Welcome back to the Liberty Insider 00:00:01.36\00:00:02.70 before the break with guest Greg Hamilton. 00:00:02.73\00:00:06.43 I am not, it doesn't take much doing, 00:00:06.47\00:00:08.94 I'm trying to extract some highlights 00:00:08.97\00:00:10.97 of your illustrious career 00:00:11.01\00:00:13.17 in religious liberty starting from... 00:00:13.21\00:00:15.38 We didn't quite start in the cradle, 00:00:15.41\00:00:16.88 but when you were young and what led you toward it. 00:00:16.91\00:00:19.81 And just before the break 00:00:19.85\00:00:21.18 you were talking about the Oregon, 00:00:21.22\00:00:23.15 what is it, the religious? 00:00:23.18\00:00:24.52 Oregon Workplace Religious Freedom Act. 00:00:24.55\00:00:25.89 Yeah, but it dealt 00:00:25.92\00:00:27.26 with religious garb a lot, right? 00:00:27.29\00:00:28.62 Well, it dealt with holy day accommodations for anybody 00:00:28.66\00:00:33.43 that had a particular Sabbath that they needed 00:00:33.46\00:00:36.13 to have accommodated in the workplace. 00:00:36.16\00:00:40.04 And that was interesting in and of itself, 00:00:40.07\00:00:41.87 we can talk more about the legal aspects in a minute 00:00:41.90\00:00:44.14 but what happened was, 00:00:44.17\00:00:47.24 we got the bill passed 00:00:47.28\00:00:48.61 in both the House and the Senate 00:00:48.64\00:00:50.75 and Governor Ted Kulongoski signed it, 00:00:50.78\00:00:53.45 but then immediately a number of religious minorities, 00:00:53.48\00:00:58.62 Sikhs, Hindus, Jewish sects, 00:00:58.65\00:01:03.66 and also Islamic sects wanted to repeal it, 00:01:03.69\00:01:07.76 because it didn't allow for the wearing 00:01:07.80\00:01:09.70 of any religious clothing or garb in the workplace... 00:01:09.73\00:01:12.33 Yeah, I guess, I was getting ahead of things. 00:01:12.37\00:01:13.70 In public schools, while teaching school. 00:01:13.74\00:01:16.57 And so teachers were basically barred from that 00:01:16.60\00:01:18.74 and they went back to that statute 00:01:18.77\00:01:21.34 in the bill that we passed and it remained. 00:01:21.38\00:01:26.15 Was a statute that went clear back to 1920, 00:01:26.18\00:01:28.68 and it was a statute 00:01:28.72\00:01:30.05 that was inspired by the Ku Klux Klan 00:01:30.09\00:01:32.75 in the state of Oregon at the time. 00:01:32.79\00:01:34.22 Governor Pierce was the governor 00:01:34.26\00:01:36.42 and both chambers in the House and the Senate, 00:01:36.46\00:01:39.69 Republicans and Democrats were basically owned 00:01:39.73\00:01:42.83 by the Ku Klux Klan 00:01:42.86\00:01:44.33 and claimed Ku Klux Klan membership, 00:01:44.37\00:01:46.90 it basically had become a very racist state. 00:01:46.94\00:01:49.64 And they believed that the greatest threat 00:01:49.67\00:01:53.11 to their sense of white supremacy 00:01:53.14\00:01:58.25 and if you will "Protestantism". 00:01:58.28\00:02:00.58 Well, that was Ku Klux Klan, it wasn't just racism, 00:02:00.62\00:02:03.89 it was a White Christian country. 00:02:03.92\00:02:09.09 And so by definition they were against Catholics and Jews. 00:02:09.12\00:02:12.79 Yes. Very much so. 00:02:12.83\00:02:14.60 And so, but they believed that communism. 00:02:14.63\00:02:17.00 I didn't wanna say Christian, Protestant, I meant Protestant. 00:02:17.03\00:02:18.97 Yeah, they believed that Communism 00:02:19.00\00:02:20.47 or Leninism at the time, 00:02:20.50\00:02:21.87 because of Lenin rising up in Russia 00:02:21.90\00:02:25.27 and creating a revolution there. 00:02:25.31\00:02:28.24 Would best or easiest to infiltrate 00:02:28.28\00:02:32.01 through Catholic schools and so they thought, 00:02:32.05\00:02:35.28 well, if it's through Catholic schools, 00:02:35.32\00:02:36.65 it might be even through Protestant schools too. 00:02:36.69\00:02:38.95 So they came up with this plan 00:02:38.99\00:02:41.66 and put a bill through the legislature 00:02:41.69\00:02:43.32 basically banning all religious schools. 00:02:43.36\00:02:45.59 All right, now go figure. 00:02:45.63\00:02:46.96 I mean, who would think of doing that? 00:02:47.00\00:02:48.33 And by the way it resulted in the greatest, 00:02:48.36\00:02:50.17 biggest religious freedom decision 00:02:50.20\00:02:53.27 by the US Supreme Court ever in American history. 00:02:53.30\00:02:56.04 It's called St. Mary's Academy 00:02:56.07\00:02:58.64 or Pierce v. Society of Sisters which is St. Mary's Academy 00:02:58.67\00:03:02.44 on 5th Street right there in Downtown Portland, Oregon. 00:03:02.48\00:03:05.75 And so they had, 00:03:05.78\00:03:08.88 the governor had signed the law, 00:03:08.92\00:03:11.22 the bill into law, 00:03:11.25\00:03:12.59 and it banned all religious schools, 00:03:12.62\00:03:15.16 so everybody was in a state of fear. 00:03:15.19\00:03:16.73 The Adventist Church came, 00:03:16.76\00:03:18.89 you know, wrote a Supreme Court brief, 00:03:18.93\00:03:21.26 it was one of the strongest ones actually, 00:03:21.30\00:03:24.70 and the Supreme Court ruled 9 to nothing against governor. 00:03:24.73\00:03:27.34 It said, are you nuts, you know, so that's, 00:03:27.37\00:03:30.54 that was interesting history but that, 00:03:30.57\00:03:32.71 there was a statute still remaining in our bill, 00:03:32.74\00:03:36.28 the Oregon Workplace Religious Freedom Act 00:03:36.31\00:03:39.15 that didn't allow any wearing of religious garb 00:03:39.18\00:03:42.18 or clothing in public school 00:03:42.22\00:03:43.75 while teachers were teaching in public school. 00:03:43.79\00:03:45.65 And it was aimed specifically at Catholic priests and nuns. 00:03:45.69\00:03:48.82 Okay, if they were to come in 00:03:48.86\00:03:50.49 and teach in public schools and so, 00:03:50.53\00:03:52.39 that still remained on the books. 00:03:52.43\00:03:54.16 And by the way there were still three states 00:03:54.20\00:03:56.06 that had that by the time 00:03:56.10\00:03:57.43 we passed the Oregon Workplace Religious Freedom Act. 00:03:57.47\00:04:00.24 Pennsylvania, Oregon and I believe Tennessee 00:04:00.27\00:04:04.01 were the three. 00:04:04.04\00:04:05.67 And so, the other two have been since repealed by the way, 00:04:05.71\00:04:09.64 but Oregon started that movement 00:04:09.68\00:04:11.78 to help the other states get it repealed. 00:04:11.81\00:04:13.15 And maybe for our viewers, 00:04:13.18\00:04:14.52 even though from time to time we've revisited the... 00:04:14.55\00:04:18.15 Religious freedom... 00:04:23.02\00:04:24.36 Religious Freedom Restoration Act. 00:04:24.39\00:04:26.23 Was passed on a federal level a long time ago, 00:04:26.26\00:04:28.13 what was it '96? 00:04:28.16\00:04:29.50 '93. 00:04:29.53\00:04:30.87 '93, it was in the 90s. 00:04:30.90\00:04:32.97 And it was declared unconstitutional 00:04:33.00\00:04:35.34 because it gained a lot of its... 00:04:35.37\00:04:37.74 And the Supreme Court decision called Boerne v. Flores, 1997. 00:04:37.77\00:04:40.54 Because it was piggybacked on inter-state commerce, right? 00:04:40.58\00:04:44.25 Yes. 00:04:44.28\00:04:45.61 Not because there was anything really wrong with the law 00:04:45.65\00:04:47.62 and since then, you as a major figure 00:04:47.65\00:04:51.19 and others tried to do the equivalent 00:04:51.22\00:04:53.86 by getting it state by state, right? 00:04:53.89\00:04:55.39 Yes, and we did that in Idaho in year 2000. 00:04:55.42\00:04:57.19 I know you had great success on it. 00:04:57.23\00:04:59.13 We had State Religious Freedom Restoration Act passed, 00:04:59.16\00:05:01.60 that was our first victory in 2000. 00:05:01.63\00:05:04.47 I'd come on board at the Union Conference office there 00:05:04.50\00:05:07.17 at the North Pacific Union in the year 1998, 00:05:07.20\00:05:10.61 and that was a huge victory for us 00:05:10.64\00:05:12.51 with Senator Grant Ipsen, who is now deceased. 00:05:12.54\00:05:15.51 And my good Mormon friend 00:05:15.54\00:05:18.31 who was just a dear, dear man. 00:05:18.35\00:05:20.65 Just a good soul and very conscientious person. 00:05:20.68\00:05:24.29 Now, when you got this through, 00:05:24.32\00:05:26.59 did you have any trouble with groups wanting to add, 00:05:26.62\00:05:30.86 add on bits and pieces to the basic bill 00:05:30.89\00:05:33.33 with their own agenda, 00:05:33.36\00:05:34.70 'cause that's the problem now in a nutshell? 00:05:34.73\00:05:36.06 Well, The American Civil Liberties Union, the ACLU, 00:05:36.10\00:05:38.60 you fought us tremendously including 00:05:38.63\00:05:40.47 with our Oregon Workplace Religious Freedom Act. 00:05:40.50\00:05:43.81 And by the way just to finish off 00:05:43.84\00:05:45.17 with the Oregon Workplace Religious Freedom Act, 00:05:45.21\00:05:47.64 when we, when the religious minorities, 00:05:47.68\00:05:50.85 the ethnic religious minorities 00:05:50.88\00:05:52.45 wanted to repeal our original victory 00:05:52.48\00:05:55.12 with the Oregon Workplace Religious Freedom Act, 00:05:55.15\00:05:57.62 we convinced them to stay on board. 00:05:57.65\00:06:01.16 After 10 years of effort to stay on board 00:06:01.19\00:06:03.26 to help us amend the bill 00:06:03.29\00:06:05.93 instead of repealing it, okay, 00:06:05.96\00:06:07.63 repealing the statute or the law 00:06:07.66\00:06:09.76 that we just passed the year before. 00:06:09.80\00:06:12.03 And so they decided to work with, 00:06:12.07\00:06:14.10 thanks to our representative Dave Hunt 00:06:14.14\00:06:16.50 who was a man called for such a time as that. 00:06:16.54\00:06:19.87 Former American Baptist Conference president nationwide 00:06:19.91\00:06:25.81 and he served as a short time 00:06:25.85\00:06:27.62 as speaker of the House there in Oregon. 00:06:27.65\00:06:29.78 And truly his power, 00:06:29.82\00:06:34.86 his consciousness 00:06:34.89\00:06:39.96 really worked in our behalf 00:06:40.00\00:06:41.53 and so we lobbied legislators day and night, 00:06:41.56\00:06:46.60 and the reason being 00:06:46.63\00:06:47.97 is because the ACLU 00:06:48.00\00:06:49.34 had convinced a number of Democratic legislators 00:06:49.37\00:06:52.84 to go ahead and repeal the bill. 00:06:52.87\00:06:55.24 That, because, but their reason was opposite. 00:06:55.28\00:06:59.68 Okay, their reason was they wanted 00:06:59.71\00:07:01.18 to keep the statute in there, 00:07:01.22\00:07:03.92 that the Ku Klux Klan put in there 00:07:03.95\00:07:06.99 regarding banning all religious garb 00:07:07.02\00:07:10.36 by public school teachers in public schools. 00:07:10.39\00:07:12.89 They wanted to keep that in place to ban that. 00:07:12.93\00:07:15.60 'Cause they kept religion out of the public schools. 00:07:15.63\00:07:16.97 In the name of the constitutional separation 00:07:17.00\00:07:18.57 of church and state which is an irony in itself. 00:07:18.60\00:07:20.97 But Attorney Steve Greene 00:07:21.00\00:07:23.57 from Willamette University School of Law 00:07:23.61\00:07:25.37 which is right across the street from Salem. 00:07:25.41\00:07:28.11 The Oregon legislature there in Salem 00:07:28.14\00:07:30.38 came to our defense 00:07:30.41\00:07:31.75 and he was the biggest proponent of the ACLU, 00:07:31.78\00:07:34.15 one of their chief spokesmen, okay. 00:07:34.18\00:07:36.45 So he backed them down 00:07:36.48\00:07:38.72 and yet we still had to convince legislators, 00:07:38.75\00:07:41.16 in fact, going into the, 00:07:41.19\00:07:44.33 both the House and the Senate for votes and debate. 00:07:44.36\00:07:47.83 We had a number of them, who said, 00:07:47.86\00:07:49.70 "No, we're gonna vote to repeal." 00:07:49.73\00:07:52.70 And when we got there, Dave Hunt even came to me, 00:07:52.73\00:07:55.64 the speaker of the House, he says, 00:07:55.67\00:07:57.84 "I don't know what's going to happen 00:07:57.87\00:07:59.21 but this does not look good." 00:07:59.24\00:08:00.58 And so, just sit in the chamber and we'll see how it comes out. 00:08:00.61\00:08:03.85 I had the worst ulcer I've ever heard in my life 00:08:03.88\00:08:06.11 when I was sitting up there in the chamber 00:08:06.15\00:08:08.02 and I'm telling you it was a miracle, 00:08:08.05\00:08:10.15 especially the Senate one. 00:08:10.19\00:08:11.65 We got it through the House just fine, 00:08:11.69\00:08:13.09 at 66% of the vote, okay. 00:08:13.12\00:08:16.06 But the Senate was the most dramatic 00:08:16.09\00:08:17.83 where one by one Democratic senators got up 00:08:17.86\00:08:20.43 and said, I've changed my mind and here's why. 00:08:20.46\00:08:25.03 And one of the reasons that drove them 00:08:25.07\00:08:26.90 to change their mind 00:08:26.94\00:08:28.67 was the fact that when they understood 00:08:28.70\00:08:30.81 the Ku Klux Klan historical connection, 00:08:30.84\00:08:34.01 that really convicted them. 00:08:34.04\00:08:36.08 And number two, the other reason, 00:08:36.11\00:08:37.85 this is the irony 00:08:37.88\00:08:39.78 is that there were a number of Republicans 00:08:39.81\00:08:41.28 who were very pro big business. 00:08:41.32\00:08:43.69 And they didn't want to accommodate anybody 00:08:43.72\00:08:45.25 for anything in the workplace. 00:08:45.29\00:08:46.76 It was all about the mighty dollar bill 00:08:46.79\00:08:49.02 and they said, "Oh, it affects small businesses." 00:08:49.06\00:08:51.49 So they voted against it, 00:08:51.53\00:08:53.03 but nevertheless as Democrats came through 00:08:53.06\00:08:56.06 and we had another 66% vote in the Senate. 00:08:56.10\00:08:58.77 You pulled it off. 00:08:58.80\00:09:00.14 So then we had our April Fool's Day 00:09:00.17\00:09:01.87 signing ceremony on April 1st with Governor Ted Kulongoski 00:09:01.90\00:09:05.14 with that famous... 00:09:05.17\00:09:06.51 That picture. 00:09:06.54\00:09:07.88 It's a beautiful picture on April 1. 00:09:07.91\00:09:09.24 And we can't show it here, 00:09:09.28\00:09:10.61 but go on the Liberty website and you'll see it. 00:09:10.65\00:09:12.61 Yeah, it's just amazing and... 00:09:12.65\00:09:14.92 But what... We're running out of time, 00:09:14.95\00:09:16.69 but one thing that I got out of that 00:09:16.72\00:09:18.59 and hearing it again from you, 00:09:18.62\00:09:20.29 this was not a simple thing, 00:09:20.32\00:09:22.29 it involved a lot of people, 00:09:22.32\00:09:23.79 and a lot of time, and a lot of persistence. 00:09:23.83\00:09:25.83 Yeah, it did. 00:09:25.86\00:09:28.23 And religious liberty 00:09:28.26\00:09:29.60 is not something to take casually? 00:09:29.63\00:09:30.97 No. 00:09:31.00\00:09:32.33 It rewards consistent and diligent effort, 00:09:32.37\00:09:33.70 doesn't it? 00:09:33.74\00:09:35.07 There's a lot of nuance and substance involved 00:09:35.10\00:09:36.54 when it comes to defending 00:09:36.57\00:09:38.67 and passing religious freedom bills. 00:09:38.71\00:09:41.64 I'm thankful for the career 00:09:41.68\00:09:44.11 that God has given me to be a sentinel 00:09:44.15\00:09:47.98 on the walls of religious freedom, 00:09:48.02\00:09:51.95 and I wouldn't trade that for anything. 00:09:51.99\00:09:56.56 I would do it all over again, 00:09:56.59\00:09:58.13 and I love the ministry of religious freedom. 00:09:58.16\00:10:01.56 And I would encourage you that if you are young, 00:10:01.60\00:10:05.10 and you're watching this program, 00:10:05.13\00:10:06.77 you're a boy or a girl, 00:10:06.80\00:10:09.40 and you want to champion 00:10:09.44\00:10:10.77 true religious freedom in this country, 00:10:10.81\00:10:12.14 you wanna be a true American patriot. 00:10:12.17\00:10:14.44 I would encourage you to go to school, 00:10:14.48\00:10:18.25 get your college degrees, whatever it takes, 00:10:18.28\00:10:20.98 become either an attorney, a historian, a business person, 00:10:21.02\00:10:25.19 a nurse, and doctor, whatever. 00:10:25.22\00:10:27.49 But set out to make your life goal 00:10:27.52\00:10:29.96 to champion religious freedom, both in your home, 00:10:29.99\00:10:34.43 in the workplace and at your state legislature. 00:10:34.46\00:10:38.57 Thank you. God bless. 00:10:38.60\00:10:39.93 Only a few years ago, it seems George Bush Sr. 00:10:46.17\00:10:49.81 was commenting that freedom and democracy 00:10:49.84\00:10:53.11 seems to be breaking out all over the world. 00:10:53.15\00:10:55.12 Well, those days are past, authoritarianism, 00:10:55.15\00:10:59.15 and despotism, and repression, 00:10:59.19\00:11:01.79 and visceral sort of nationalistic movements 00:11:01.82\00:11:05.39 are the order of the day in our day. 00:11:05.43\00:11:08.40 And often, very often religious conflict 00:11:08.43\00:11:12.13 is the center of this movement. 00:11:12.17\00:11:14.04 It's very unfortunate 00:11:14.07\00:11:15.40 that religion seems to be hastening 00:11:15.44\00:11:18.27 these bad tendencies. 00:11:18.31\00:11:20.04 Much better as we promote religious freedom, 00:11:20.08\00:11:23.01 and tolerance, and respect, 00:11:23.04\00:11:25.21 and allowance for all faiths of conscience. 00:11:25.25\00:11:27.92 Much better that that's the movement. 00:11:27.95\00:11:30.39 Much better that we work to the day for that 00:11:30.42\00:11:32.79 to break out all over. 00:11:32.82\00:11:36.22 For Liberty Insider, this is Lincoln Steed. 00:11:36.26\00:11:38.69
