Thank you. 00:00:59.32\00:01:00.66 We've spoken before and... 00:01:00.69\00:01:03.36 So in some ways, this is a continuation. 00:01:03.39\00:01:06.19 And let's jump off on where we are now as we record, 00:01:06.23\00:01:09.50 and I doubt it'll change in the next few months. 00:01:09.53\00:01:12.03 We are in the second phase of the COVID epidemic, 00:01:12.07\00:01:15.04 the global COVID epidemic. 00:01:15.07\00:01:16.91 And I think it's something 00:01:16.94\00:01:18.27 around 4.5, 5 million people globally that have died. 00:01:18.31\00:01:21.54 Not yet close to the 00:01:21.58\00:01:23.65 so-called Spanish flu of about 50, 60 million, 00:01:23.68\00:01:26.51 but enough to catch the world's attention. 00:01:26.55\00:01:28.85 Oh, yes. 00:01:28.88\00:01:30.45 How would you place religious liberty 00:01:30.49\00:01:33.59 and Liberty Magazine 00:01:33.62\00:01:35.92 in the ongoing challenge with COVID? 00:01:35.96\00:01:41.63 How would you place this beginning with the failure 00:01:41.66\00:01:44.63 to designate church 00:01:44.67\00:01:46.00 and church activity as essential services? 00:01:46.03\00:01:49.70 Yeah, well, I think this whole situation is just 00:01:49.74\00:01:54.08 such a vivid reminder 00:01:54.11\00:01:57.71 of how fragile our civil liberties are. 00:01:57.75\00:02:00.92 I mean, clearly, public health measures 00:02:00.95\00:02:03.85 were absolutely vital in dealing 00:02:03.89\00:02:07.62 with this COVID situation. 00:02:07.66\00:02:09.66 But it has reinforced 00:02:09.69\00:02:12.19 just how willing we can be as individuals 00:02:12.23\00:02:15.46 to give up our freedoms in the face of fear, 00:02:15.50\00:02:19.63 you know, in exchange for perceived security. 00:02:19.67\00:02:23.51 And I think that is a stark warning 00:02:23.54\00:02:26.91 for us going into the future. 00:02:26.94\00:02:29.11 We need to be prepared. 00:02:29.14\00:02:31.18 You know, I think it was James Madison, 00:02:31.21\00:02:32.81 he said, you know, "It is proper to take alarm 00:02:32.85\00:02:36.55 at the first experiment on our liberties." 00:02:36.58\00:02:38.95 And I think we have been 00:02:38.99\00:02:41.82 shown in an incredibly vivid way 00:02:41.86\00:02:46.29 just how careful and vigilant we need to be. 00:02:46.33\00:02:49.23 And how fragile some of these liberties are 00:02:49.26\00:02:52.00 and certainly religious liberty as much as the others. 00:02:52.03\00:02:55.74 Yes. 00:02:55.77\00:02:57.11 But also, Lincoln, 00:02:57.14\00:02:58.47 it has shown us that as a nation, 00:02:58.51\00:03:00.74 we are finding it increasingly difficult 00:03:00.78\00:03:04.45 to talk about difficult issues. 00:03:04.48\00:03:06.68 It has showcased 00:03:06.72\00:03:09.58 just how broken 00:03:09.62\00:03:11.05 our political dialogue really is. 00:03:11.09\00:03:15.22 And I think that also is a warning for us 00:03:15.26\00:03:18.89 going into the future. 00:03:18.93\00:03:20.36 Because we know that 00:03:20.40\00:03:21.73 there will be contentious issues 00:03:21.76\00:03:23.10 that we'll have to deal with. 00:03:23.13\00:03:24.47 Yeah. 00:03:24.50\00:03:26.33 Are you aware of some of the state actions? 00:03:26.37\00:03:32.14 I was going to say legislation, 00:03:32.17\00:03:33.51 but I don't think legislation is the word. 00:03:33.54\00:03:35.51 But the governor, as I remember, 00:03:35.54\00:03:37.31 of Mississippi has passed 00:03:37.35\00:03:39.65 some edicts recently on dealing with COVID. 00:03:39.68\00:03:43.99 And someone sent me a copy. 00:03:44.02\00:03:45.35 It was the official document from the state. 00:03:45.39\00:03:48.26 And it says there, among other things, 00:03:48.29\00:03:50.76 that committal proceedings 00:03:50.79\00:03:52.99 can be done over the phone, an evaluation for committal. 00:03:53.03\00:03:57.20 Yeah. 00:03:57.23\00:03:58.57 And then as a follow up, I saw the connection. 00:03:58.60\00:04:02.14 The detention centers 00:04:02.17\00:04:03.57 where people will be sent 00:04:03.61\00:04:04.94 for not going along with some of these things, 00:04:04.97\00:04:07.74 they're not to be supervised as before given the emergency. 00:04:07.78\00:04:12.48 Do you remember 00:04:12.51\00:04:14.02 in the Soviet Union toward the end there? 00:04:14.05\00:04:16.69 The dissidents, not all of them religious, 00:04:16.72\00:04:20.09 but in particular, the religious dissidents 00:04:20.12\00:04:22.32 were treated by the state as mentally defective. 00:04:22.36\00:04:26.83 You remember? No. 00:04:26.86\00:04:28.23 They would determine them by definition, 00:04:28.26\00:04:31.37 with the religious mania, 00:04:31.40\00:04:32.73 not understanding things for their own good. 00:04:32.77\00:04:34.44 And they were declared mentally incompetent 00:04:34.47\00:04:36.91 and imprisoned and subjected 00:04:36.94\00:04:39.64 to chemical procedures 00:04:39.67\00:04:43.11 since they'd lost their rights. 00:04:43.14\00:04:45.25 And I don't think 00:04:45.28\00:04:46.61 it's much different for us today. 00:04:46.65\00:04:49.92 Well, I mean, authoritarian governments, 00:04:49.95\00:04:52.79 they will do anything to shore up their power. 00:04:52.82\00:04:56.59 Well, let me put it another way from my own perspective. 00:04:56.62\00:04:59.59 I personally think 00:04:59.63\00:05:01.23 there's an element of QAnon type craziness 00:05:01.26\00:05:04.67 for someone 00:05:04.70\00:05:06.03 that's just so adamantly opposed to immunization 00:05:06.07\00:05:10.11 as though it's, you know, it's the tool of the devil. 00:05:10.14\00:05:13.04 You and I are probably alive at the advanced ages we are. 00:05:13.07\00:05:17.45 You're not as much as me, 00:05:17.48\00:05:18.81 but you know, anything over 35 00:05:18.85\00:05:21.52 in previous ages was luck, it was the luck of the draw. 00:05:21.55\00:05:25.29 And it's only because of immunization 00:05:25.32\00:05:27.29 that we have the lifespans we have today. 00:05:27.32\00:05:29.96 So it's just flat-earth thinking to be 00:05:29.99\00:05:32.26 adamantly opposed to immunization. 00:05:32.29\00:05:34.86 So that sort of troubles me. 00:05:34.90\00:05:37.27 And yet, of course, there's a conscience aspect. 00:05:37.30\00:05:41.60 And someone, 00:05:41.64\00:05:43.07 if they're under deep conviction 00:05:43.10\00:05:44.47 that they don't want to take it, 00:05:44.51\00:05:45.84 that should be respected. 00:05:45.87\00:05:47.21 But I don't particularly respect 00:05:47.24\00:05:49.44 just paranoid thinking. 00:05:49.48\00:05:51.95 And so I can see it's drifting toward a time 00:05:51.98\00:05:55.78 when people that invoke religion 00:05:55.82\00:05:58.82 to not go along with public health, 00:05:58.85\00:06:01.02 in this case, procedures, 00:06:01.06\00:06:02.76 they could easily be determined to be out of their mind. 00:06:02.79\00:06:06.63 Right, right. 00:06:06.66\00:06:08.00 I mean, in many ways, what we're seeing here 00:06:08.03\00:06:10.67 is a stress test for our entire system, 00:06:10.70\00:06:13.27 for our legal system, for our social system, 00:06:13.30\00:06:17.71 for our ability to function together 00:06:17.74\00:06:19.77 as a diverse community. 00:06:19.81\00:06:22.14 It is a stress test 00:06:22.18\00:06:23.78 and we are seeing in many ways that 00:06:23.81\00:06:25.95 it's functioning exactly as it should. 00:06:25.98\00:06:28.98 Because, you know, 00:06:29.02\00:06:30.39 we see instances of churches being closed, 00:06:30.42\00:06:33.86 and we see challenges. 00:06:33.89\00:06:35.66 And we see courts making decisions 00:06:35.69\00:06:38.23 which we agree with and courts making decisions 00:06:38.26\00:06:40.26 we disagree with. 00:06:40.30\00:06:41.63 But the system is working more or less as it should. 00:06:41.66\00:06:45.73 But, you know, some of the instances 00:06:45.77\00:06:47.37 that you mentioned, 00:06:47.40\00:06:48.74 you know, changes in the way 00:06:48.77\00:06:50.24 people are detained, et cetera. 00:06:50.27\00:06:52.07 I mean, again, this is a stress test 00:06:52.11\00:06:55.44 for our constitutional system of government. 00:06:55.48\00:06:58.98 And we as individuals, people of faith need to be 00:06:59.01\00:07:03.18 aware of what, 00:07:03.22\00:07:04.85 not just what the consequences are now, 00:07:04.89\00:07:07.42 but as you say, what the consequences 00:07:07.46\00:07:09.69 could potentially be if left unchecked. 00:07:09.72\00:07:14.76 You're probably aware of the book, 00:07:14.80\00:07:16.23 and I'm sure over the many years, 00:07:16.26\00:07:17.90 I've mentioned it before. 00:07:17.93\00:07:19.27 But when I first started with Liberty, 00:07:19.30\00:07:21.34 I was more free 00:07:21.37\00:07:23.54 with my opinions to our power group, 00:07:23.57\00:07:25.84 our public affairs of religious liberty group 00:07:25.87\00:07:27.91 within the church. 00:07:27.94\00:07:29.44 And I was going on about the War Powers Act 00:07:29.48\00:07:34.88 that exists in the English and the Australian system. 00:07:34.92\00:07:38.09 And somebody recommended a book, 00:07:38.12\00:07:39.79 which I've since read by the Rehnquist, 00:07:39.82\00:07:44.09 the chief justice years ago. 00:07:44.13\00:07:46.59 And it was called, All The Laws But One. 00:07:46.63\00:07:48.60 Have you read it or heard of it? 00:07:48.63\00:07:49.96 I have not. 00:07:50.00\00:07:51.33 And it cites the Roman maxim that in times of war, 00:07:51.37\00:07:53.80 all the laws are silent. 00:07:53.84\00:07:55.44 Right. 00:07:55.47\00:07:57.04 And Rehnquist looks within the US history of times 00:07:57.07\00:08:01.71 when the law was swept aside. 00:08:01.74\00:08:04.38 And Abraham Lincoln was one. 00:08:04.41\00:08:05.75 He suspended Habeas corpus 00:08:05.78\00:08:07.18 because he saw enemies everywhere. 00:08:07.22\00:08:09.25 He arrested a couple of hundred so-called enemies. 00:08:09.28\00:08:12.42 No charge, no trial, just locked them up. 00:08:12.45\00:08:15.69 And he was ready to do the same to the Supreme Court Justice 00:08:15.72\00:08:18.56 who said this was incipient dictatorship, 00:08:18.59\00:08:20.53 but was finally dissuaded from doing it. 00:08:20.56\00:08:23.26 And so there's many cases of that. 00:08:23.30\00:08:25.37 I think that's what we are heading toward. 00:08:25.40\00:08:29.07 You and I both believe in Bible prophecy. 00:08:29.10\00:08:32.94 And Jesus said there'll be increasing calamities, 00:08:32.97\00:08:36.88 you know, by land and sea, 00:08:36.91\00:08:38.25 and earthquakes, and pestilences and so on, 00:08:38.28\00:08:40.18 although these are not the end. 00:08:40.22\00:08:41.55 Remember, it's persecution that's the real end sign. 00:08:41.58\00:08:45.89 But in those sort of stresses, historically, 00:08:45.92\00:08:48.49 even in stable democracies 00:08:48.52\00:08:50.43 bring sort of chinks in the armor, don't they? 00:08:50.46\00:08:53.76 We are under the emergency at hand. 00:08:53.80\00:08:56.77 People can be dealt with rather summarily 00:08:56.80\00:08:59.03 and prejudices kick in and so on. 00:08:59.07\00:09:02.84 Right. 00:09:02.87\00:09:04.21 I mean, you know, 00:09:04.24\00:09:05.57 just think of the Second World War. 00:09:05.61\00:09:06.94 The internment of Japanese nationals 00:09:06.98\00:09:10.11 or Japanese Americans. 00:09:10.15\00:09:12.58 We do have a tendency 00:09:12.61\00:09:14.32 to cling to our constitutional protections 00:09:14.35\00:09:17.62 until there is an emergency. 00:09:17.65\00:09:20.42 And that is why we need to be vigilant. 00:09:20.46\00:09:24.79 You know, I think, Lincoln, 00:09:24.83\00:09:26.16 that all the areas that you're talking about here. 00:09:26.19\00:09:30.60 I think you also need to 00:09:30.63\00:09:31.97 add another layer on top of that. 00:09:32.00\00:09:33.44 And that is the issue of technology 00:09:33.47\00:09:35.90 and how technology plays into all of this. 00:09:35.94\00:09:39.27 You know, we see in a country such as China, 00:09:39.31\00:09:43.08 an authoritarian regime. 00:09:43.11\00:09:45.01 Where technologies 00:09:45.05\00:09:46.82 are being developed that increase surveillance capacity 00:09:46.85\00:09:51.19 that allow the government to control... 00:09:51.22\00:09:53.46 I mean, I was interviewing Ambassador Sam Brownback 00:09:53.49\00:09:56.66 who, as you know, 00:09:56.69\00:09:58.03 was a former ambassador at large 00:09:58.06\00:09:59.56 for international religious freedom 00:09:59.59\00:10:00.96 under the previous president. 00:10:01.00\00:10:03.47 And he said one thing that keeps him awake at night 00:10:03.50\00:10:06.33 is the idea that China is digitizing its currency. 00:10:06.37\00:10:10.47 And if it succeeds in doing that, 00:10:10.51\00:10:13.61 then it has this sort of unparalleled power 00:10:13.64\00:10:15.98 over its populants. 00:10:16.01\00:10:17.55 You know, if the government 00:10:17.58\00:10:19.31 has something against a certain group 00:10:19.35\00:10:23.25 or religious community, you know, 00:10:23.28\00:10:25.69 it's just a flick of a switch, a turnover. 00:10:25.72\00:10:28.26 We're almost there too. 00:10:28.29\00:10:29.62 Haven't you noticed during the COVID emergency, 00:10:29.66\00:10:31.49 they've been withdrawing cash 00:10:31.53\00:10:34.46 and it's been less useful as in commerce? 00:10:34.50\00:10:40.44 There's an attempt to withdraw cash. 00:10:40.47\00:10:43.17 And we are heading toward a digital future. 00:10:43.20\00:10:47.04 It's interesting that he was worried by that, 00:10:47.08\00:10:48.94 but that is actually in the planning here. 00:10:48.98\00:10:51.71 Well, it's interesting. 00:10:51.75\00:10:53.08 I think what worried him in particular was that 00:10:53.11\00:10:55.58 it was actively being utilized by an authoritarian regime. 00:10:55.62\00:11:00.72 And its purpose was specifically to control 00:11:00.76\00:11:04.26 a certain group within China, which is the Uyghur Muslims. 00:11:04.29\00:11:08.06 As you know, you know, they are a persecuted group. 00:11:08.10\00:11:09.63 Yeah, I read an editorial on it once. 00:11:09.66\00:11:11.00 Yeah. 00:11:11.03\00:11:12.37 The systematic imprisonment and abuse, 00:11:12.40\00:11:14.37 and they're mixed up in China's physical traffic 00:11:14.40\00:11:17.31 and the bodies of prisoners. 00:11:17.34\00:11:19.34 And many of them are Uyghurs. Exactly. 00:11:19.37\00:11:22.14 And China is not only developing the technology, 00:11:22.18\00:11:24.58 it's exporting it. 00:11:24.61\00:11:25.95 And so you have Pakistan, 00:11:25.98\00:11:27.32 which is increasingly becoming an ally of China. 00:11:27.35\00:11:31.19 Has followed China's pattern in installing controls 00:11:31.22\00:11:36.62 on the internet to control the flow of information 00:11:36.66\00:11:39.53 that its populants can access via the internet. 00:11:39.56\00:11:42.96 And so these tools of repression are increasingly 00:11:43.00\00:11:47.70 being used by authoritarian regimes. 00:11:47.74\00:11:50.94 Now I only raise this 00:11:50.97\00:11:53.14 because I think going into the future, 00:11:53.17\00:11:56.08 we need to be aware that 00:11:56.11\00:11:58.18 we're not just talking about old fashioned term, 00:11:58.21\00:12:00.82 you know, methods of repression 00:12:00.85\00:12:03.02 and abridgement of civil liberties. 00:12:03.05\00:12:05.15 Now we need to be aware of the potential 00:12:05.19\00:12:07.52 of technology to be utilized. 00:12:07.56\00:12:10.39 Well, it's more than the potential. 00:12:10.43\00:12:11.76 It's here and now. 00:12:11.79\00:12:15.53 What we are... 00:12:15.56\00:12:16.90 And we can't be Luddites and oppose technology. 00:12:16.93\00:12:20.74 I think it's inevitable. 00:12:20.77\00:12:23.27 All we can do is be vigilant 00:12:23.30\00:12:24.97 and call out the wrong attitudes 00:12:25.01\00:12:27.74 in the powers of the be 00:12:27.78\00:12:29.61 or in society that's allowing this. 00:12:29.64\00:12:32.35 But we're not quite as advanced as China. 00:12:32.38\00:12:34.68 I've spoken to people that have visited China, 00:12:34.72\00:12:36.38 and there are cameras about every hundred yards 00:12:36.42\00:12:40.16 along major roads that are photographing you 00:12:40.19\00:12:42.29 and they notice when you deviate. 00:12:42.32\00:12:44.03 So they're tracking you 00:12:44.06\00:12:45.39 in the real world the whole time. 00:12:45.43\00:12:47.40 We have a bit of the same. 00:12:47.43\00:12:48.76 It's not by accident that every time there's a crime... 00:12:48.80\00:12:51.80 January 6th is case in point. 00:12:51.83\00:12:53.97 There are myriad pictures of people, 00:12:54.00\00:12:56.30 not just selfie shots, 00:12:56.34\00:12:58.71 almost everywhere you go 00:12:58.74\00:13:00.08 there's a camera photographing you. 00:13:00.11\00:13:02.38 And, of course, your own cell phone is spying on you. 00:13:02.41\00:13:06.48 There are downward looking 00:13:06.51\00:13:09.48 radar satellites that can see 00:13:09.52\00:13:11.45 and track you in your home. 00:13:11.49\00:13:12.82 I mean, it's endless. 00:13:12.85\00:13:14.52 And I don't see how we can hold back the technology, 00:13:14.56\00:13:17.96 but we do need to hold back the attitude 00:13:17.99\00:13:21.56 that breaks down what Justice Coke in England 00:13:21.60\00:13:25.40 said that, you know, 00:13:25.43\00:13:26.77 "An Englishman's home is his castle." 00:13:26.80\00:13:28.70 There has to be some place you can retreat 00:13:28.74\00:13:31.34 from oversight and monitoring. 00:13:31.37\00:13:34.74 Yes, absolutely. 00:13:34.78\00:13:36.11 You know, it's passA(C) now, 00:13:36.14\00:13:37.68 but way before I was with Liberty, 00:13:37.71\00:13:39.58 I used to write on 1984, the novel by George Orwell. 00:13:39.61\00:13:43.69 But, you know, that's almost the norm now. 00:13:43.72\00:13:47.09 I don't pay for cable, but cable gives the ability 00:13:47.12\00:13:51.96 for them to look at you, 00:13:51.99\00:13:54.00 exactly as the character in Orwell's novel 00:13:54.03\00:13:56.97 was being watched by the television. 00:13:57.00\00:13:59.20 We're becoming increasingly comfortable 00:13:59.23\00:14:01.20 with surveillance of all kinds. 00:14:01.24\00:14:03.00 Absolutely. 00:14:03.04\00:14:04.37 And I think that's with us till the end of time. 00:14:04.41\00:14:07.18 But it just means that we've got, 00:14:07.21\00:14:08.84 as you say, we've got to 00:14:08.88\00:14:10.21 up our game on protecting civil and religious liberty. 00:14:10.25\00:14:13.92 Yes. 00:14:13.95\00:14:15.28 Let's take a short break and then I'll come back 00:14:15.32\00:14:17.12 and we'll look ahead to the future, 00:14:17.15\00:14:18.95 and how you and Liberty Magazine 00:14:18.99\00:14:20.52 and all of us are going to relate to these challenges. 00:14:20.56\00:14:23.43
