05:49.02 whether... the seriousness of the disability 00:05:49.05\00:05:51.72 and so.. there's a rating system after that 00:05:51.75\00:05:54.35 however, what has happened... and they are acknowledging 00:05:54.38\00:05:58.16 now that because of having a paper system... 00:05:58.19\00:06:00.39 there are warehouses... that are full to the brim... 00:06:00.42\00:06:03.52 with cases that have not even been evaluated... 00:06:03.55\00:06:06.45 the VA has committed that they are going to address 00:06:06.49\00:06:09.32 the backlog and that by 2015... a veteran will, in fact, 00:06:09.35\00:06:13.50 receive information from the VA within a matter of 00:06:13.53\00:06:17.34 2 to 3 months... but right now, it can be years... 00:06:17.38\00:06:21.15 so that without actually representation... 00:06:21.19\00:06:23.98 it's kind of difficult for a veteran to get through 00:06:24.01\00:06:26.39 the system... to get what they are so 00:06:26.43\00:06:28.37 entitled to... My! my! so tell us what you do 00:06:28.40\00:06:33.32 for the veterans... OK, OK, what I do... 00:06:33.35\00:06:36.78 Number one as a VA Certified Attorney... 00:06:36.81\00:06:40.21 I am not authorized to actually represent a veteran 00:06:40.24\00:06:43.74 until the VA has made an initial determination 00:06:43.78\00:06:46.42 so, you see, where that puts me on the chain... 00:06:46.46\00:06:49.30 they have to get through that long process, 00:06:49.33\00:06:52.11 and then, contact an attorney if the decision that they 00:06:52.14\00:06:56.24 received from the VA is not favorable, however, 00:06:56.27\00:07:00.00 the focus of my work now is actually to find, educate, 00:07:00.04\00:07:05.56 advocate and get veterans into the system... 00:07:05.60\00:07:09.45 so most of my work is spent addressing veterans' groups at 00:07:09.49\00:07:14.30 churches and community organizations and sponsoring 00:07:14.33\00:07:19.18 workshops to educate veterans because... although there is... 00:07:19.21\00:07:23.38 I indicated... more than a million veterans 00:07:23.41\00:07:26.40 who have applied for services, that are waiting for an answer, 00:07:26.43\00:07:31.01 there are many more who are on the street... homeless, 00:07:31.05\00:07:35.18 perhaps in drug treatment facilities or perhaps not even 00:07:35.22\00:07:39.51 having the courage to apply for that benefit, so there are 00:07:39.55\00:07:43.81 many more, who are not even in the system... 00:07:43.85\00:07:46.47 and that is a focus of the work that I am called to doing... 00:07:46.50\00:07:51.07 to find, locate, educate, advocate and get as many 00:07:51.11\00:07:54.98 veterans as I can in the system. Now, for those veterans, 00:07:55.02\00:07:58.87 who I am certified to represent... 00:07:58.90\00:08:02.65 they are the veterans who have received a letter... 00:08:02.68\00:08:06.65 a decision letter from the VA indicating that either that 00:08:06.68\00:08:11.12 their claim has been denied... or, it may be that their claim 00:08:11.15\00:08:15.56 has been accepted but at a lower rating than the veteran feels is 00:08:15.59\00:08:19.98 appropriate for their disability so, those, we are legally 00:08:20.02\00:08:24.16 are required to represent... communicate on their behalf 00:08:24.20\00:08:28.51 with the VA.. take the necessary steps to have that decision 00:08:28.54\00:08:32.34 turned around and we've been quite successful with a number 00:08:32.37\00:08:36.21 of veterans in this process. That's wonderful, now let me 00:08:36.24\00:08:40.05 ask you... How do they find out about you? 00:08:40.08\00:08:43.90 How do they know... once they have been denied 00:08:43.93\00:08:46.09 how do they know that they can come to you 00:08:46.13\00:08:49.10 to actually... kind of... work with them as an advocate? 00:08:49.13\00:08:52.92 Yes, well in that letter of decision from the VA 00:08:52.96\00:08:57.50 they will inform them that they can seek legal representation 00:08:57.54\00:09:02.59 now that the initial decision has been made... 00:09:02.63\00:09:05.74 and many of them will go to the local veterans service 00:09:05.77\00:09:09.40 organizations, you know, Vietnam Vets of America, 00:09:09.43\00:09:13.74 Disabled Veterans of America, but another choice is to seek 00:09:13.78\00:09:18.81 legal representation through private attorneys 00:09:18.84\00:09:22.28 and that's when... we are able to get involved... 00:09:22.32\00:09:25.01 so they will find out about our firm through word of mouth or 00:09:25.05\00:09:30.63 I have a website or, you know, usually, it's by word of mouth 00:09:30.67\00:09:35.74 from the veterans that we have been able to be successful 00:09:35.78\00:09:38.98 in changing their situation around... 00:09:39.01\00:09:41.52 that makes a big difference and it's very difficult 00:09:41.56\00:09:45.58 to do this work without having the training and the experience 00:09:45.61\00:09:49.60 to do so. Absolutely... tell us about 00:09:49.63\00:09:51.69 some of the veterans that you've helped... 00:09:51.72\00:09:54.27 Well, a typical case is a veteran who actually 00:09:54.31\00:10:00.13 was from the Korean War... so any... 00:10:00.17\00:10:02.92 in order to receive benefits, a veteran must have been active 00:10:02.95\00:10:06.92 must have been... at least... one-day active 00:10:06.95\00:10:09.39 in a war time... so, one of the veterans 00:10:09.42\00:10:11.79 who was from the Korean War... had been fighting his case 00:10:11.82\00:10:16.52 since 1954... and he was fighting this case 00:10:16.55\00:10:20.29 in a way... that he was not able to win, because the VA 00:10:20.33\00:10:24.30 for disabilities... you must have a diagnosed case, 00:10:24.34\00:10:27.91 a diagnosis... in order to receive the benefits, 00:10:27.95\00:10:31.45 and he was complaining about how they treated him in the VA, 00:10:31.49\00:10:34.41 he was going to his Congress persons... I mean, he has 00:10:34.44\00:10:38.31 really literally been fighting it every day... every year, 00:10:38.34\00:10:42.60 we were able to help him to see that he needed a diagnosis... 00:10:42.64\00:10:46.86 which... in this case... the diagnosis was PTSD, 00:10:46.90\00:10:50.20 so I arranged for him to be evaluated by a psychiatrist 00:10:50.24\00:10:56.32 who determined that he did have a diagnosis of PTSD, 00:10:56.35\00:11:00.59 and the psychiatrist also suggested... that based on the 00:11:00.62\00:11:04.82 symptoms that we are seeing, determined that the rating 00:11:04.86\00:11:08.99 for this veteran was about 100% so this veteran, pretty much, 00:11:09.03\00:11:15.17 within a couple of months, went from receiving a 10% 00:11:15.20\00:11:19.57 for x-ray for asthma... a 10% rating for asthma... 00:11:19.61\00:11:23.95 we were able to put forth to the VA the diagnosis of PTSD 00:11:23.98\00:11:29.01 and he went from a $128 a month to $3,000 a month 00:11:29.04\00:11:34.42 for the rest of his life. So that is the kind of case, 00:11:34.45\00:11:37.15 that is the kind of work that we know... is so important 00:11:37.19\00:11:40.15 that veterans cannot... really... it is very difficult 00:11:40.19\00:11:42.89 for them to do that... without legal representation 00:11:42.92\00:11:45.59 where you have to know the law, you have to be familiar with 00:11:45.62\00:11:49.64 the VA process... which is unique only to the VA 00:11:49.68\00:11:52.64 and then you have to be prepared or able to 00:11:52.67\00:11:55.71 apply the law and the VA process particular to every single 00:11:55.74\00:12:00.49 veteran's case in a different manner. 00:12:00.53\00:12:02.14 That's tremendous AT... I mean... to go from a $128 00:12:02.17\00:12:07.01 to over $3,000 a month... for the rest of his life... 00:12:07.05\00:12:10.56 Yes, yes for the.. rest of his life, 00:12:10.60\00:12:12.17 you know, what is unfortunate 00:12:12.21\00:12:13.68 is that it is... for the rest of his life.. 00:12:13.71\00:12:14.97 and, of course, he is in his 70s now but what happens 00:12:15.00\00:12:18.40 also is that once the VA determines that you are 00:12:18.43\00:12:21.96 eligible.. then you will receive a retroactive pay based to the 00:12:22.00\00:12:26.65 date that you originally applied well, unfortunately, 00:12:26.69\00:12:29.90 although he had been working on this case since 1954... 00:12:29.94\00:12:33.45 he really only legally applied after we assisted him 00:12:33.49\00:12:36.94 in getting his case with a diagnosis into the system... 00:12:36.98\00:12:40.36 My! so he didn't even realize the steps that were necessary 00:12:40.40\00:12:44.29 to actually accomplish his goals he needed that diagnosis... 00:12:44.32\00:12:48.18 and he didn't have that until ... was that.. he got that after 00:12:48.21\00:12:53.38 he started working with you or... you helped him? 00:12:53.42\00:12:57.01 After he started working with us That's amazing... 00:12:57.04\00:13:00.57 so... walk me through the steps, ok, so I'm a veteran... 00:13:00.60\00:13:06.42 I finally... I come back with PTSD and I contact you... 00:13:06.46\00:13:12.25 what happens then? OK, OK, all right... 00:13:12.28\00:13:15.63 the initial phase... as I indicated... 00:13:15.66\00:13:17.39 that is work that we do because that is my mission 00:13:17.43\00:13:20.41 to find and educate... what I would do with that 00:13:20.44\00:13:23.51 veteran... is number one if they have not applied 00:13:23.55\00:13:26.58 for the claim... for a claim... 00:13:26.62\00:13:28.82 I would assist them in getting the claim filed... 00:13:28.85\00:13:33.39 so after he has filed his claim, then we also assist him 00:13:33.42\00:13:38.84 in ordering his records... his complete records from the VA 00:13:38.88\00:13:43.39 which... that's available to any veteran who requests that 00:13:43.43\00:13:47.91 of the VA... and then... we take the step to... 00:13:47.95\00:13:51.12 assist him into filing... and then... 00:13:51.16\00:13:54.59 we have to wait for the VA to respond, 00:13:54.62\00:13:57.98 so he actually joins that number of a million who are waiting... 00:13:58.02\00:14:01.71 however, after we have worked with him 00:14:01.75\00:14:05.58 or after his case has been filed for a number of months, 00:14:05.61\00:14:09.22 then we take other steps to make sure that his case comes 00:14:09.25\00:14:12.70 to the top.. and one of those... is actually seeking the support 00:14:12.74\00:14:16.15 of his Congressional Law Office to ask them to enquire 00:14:16.18\00:14:20.12 about the status of his case, so... various methods we have 00:14:20.16\00:14:24.55 to try to bring the veterans case out from the million 00:14:24.59\00:14:29.51 to his getting a response 00:14:29.54\00:14:33.32 sooner than others, 00:14:33.35\00:14:35.00 but you can't do that without representation... 00:14:35.04\00:14:38.31 Yes, so you are able to kind of expedite the process a bit? 00:14:38.34\00:14:42.45 Yes... well through methods that we are able to use... Yes... 00:14:42.49\00:14:46.57 and of course it's different for each veteran's case... 00:14:46.60\00:14:48.99 So what are some of the disabilities that have a 00:14:49.03\00:14:53.53 high ranking with the VA... what are some of those 00:14:53.56\00:14:58.03 disabilities? All right... well the VA has... 00:14:58.07\00:15:00.63 OK... there must be over 250 disabilities that they have 00:15:00.67\00:15:07.50 ratings for... and each disability... 00:15:07.53\00:15:09.57 they would give you the symptoms for the level... from zero 00:15:09.60\00:15:13.61 or from 10% to a 100%... they would give you the 00:15:13.65\00:15:17.45 corresponding symptoms that a veteran would have... 00:15:17.48\00:15:22.19 I have a case of a veteran who has Leukemia... 00:15:22.23\00:15:27.60 and he was on active duty in the Gulf War... 00:15:27.64\00:15:32.84 and the VA had denied him based on the fact that his 00:15:32.87\00:15:38.04 Leukemia was not service-connected. 00:15:38.08\00:15:41.00 So there again... what we had to do... is to identify a 00:15:41.04\00:15:46.50 physician or actually... in this case... 00:15:46.53\00:15:48.64 it was his own physician... to ask him if he could state 00:15:48.68\00:15:52.13 that the Leukemia that he now is suffering from... 00:15:52.17\00:15:56.79 is as likely as not to have been service-connected. 00:15:56.83\00:16:01.38 That is the magic language that the VA doesn't necessarily 00:16:01.41\00:16:06.93 share this with veterans but as long as a physician can 00:16:06.96\00:16:12.44 determine that the diagnosis is as likely as not 00:16:12.48\00:16:16.56 to have been connected... with their military service 00:16:16.60\00:16:18.80 and because... this particular veteran... in the Gulf War was 00:16:18.84\00:16:21.87 exposed to so many fumes when he was over there, 00:16:21.90\00:16:24.31 then... his doctor did give that determination and the VA turned 00:16:24.35\00:16:29.66 the situation around and determined that he 00:16:29.70\00:16:31.86 was eligible for compensation... Ah... that is great... 00:16:31.90\00:16:37.90 what a blessing this is... this work must be for you... 00:16:37.93\00:16:42.42 how has this work impacted your life? 00:16:42.46\00:16:44.90 Well, you know my background, you know, I grew up in a home 00:16:44.94\00:16:52.37 where my father was a Minister and my mother... 00:16:52.40\00:16:55.44 and they always taught us that we had a responsibility 00:16:55.48\00:16:58.50 to determine... why we are here and what we are called to do... 00:16:58.54\00:17:02.67 and so that all of my career... I have basically had 00:17:02.70\00:17:06.09 the blessing of doing ministry along with my work... 00:17:06.12\00:17:09.48 so, I consider anything that I am doing as being 00:17:09.51\00:17:12.77 mission work that I am called to doing... 00:17:12.81\00:17:15.57 When I determined... I was called by several groups 00:17:15.61\00:17:19.56 to just do a presentation on VA benefits... 00:17:19.59\00:17:22.56 these groups have happened to be groups of men... 00:17:22.59\00:17:25.62 although we know that female veterans face the same problems, 00:17:25.65\00:17:29.12 so, in researching and determining... 00:17:29.16\00:17:31.90 what the steps veterans needed to do to receive their benefits 00:17:31.93\00:17:35.77 I just realized that it was an overwhelming process 00:17:35.81\00:17:39.06 and it was very difficult for the average veteran 00:17:39.09\00:17:42.28 to know that process... so in the process of kind of 00:17:42.31\00:17:46.12 preparing for that and then working with a number of the 00:17:46.16\00:17:49.94 veterans that came out of that, I just received a call that 00:17:49.97\00:17:53.62 this is such an area of disparity... 00:17:53.65\00:17:55.97 that this is what I am now called to doing... 00:17:56.01\00:17:59.85 You know, AT, God is so amazing... 00:17:59.89\00:18:02.57 Yes... He is... Because, you know, 00:18:02.61\00:18:05.26 OK... here you are... you've been able to... 00:18:05.30\00:18:09.38 this journey that you've been on has prepared you for this work, 00:18:09.41\00:18:14.68 Yes... it has... Yes... it has... 00:18:14.71\00:18:16.57 Your social work background, your law background, 00:18:16.60\00:18:20.63 culminating in this advocacy for the veterans... 00:18:20.67\00:18:23.98 that is so tremendous... Do you feel as though 00:18:24.01\00:18:27.25 you're walking now in your destiny that this is what 00:18:27.29\00:18:31.43 God has put you on the planet to do... 00:18:31.47\00:18:33.47 Without a question... this is where God has placed me 00:18:33.50\00:18:37.00 and I am doing my best to make good of what He has given me... 00:18:37.03\00:18:42.30 and as you indicated... my experience as a Social Worker 00:18:42.33\00:18:45.51 my experience working with families and children, 00:18:45.54\00:18:48.55 my experience working in Foster Care and Adoptions, 00:18:48.58\00:18:51.55 my experience working at HUD and Housing, 00:18:51.58\00:18:54.59 all of these have come together and is much needed 00:18:54.63\00:18:57.78 as I impact the lives of veterans... 00:18:57.81\00:19:00.78 who have been deprived of housing... 00:19:00.82\00:19:02.79 been deprived of their rightful served compensation. 00:19:02.82\00:19:07.43 That's tremendous, AT, and you seem so fulfilled... 00:19:07.46\00:19:12.03 you know, I tell our viewers on Urban Report all the time 00:19:12.06\00:19:15.32 that God has a plan for each of us... 00:19:15.35\00:19:18.59 that we have a divine destiny... and there's no fulfillment 00:19:18.62\00:19:22.97 like walking in that destiny... Number one... is to really 00:20:28.84\00:20:32.22 determine whether you sincerely feel that you have a disability 00:20:32.25\00:20:35.61 that was connected with your service... 00:20:35.64\00:20:37.26 we know how difficult it is for veterans to reintegrate 00:20:37.29\00:20:40.84 into the community... so that there are many 00:20:40.88\00:20:42.71 disabilities that they may not have identified... 00:20:42.75\00:20:46.28 may be experiencing but have not identified... 00:20:46.31\00:20:49.77 so my first step is to recommend them to go to the VA 00:20:49.81\00:20:54.08 to have a complete Physical to determine if there are 00:20:54.12\00:20:58.36 any disabilities that may be connected with the VA. 00:20:58.40\00:21:02.17 That is the first step.
