way down South. 00:00:51.15\00:00:55.18 I've told people for years talking to audiences in the US, 00:00:55.22\00:00:57.89 I'm from the Deep South. 00:00:57.92\00:00:59.25 Well, it's Deep South, 00:00:59.29\00:01:01.02 the South of the great Southern land of Australia. 00:01:01.06\00:01:03.43 But talking about religious liberty, 00:01:03.46\00:01:05.23 it's hit me that something took place down there 00:01:05.26\00:01:09.13 a few decades ago 00:01:09.16\00:01:10.57 that was very telling 00:01:10.60\00:01:12.60 on the nature of religious liberty 00:01:12.63\00:01:14.74 and how easily societal attitudes 00:01:14.77\00:01:16.87 can turn against those of faith. 00:01:16.91\00:01:21.04 Perhaps a few of the viewers remember, 00:01:21.08\00:01:24.15 especially if you are readers of Adventist books. 00:01:24.18\00:01:26.65 When I was book editor 00:01:26.68\00:01:28.02 at Pacific Press in Boise, Idaho, 00:01:28.05\00:01:30.49 I was under assignment to get a book 00:01:30.52\00:01:32.85 based on the story I'm about to share a little with you, 00:01:32.89\00:01:37.26 the saga of the Chamberlains, 00:01:37.29\00:01:40.06 Lindy and Michael Chamberlain. 00:01:40.10\00:01:42.10 A Seventh-day Adventist Church pastor and his wife, 00:01:42.13\00:01:44.17 who with their infant daughter and two young sons 00:01:44.20\00:01:48.70 went out into the desert 00:01:48.74\00:01:50.64 in the Center of Australia at Ayers Rock 00:01:50.67\00:01:52.54 where there's a massive monolith 00:01:52.57\00:01:54.74 surrounded by mostly desert plains 00:01:54.78\00:01:58.31 with a few scrubby eucalyptus, 00:01:58.35\00:01:59.85 and kangaroos, and emus but not much else. 00:01:59.88\00:02:02.65 They went camping there and while... 00:02:02.68\00:02:06.22 Even to this day, 00:02:06.25\00:02:07.59 it's a little obscure what happened. 00:02:07.62\00:02:08.96 It appears 00:02:08.99\00:02:10.33 that while they were gathered around the campfire 00:02:10.36\00:02:12.56 with their children in a nearby tent, 00:02:12.59\00:02:15.06 a dingo or a wild dog crept into the tent 00:02:15.10\00:02:18.53 and took the child out of the sleep 00:02:18.57\00:02:21.27 of a little bassinet is the term 00:02:21.30\00:02:22.87 they use down there, 00:02:22.90\00:02:24.24 in the presence of the two boys. 00:02:24.27\00:02:26.27 But it was never clear 00:02:26.31\00:02:27.68 if they saw it or what they were doing. 00:02:27.71\00:02:30.21 It was an incredible headline used item for years 00:02:30.25\00:02:34.42 and I was in Australia during much of that period. 00:02:34.45\00:02:38.29 And initially, people were just overwhelmed 00:02:38.32\00:02:42.86 with sympathy for the family 00:02:42.89\00:02:45.89 as you'd expect because to have a child 00:02:45.93\00:02:48.86 that's just a few weeks old 00:02:48.90\00:02:50.30 taken and probably eaten by the wild animals 00:02:50.33\00:02:54.37 was horrific. 00:02:54.40\00:02:57.41 Unfortunately, the family didn't help a lot. 00:02:57.44\00:03:00.61 The father was a Seventh-day Adventist minister 00:03:00.64\00:03:03.78 and I think because of their faith, 00:03:03.81\00:03:07.55 they were able to bear up reasonably well, 00:03:07.58\00:03:11.09 and make statements to the media 00:03:11.12\00:03:13.25 that they were not worried. 00:03:13.29\00:03:14.62 They knew they would see their daughter again 00:03:14.66\00:03:17.43 beyond this veil of tears, 00:03:17.46\00:03:19.86 but they had hope for another time. 00:03:19.89\00:03:22.36 That was good. 00:03:22.40\00:03:23.73 But unfortunately as time went on, 00:03:23.77\00:03:26.10 that seemed to translate 00:03:26.13\00:03:27.87 into a rather careless attitude in the public mind 00:03:27.90\00:03:31.37 because the next day 00:03:31.41\00:03:32.91 Michael was there taking photographs. 00:03:32.94\00:03:34.61 He said he was going to write a book 00:03:34.64\00:03:35.98 about the event. 00:03:36.01\00:03:38.08 In the inquest 00:03:38.11\00:03:39.45 that was followed closely by the public. 00:03:39.48\00:03:41.88 The wife turned up in a different dress every day 00:03:41.92\00:03:44.82 and the newspaper started covering it like 00:03:44.85\00:03:47.46 a fashion moment 00:03:47.49\00:03:49.46 and so people became a little ambivalent. 00:03:49.49\00:03:52.96 Were these truly grieving parents? 00:03:52.99\00:03:55.06 So a lot of gossip grew up 00:03:55.10\00:03:58.63 that maybe something happened different than an animal. 00:03:58.67\00:04:03.04 Then a misunderstanding kicked in 00:04:03.07\00:04:06.47 Seventh-day Adventists Protestant Christians, 00:04:06.51\00:04:10.38 Bible believing and prophecy explicating 00:04:10.41\00:04:16.18 Protestant Christians 00:04:16.22\00:04:18.45 and one of the emphases 00:04:18.49\00:04:20.09 of the Adventist Church is on health. 00:04:20.12\00:04:22.66 We're very much opposed to alcohol, 00:04:22.69\00:04:24.36 tobacco and other habits and substances 00:04:24.39\00:04:26.56 that will ruin our body's integrity 00:04:26.59\00:04:29.73 and, of course, cloud our minds about 00:04:29.76\00:04:31.63 understanding spiritual things. 00:04:31.67\00:04:33.54 And in spite of that the husband 00:04:33.57\00:04:35.34 had run anti-smoking clinics in his church and as a gimmick 00:04:35.37\00:04:39.01 but very unfortunate 00:04:39.04\00:04:40.38 when the media attention focused on them. 00:04:40.41\00:04:42.91 He used to carry a little coffin down 00:04:42.94\00:04:45.55 in the middle of the church 00:04:45.58\00:04:47.02 and have people throw their cigarettes into it 00:04:47.05\00:04:50.35 as he was asking them to stop smoking. 00:04:50.39\00:04:52.85 Well, a little coffin seems more than prescient 00:04:52.89\00:04:56.29 for a family like that. 00:04:56.32\00:04:57.66 People started to wonder, 00:04:57.69\00:04:59.03 "Was it foreshadowing 00:04:59.06\00:05:00.40 their efforts to do away with a child?" 00:05:00.43\00:05:01.76 So rumors grew up like crazy. 00:05:01.80\00:05:04.93 But the judge, like most judges kept to the law 00:05:04.97\00:05:09.47 and tried to have personal justice 00:05:09.50\00:05:11.91 as well as legal justice. 00:05:11.94\00:05:13.51 And so at the hearing, they made it public 00:05:13.54\00:05:16.18 and he decried all of the rumors and innuendos 00:05:16.21\00:05:19.48 that were going on. 00:05:19.51\00:05:20.85 And he said, "These are truly grieving parents." 00:05:20.88\00:05:23.35 He says they did not harm their child 00:05:23.39\00:05:25.85 and exonerated them. 00:05:25.89\00:05:27.52 And that should have been the end of it, 00:05:27.56\00:05:30.06 but unfortunately there was a fight 00:05:30.09\00:05:31.99 even within the church. 00:05:32.03\00:05:33.80 And a dentist 00:05:33.83\00:05:36.23 from the same religious community 00:05:36.26\00:05:39.70 was convinced that they had done something 00:05:39.73\00:05:42.07 so he went to the police. 00:05:42.10\00:05:43.71 They gave him the little jacket that had been found 00:05:43.74\00:05:46.84 and he took that to England 00:05:46.88\00:05:48.58 and here is where farce kicks in. 00:05:48.61\00:05:51.28 He took it to England and had a dingo expert in England. 00:05:51.31\00:05:53.92 There's no dingo in England, examined it. 00:05:53.95\00:05:56.42 And the idea that he brought back 00:05:56.45\00:05:59.22 was that there was not teeth marks on it. 00:05:59.25\00:06:01.19 These were scissor marks. 00:06:01.22\00:06:03.19 And so a whole scenario was cooked up 00:06:03.22\00:06:06.23 whereby with the group around the fire 00:06:06.26\00:06:11.17 the mother had ducked away for just a moment, 00:06:11.20\00:06:13.74 killed the child with scissors, 00:06:13.77\00:06:16.17 stuffed his body in a camera bag 00:06:16.20\00:06:17.94 and come back and acted normally. 00:06:17.97\00:06:20.51 The timing was improbable, 00:06:20.54\00:06:22.04 as well as the rationale was crazy, 00:06:22.08\00:06:25.55 so then the police started really checking on this couple. 00:06:25.58\00:06:30.45 Again, they didn't help themselves 00:06:30.49\00:06:32.22 very much. 00:06:32.25\00:06:34.72 They separated them with quiz separately, 00:06:34.76\00:06:36.89 of course, with tape recorders rolling. 00:06:36.93\00:06:39.36 And the wife sure of her innocence said 00:06:39.39\00:06:42.93 to the policeman in the car, 00:06:42.96\00:06:44.30 she said, "Even if I did it, you couldn't prove it." 00:06:44.33\00:06:47.34 And he says, "You're a very clever woman, 00:06:47.37\00:06:49.00 but we will get you." 00:06:49.04\00:06:50.97 So those were all unfortunate human elements 00:06:51.01\00:06:53.91 that contributed to it, 00:06:53.94\00:06:55.28 but there's no question 00:06:55.31\00:06:57.05 that as this thing revved up religious prejudice, 00:06:57.08\00:07:00.72 misunderstandings, 00:07:00.75\00:07:02.28 and then outright disliked minority group kicked in. 00:07:02.32\00:07:07.82 And it went on for years and years 00:07:07.86\00:07:09.96 and in the end, 00:07:09.99\00:07:11.59 Lindy Chamberlain was put on trial, 00:07:11.63\00:07:14.70 convicted and sentenced to, 00:07:14.73\00:07:17.83 I think it was 20 years but a lifetime, 00:07:17.87\00:07:19.67 essentially with hard labor. 00:07:19.70\00:07:22.90 Her husband was convicted of being an accomplice 00:07:22.94\00:07:25.24 but given a suspended sentence, 00:07:25.27\00:07:27.44 which is where the judge showed his clemency 00:07:27.48\00:07:29.64 because the judge was very easy on them 00:07:29.68\00:07:32.45 but the community were not 00:07:32.48\00:07:37.19 and the jury in that area were very prejudiced. 00:07:37.22\00:07:41.52 They even allowed to go home at night and discuss things 00:07:41.56\00:07:44.03 and what's the news and all the rest. 00:07:44.06\00:07:45.93 But in the sentencing guidelines for her, 00:07:45.96\00:07:48.80 the judge had no choice so it was obligatory. 00:07:48.83\00:07:52.23 With the husband, he showed 00:07:52.27\00:07:53.84 that he didn't really think that this even happened. 00:07:53.87\00:07:57.07 And the government, as I listened to it, 00:07:57.11\00:07:59.41 were looking for an excuse to release it from prison 00:07:59.44\00:08:02.11 because it's not unusual. 00:08:02.14\00:08:04.01 Even when a parent does kill a child like that, 00:08:04.05\00:08:08.32 they'll put it down to extenuating circumstances 00:08:08.35\00:08:11.62 like postpartum depression or whatever. 00:08:11.65\00:08:15.39 But what I really want to bring up 00:08:15.42\00:08:17.59 here in this short discussion 00:08:17.63\00:08:19.66 is once religious prejudice kicked in, 00:08:19.69\00:08:23.33 it then divided the church. 00:08:23.37\00:08:27.17 And half of the church members 00:08:27.20\00:08:30.31 believe she'd done it, half not. 00:08:30.34\00:08:32.31 In the wide community, 00:08:32.34\00:08:34.01 the vast majority of citizens believed 00:08:34.04\00:08:36.85 that this woman was guilty. 00:08:36.88\00:08:38.21 They do till this day, incidentally. 00:08:38.25\00:08:41.78 So there was infighting in the church, 00:08:41.82\00:08:43.95 half of the church members were prayerful about it, 00:08:43.99\00:08:48.19 the other half were politically active, 00:08:48.22\00:08:50.53 and used to hold rallies on the Sabbath day, 00:08:50.56\00:08:52.99 even demanding her release. 00:08:53.03\00:08:55.70 And I talked to some of them 00:08:55.73\00:08:57.27 and they did notice that there was a connection 00:08:57.30\00:09:00.57 between for one of a better word, 00:09:00.60\00:09:04.01 religious liberalism and the political activism 00:09:04.04\00:09:07.11 of those that were supporting political reasons 00:09:07.14\00:09:10.38 to get her out of prison. 00:09:10.41\00:09:12.85 But it tore the church apart and the country 00:09:12.88\00:09:14.85 was in a turmoil periodically over this. 00:09:14.88\00:09:18.15 In the middle of all of this, 00:09:18.19\00:09:19.99 I was listening to the legal programs 00:09:20.02\00:09:23.83 on government radio. 00:09:23.86\00:09:25.76 And there were two things that happened 00:09:25.79\00:09:27.53 that made me realize 00:09:27.56\00:09:28.90 the stakes were very, very high. 00:09:28.93\00:09:33.00 As in America, Australia has great guilt 00:09:33.03\00:09:36.14 about its treatment of the indigenous peoples. 00:09:36.17\00:09:41.61 The United States 00:09:41.64\00:09:42.98 has gotten over it to a large degree, 00:09:43.01\00:09:45.58 but you know, there were land grants, 00:09:45.61\00:09:47.38 reservations and so on given to the Indian tribes 00:09:47.42\00:09:50.12 and they're out of sight, out of mind for most people. 00:09:50.15\00:09:53.19 In Australia, it's a little more public 00:09:53.22\00:09:56.42 because of the civil rights movements 00:09:56.46\00:10:02.43 of recent years. 00:10:02.46\00:10:03.80 They've taken up the cause of the Aboriginals 00:10:03.83\00:10:06.33 and given them the land back also 00:10:06.37\00:10:08.50 and recognizing sacred places and so on. 00:10:08.54\00:10:11.81 But in recognition of the abusive nature 00:10:11.84\00:10:15.14 of colonialism 00:10:15.18\00:10:16.81 and the White settlement in Australia, 00:10:16.85\00:10:19.65 they have long allowed native peoples 00:10:19.68\00:10:23.25 to give unsworn testimony in court. 00:10:23.28\00:10:26.62 That's not allowed in the US that I know of 00:10:26.65\00:10:29.09 and that was out of deference to the fact. 00:10:29.12\00:10:31.46 And Australian Aboriginals are not an aggressive people, 00:10:31.49\00:10:34.63 nothing to do with colonialism or whatever. 00:10:34.66\00:10:36.16 There are just a very passive quiet, sorts of, 00:10:36.20\00:10:40.77 a nature of their race. 00:10:40.80\00:10:43.20 And so to allow them to appear in court 00:10:43.24\00:10:46.37 were normally under cross examination, 00:10:46.41\00:10:49.21 they could be intimidated, 00:10:49.24\00:10:51.18 and they would say nothing 00:10:51.21\00:10:52.55 or crack under the attorney's questions. 00:10:52.58\00:10:56.79 It had been allowed 00:10:56.82\00:10:58.15 that they could give the testimony. 00:10:58.19\00:10:59.52 It would be unchallenged to go into the record. 00:10:59.55\00:11:02.52 In the middle of this Chamberlain thing, 00:11:02.56\00:11:04.83 where the followers of Lindy were trying to elect 00:11:04.86\00:11:08.10 their own representatives 00:11:08.13\00:11:09.76 into the Northern territory where this took place, 00:11:09.80\00:11:14.10 into the Northern territory assembly with the stated aim 00:11:14.14\00:11:17.27 that they would then use their legal powers 00:11:17.31\00:11:20.08 to release her from prison. 00:11:20.11\00:11:22.98 And one of the Adventist lay people, 00:11:23.01\00:11:27.52 a wealthy journalist had uncovered 00:11:27.55\00:11:30.79 supposedly new testimony from an Aboriginal tracker, 00:11:30.82\00:11:33.62 who could prove, 00:11:33.66\00:11:35.69 "prove that the body had been dragged 00:11:35.72\00:11:39.26 under the home of a ranger 00:11:39.29\00:11:43.50 who then shot the animal and disposed the body." 00:11:43.53\00:11:47.77 Crazy stuff. 00:11:47.80\00:11:49.70 And here on the legal program, they were saying, 00:11:49.74\00:11:53.98 "No reference to the Chamberlain thing." 00:11:54.01\00:11:55.68 But suddenly in the middle of this 00:11:55.71\00:11:57.71 that they were in the process of removing this clause that... 00:11:57.75\00:12:01.25 or this provision that allowed natives 00:12:01.28\00:12:05.02 to give unsworn testimony. 00:12:05.05\00:12:08.56 So it removed a massive protection 00:12:08.59\00:12:12.06 from an entire people 00:12:12.09\00:12:14.06 in trying to get this one person out of jail. 00:12:14.10\00:12:17.47 That was bad enough but then a few weeks later, 00:12:17.50\00:12:19.70 I heard something that is much more relevant now 00:12:19.73\00:12:23.20 but it was very frightening at the occasion. 00:12:23.24\00:12:25.47 This was not well before 9/11. 00:12:25.51\00:12:27.48 This was in the 1980s. 00:12:27.51\00:12:31.55 And the lawyers came on this program 00:12:31.58\00:12:33.55 and they said the greatest threat ever 00:12:33.58\00:12:35.62 to civil liberties is taking place 00:12:35.65\00:12:37.59 in the Northern Territory. 00:12:37.62\00:12:39.59 They said they're in the process of... 00:12:39.62\00:12:41.69 They put forward a bill that would... 00:12:41.72\00:12:44.86 an anti-terrorism bill. 00:12:44.89\00:12:46.53 And at that point, 00:12:46.56\00:12:47.90 there had never been a terrorist act in Australia. 00:12:47.93\00:12:51.00 The closest to it, 00:12:51.03\00:12:52.93 there's a lot of Serbs and Croats 00:12:52.97\00:12:54.70 that have made their way to Australia 00:12:54.74\00:12:56.81 and because we know the Balkans War, 00:12:56.84\00:12:58.54 what that produced there 00:12:58.57\00:12:59.91 but in Australia it was just antagonism 00:12:59.94\00:13:01.58 between the elements of the community. 00:13:01.61\00:13:03.68 And I remember on one occasion 00:13:03.71\00:13:05.05 someone exploded the garbage can, 00:13:05.08\00:13:07.05 probably put a firecracker or something in. 00:13:07.08\00:13:09.28 That was the closest to a terrorist action. 00:13:09.32\00:13:11.72 So here according to this 00:13:11.75\00:13:14.66 law review report, 00:13:14.69\00:13:18.09 they said this great threat to civil liberties 00:13:18.13\00:13:20.43 was coming under an anti-terrorism bill 00:13:20.46\00:13:22.90 and the bill will be set up this way. 00:13:22.93\00:13:25.97 They would establish an anti-terrorism Commissioner, 00:13:26.00\00:13:30.74 who would not be bound by the rules of evidence. 00:13:30.77\00:13:34.78 Now that's quite startling. 00:13:34.81\00:13:36.71 Both in Australia and England and also in the US, 00:13:36.75\00:13:42.35 there's the rules of Habeas corpus 00:13:42.38\00:13:44.29 and the conventions of, 00:13:44.32\00:13:47.36 you know, a trial by jury 00:13:47.39\00:13:48.79 and you know, all of these conventions of fair trial, 00:13:48.82\00:13:51.39 fair and speedy trial and you're innocent 00:13:51.43\00:13:53.86 until proven guilty and so on. 00:13:53.90\00:13:55.30 That wouldn't apply in this case. 00:13:55.33\00:13:56.77 He's not bound by the rules of evidence 00:13:56.80\00:13:59.30 and he would hold a secret list of terrorist organizations, 00:13:59.33\00:14:03.61 a secret list, never made public. 00:14:03.64\00:14:06.21 And if you belonged to a member 00:14:06.24\00:14:09.34 of one of these secretly listed organizations, 00:14:09.38\00:14:13.01 you would be subject to immediate 00:14:13.05\00:14:15.02 and arbitrary arrest 00:14:15.05\00:14:16.72 and imprisonment without trial 00:14:16.75\00:14:19.52 on hard labor for the rest of your life. 00:14:19.55\00:14:21.56 I mean, it's just... 00:14:21.59\00:14:22.92 You couldn't hardly credit such a thing. 00:14:22.96\00:14:24.73 And it clearly was a response 00:14:24.76\00:14:28.00 to the political pressure being brought 00:14:28.03\00:14:31.07 to gain release of Lindy Chamberlain. 00:14:31.10\00:14:35.24 A very sad situation. 00:14:35.27\00:14:37.51 I will speak a little bit more about it 00:14:37.54\00:14:39.07 after the break but stay with me. 00:14:39.11\00:14:41.68 And
