Welcome back to the Liberty Insider. 00:00:03.63\00:00:05.87 Before the break with guest Charles Steinberg 00:00:05.90\00:00:09.10 we were going through some of the exciting battles 00:00:09.14\00:00:12.54 and victories 00:00:12.57\00:00:13.91 that the Northwest Religious Liberty Association 00:00:13.94\00:00:15.71 is carried on, 00:00:15.74\00:00:17.45 and you've been a big part of that 00:00:17.48\00:00:18.81 for quite a few years. 00:00:18.85\00:00:20.75 Where else can we pick it up? 00:00:20.78\00:00:22.12 What are some of the other exciting moments 00:00:22.15\00:00:25.15 for your activities? 00:00:25.19\00:00:26.52 We can pick it up a couple areas, 00:00:26.55\00:00:28.29 both into Inmates Rights. 00:00:28.32\00:00:30.09 You know, in the Bible, it says, 00:00:30.13\00:00:32.46 "I was hungry, you gave me something to eat. 00:00:32.49\00:00:34.66 I was in jail and you visited me." 00:00:34.70\00:00:36.77 So there was a fellow, 00:00:36.80\00:00:39.23 he was a fellow inmate 00:00:39.27\00:00:42.07 in Washington Correctional Institution. 00:00:42.10\00:00:44.04 He was in for murder. 00:00:44.07\00:00:45.41 His name is Joe Macomb. 00:00:45.44\00:00:46.84 And Joe Macomb is Native American 00:00:46.88\00:00:49.71 by birth and by culture. 00:00:49.74\00:00:51.58 I remember this case. Yeah. 00:00:51.61\00:00:53.25 And Joe Macomb wanted to participate in Bible studies 00:00:53.28\00:00:58.95 with the Seventh-day Adventist and other Christian groups. 00:00:58.99\00:01:02.52 Now in a prison situation, 00:01:02.56\00:01:04.16 the government has a compelling interest 00:01:04.19\00:01:06.23 in making sure there's order in the prison. 00:01:06.26\00:01:08.56 And Joe Macomb contacted our office. 00:01:08.60\00:01:11.63 And he said he's not allowed to have Bible studies 00:01:11.67\00:01:14.37 with Christians because he's a Native American. 00:01:14.40\00:01:17.34 So it was the right says 00:01:17.37\00:01:19.57 for data for American traditional practices, 00:01:19.61\00:01:22.71 coming at odds with Christian religious accommodation, 00:01:22.74\00:01:25.51 wasn't that? 00:01:25.55\00:01:26.88 Yes. 00:01:26.92\00:01:28.25 In the State of Washington... 00:01:28.28\00:01:29.62 And they were trying to deny you can have one 00:01:29.65\00:01:30.99 or the other but not both. 00:01:31.02\00:01:32.35 The State of Washington 00:01:32.39\00:01:33.72 when you go into a prison system, 00:01:33.76\00:01:35.09 you have a piece of paper, you check the box. 00:01:35.12\00:01:37.56 What is your religious preference? 00:01:37.59\00:01:39.29 Native American, Protestant, Baptist, Jewish, Muslim, 00:01:39.33\00:01:44.53 and it was to the exclusion of the others 00:01:44.57\00:01:46.84 how the rules interpreted. 00:01:46.87\00:01:48.70 And Chaplain Tom Sasse, 00:01:48.74\00:01:51.07 a very ardent Catholic man, chaplain, 00:01:51.11\00:01:54.18 had a very firm belief that Native Americans 00:01:54.21\00:01:56.54 could not fellowship with Christians. 00:01:56.58\00:02:00.05 Because Native Americans only worship spirit animals 00:02:00.08\00:02:03.55 and only worship spirits. 00:02:03.59\00:02:05.59 And so Chaplain Sasse took away 00:02:05.62\00:02:09.72 Mr. Macomb's Bible, 00:02:09.76\00:02:11.53 took away a cross, 00:02:11.56\00:02:12.89 that he had gone through a bunch of Bible studies 00:02:12.93\00:02:14.30 with the statement scrolls. 00:02:14.33\00:02:15.66 It's a bizarre situation. They took away his cross. 00:02:15.70\00:02:18.03 And at the deposition, that the State of Washington 00:02:18.07\00:02:21.70 and the Seventh-day Adventist Church General Counsel took, 00:02:21.74\00:02:25.64 they learned that Chaplain Sasse 00:02:25.67\00:02:27.41 had all these prejudices against Native Americans 00:02:27.44\00:02:30.21 that wanted a dual religion status. 00:02:30.25\00:02:33.65 And the Deputy Attorney General that was listening on the case, 00:02:33.68\00:02:38.29 basically, once you heard the deposition, 00:02:38.32\00:02:40.36 the sworn evidence, 00:02:40.39\00:02:42.79 we're going to go ahead and change 00:02:42.82\00:02:44.16 this administrative rule in the state of Washington. 00:02:44.19\00:02:47.10 It'll take a while for us to do that. 00:02:47.13\00:02:48.53 But we're going to change the law 00:02:48.56\00:02:50.00 for the benefit of all... 00:02:50.03\00:02:51.47 And that's the best sort of case to have 00:02:51.50\00:02:53.30 not just to win that case, 00:02:53.34\00:02:55.00 but to write the result large for other people. 00:02:55.04\00:02:58.01 But again, it was application of a law 00:02:58.04\00:03:01.78 that had a lot of broad support 00:03:01.81\00:03:03.55 that was signed by President Clinton 00:03:03.58\00:03:05.61 on the Religious Land Use 00:03:05.65\00:03:07.42 and Institutionalized Persons Act. 00:03:07.45\00:03:09.98 It was a great victory. 00:03:10.02\00:03:11.35 And I learned later from Monte Church 00:03:11.39\00:03:13.72 that it became a template 00:03:13.76\00:03:15.12 that other states and their prison systems used 00:03:15.16\00:03:17.99 to not have as much dissension in a prison. 00:03:18.03\00:03:20.16 Now, you got to explain who's Monte Church? 00:03:20.20\00:03:21.53 Okay. 00:03:21.56\00:03:22.90 Monte Church is the director of Native American Ministries 00:03:22.93\00:03:25.47 within the Seventh-day Adventist Church at the, 00:03:25.50\00:03:27.60 I believe, the North Pacific Union Conferences, 00:03:27.64\00:03:29.27 I believe is... 00:03:29.30\00:03:30.64 You know, I know he's native, 00:03:30.67\00:03:32.01 I didn't know at that time what he was doing. 00:03:32.04\00:03:33.38 But that's one of the things I learned. 00:03:33.41\00:03:34.74 It's a great victory. 00:03:34.78\00:03:36.28 You know, some of the other things 00:03:36.31\00:03:37.65 that we've done over the last 21 years 00:03:37.68\00:03:39.11 at the Northwest Religious Liberty Association, 00:03:39.15\00:03:41.88 is we've conducted about 3,700 mediations. 00:03:41.92\00:03:47.52 And that's when an employee 00:03:47.56\00:03:49.06 is asking for a religious accommodation, 00:03:49.09\00:03:51.73 or they need a letter 00:03:51.76\00:03:53.09 so that they can change the date of a test 00:03:53.13\00:03:56.70 and the law is not favorable for most accommodations 00:03:56.73\00:04:01.84 except in Oregon, 00:04:01.87\00:04:03.20 which changed 00:04:03.24\00:04:04.87 the TWA versus Hardison standard. 00:04:04.91\00:04:07.44 And a lot of times most people of faith, 00:04:07.48\00:04:09.24 they want to be a good witness for their employer. 00:04:09.28\00:04:12.55 They want to be able to be a good employee 00:04:12.58\00:04:14.78 not get written up, 00:04:14.82\00:04:16.15 not get disciplined, not to get fired. 00:04:16.18\00:04:17.52 Yeah, they shouldn't have to make a choice 00:04:17.55\00:04:18.89 between their faith 00:04:18.92\00:04:20.26 and their stewardship as an employee. 00:04:20.29\00:04:22.02 Yeah. 00:04:22.06\00:04:23.39 And there's legal precedent that makes that difficult. 00:04:23.43\00:04:25.59 Another area that we've had great success 00:04:25.63\00:04:27.66 and believe it or not, back in 2010, 00:04:27.70\00:04:30.87 there was a bill dropped in the Olympia Legislature 00:04:30.90\00:04:35.27 to have forced unionization of all childcare workers 00:04:35.30\00:04:39.27 in the State of Washington. 00:04:39.31\00:04:41.21 And the Seventh-day Adventist Church 00:04:41.24\00:04:43.38 I think back in 1974, or '72, 00:04:43.41\00:04:45.95 had a paper basically 00:04:45.98\00:04:48.25 against some aspects of labor union membership. 00:04:48.28\00:04:51.62 Some members are members of labor unions, 00:04:51.65\00:04:53.72 some members aren't. 00:04:53.76\00:04:55.09 But one of the things that I like to look at is 00:04:55.12\00:04:57.83 how good a witness are you for your faith, 00:04:57.86\00:05:01.03 if you're going to do economic harm to your boss 00:05:01.06\00:05:03.60 by going out on strike. 00:05:03.63\00:05:05.47 There are legitimate reasons for labor unions. 00:05:05.50\00:05:07.74 And you know, I think... 00:05:07.77\00:05:09.10 I'm glad you say that because that's the one area 00:05:09.14\00:05:11.04 I don't quite whew historic view, 00:05:11.07\00:05:14.51 even though I'm certain 00:05:14.54\00:05:17.31 that at some point of conflict 00:05:17.35\00:05:21.02 in the USSR unions 00:05:21.05\00:05:22.55 could again be a huge problem. 00:05:22.58\00:05:25.75 I think it's a mixed bag at the moment. 00:05:25.79\00:05:27.99 And there are some clear advantages 00:05:28.02\00:05:29.39 to Eugene activity. 00:05:29.42\00:05:30.76 Yeah. 00:05:30.79\00:05:32.13 One of my very early cases 00:05:32.16\00:05:33.50 in Northwest Religious Liberty Association 00:05:33.53\00:05:34.93 involved the plight of a cashier 00:05:34.96\00:05:37.50 at a place called Fred Meyer. 00:05:37.53\00:05:38.97 And Fred Meyer s a large grocery store 00:05:39.00\00:05:41.07 and multi retail operation. 00:05:41.10\00:05:45.44 And this one lady, 00:05:45.47\00:05:46.81 she wanted to go celebrate Easter 00:05:46.84\00:05:48.68 at her church. 00:05:48.71\00:05:50.11 And she was Catholic. 00:05:50.15\00:05:52.68 Her manager was Catholic also. 00:05:52.71\00:05:54.92 And he said, "Well, you know, 00:05:54.95\00:05:56.48 we will just go together to lunch break, 00:05:56.52\00:05:58.72 have communion, and then come back to work." 00:05:58.75\00:06:00.89 And she's like, "No, you don't understand. 00:06:00.92\00:06:02.59 I want to celebrate the entire day of Easter 00:06:02.62\00:06:05.49 and the Resurrection. 00:06:05.53\00:06:06.86 I want my grandkids to be a part of it. 00:06:06.90\00:06:08.83 I want to take the full day off." 00:06:08.86\00:06:10.20 And he goes, "Nope. 00:06:10.23\00:06:11.57 I made the schedule, you have to do that." 00:06:11.60\00:06:13.23 And so on behalf 00:06:13.27\00:06:14.60 of the Northwest Religious Liberty Association, 00:06:14.64\00:06:17.17 we reached out to Fred Meyer, 00:06:17.21\00:06:19.27 wrote a nice letter to the union shop steward for, 00:06:19.31\00:06:22.21 'cause she's a member of labor union. 00:06:22.24\00:06:24.28 And also wrote a letter to, I think, was in Beaverton, 00:06:24.31\00:06:27.12 Oregon was where Fred Meyer's headquarters was. 00:06:27.15\00:06:30.82 And the manager was very livid that they would go to a lawyer 00:06:30.85\00:06:34.49 to write a letter like that. 00:06:34.52\00:06:36.19 And the union shop steward, he was very much, well, 00:06:36.22\00:06:39.16 we paid double time. 00:06:39.19\00:06:41.03 And so I've got like five volunteers 00:06:41.06\00:06:42.76 wanting to take a place on the shift. 00:06:42.80\00:06:44.13 Yeah. 00:06:44.17\00:06:45.50 So it was no problem just the manager's suffice. 00:06:45.53\00:06:46.90 Just the manager's intransigence. 00:06:46.94\00:06:48.84 And a lot of time it really is just education 00:06:48.87\00:06:50.67 to educate somebody and not their... 00:06:50.71\00:06:52.17 That's the lesson I've got out of it. 00:06:52.21\00:06:56.58 Nine, ten, so much more than that 00:06:56.61\00:06:58.81 of these issues 00:06:58.85\00:07:00.18 are so right out of the gate. 00:07:00.22\00:07:01.95 It's just some communication to the employer 00:07:01.98\00:07:04.35 that this person really has a legal right 00:07:04.39\00:07:08.26 to be accommodated. 00:07:08.29\00:07:09.62 And can you do it or whatever, and then it's sort of smooth. 00:07:09.66\00:07:11.36 It's when it goes further 00:07:11.39\00:07:12.73 that it gets complicated, isn't it? 00:07:12.76\00:07:14.20 Yes. It does. It does. 00:07:14.23\00:07:15.80 One of the other... 00:07:15.83\00:07:17.20 And it's not a sure bet to go the full run. 00:07:17.23\00:07:19.87 One of the other victories 00:07:19.90\00:07:21.27 we had early on was in a public school setting. 00:07:21.30\00:07:25.94 There was a fourth grader 00:07:25.97\00:07:27.31 in Washington State Public School 00:07:27.34\00:07:29.71 that had free reading time. 00:07:29.74\00:07:31.91 And the fourth grader being a Bible believer, 00:07:31.95\00:07:36.02 brought her Bible with her 00:07:36.05\00:07:37.39 to read during free reading time. 00:07:37.42\00:07:39.25 And the teacher went up and confiscated the Bible 00:07:39.29\00:07:41.69 and said, "Separation of church and state, 00:07:41.72\00:07:43.73 you can't have your Bible here at the public school ground." 00:07:43.76\00:07:47.20 And the grandparents called our office. 00:07:47.23\00:07:50.97 And I said, "You know, 00:07:51.00\00:07:52.57 we can do this three different ways. 00:07:52.60\00:07:54.17 One, I can send a mean letter to the teacher 00:07:54.20\00:07:56.30 and the principal. 00:07:56.34\00:07:57.84 Number two, and threatened the law suit. 00:07:57.87\00:08:00.68 Number two, I can print out these regulations 00:08:00.71\00:08:03.24 from the Federal Department of Education 00:08:03.28\00:08:05.51 about what's allowed and not allowed. 00:08:05.55\00:08:08.05 And you and your daughter can go have a meeting 00:08:08.08\00:08:10.25 with the principal in person." 00:08:10.29\00:08:13.15 And not, you wouldn't go? 00:08:13.19\00:08:14.52 I wasn't involved with that. 00:08:14.56\00:08:15.89 I would get involved if they refuse to change. 00:08:15.92\00:08:18.83 And they said that... 00:08:18.86\00:08:20.20 The third thing to do is to do nothing. 00:08:20.23\00:08:22.16 And let these people run over 00:08:22.20\00:08:25.03 your fourth grader's constitutional rights. 00:08:25.07\00:08:27.67 And the path they chose was to take the printouts 00:08:27.70\00:08:31.17 that I had done, 00:08:31.21\00:08:32.54 to go talk to the principal and the teacher 00:08:32.57\00:08:35.48 and the teacher gotten education. 00:08:35.51\00:08:37.88 And their fourth grader 00:08:37.91\00:08:39.25 was able to get her Bible back and use it. 00:08:39.28\00:08:40.62 It worked out beautifully. Yeah. 00:08:40.65\00:08:41.98 Over the years in Liberty, 00:08:42.02\00:08:43.49 we've had many articles on this. 00:08:43.52\00:08:44.92 And this might takeaway, 00:08:44.95\00:08:47.16 that it's usually overzealous teachers 00:08:47.19\00:08:50.26 and school administration, 00:08:50.29\00:08:52.09 not any great move 00:08:52.13\00:08:53.56 against religious liberty of the schools. 00:08:53.60\00:08:57.07 And different... 00:08:57.10\00:08:59.43 Well, I wouldn't call them religious liberty groups, 00:08:59.47\00:09:01.20 but different religious groups that are claiming harassment 00:09:01.24\00:09:03.84 and you know, they really want the largest share of society. 00:09:03.87\00:09:06.27 They're always quoting these cases, 00:09:06.31\00:09:09.58 and they don't illustrate any more than then misguided 00:09:09.61\00:09:14.05 overzealous actions by an individual. 00:09:14.08\00:09:18.99 The law is very plain that the student is allowed 00:09:19.02\00:09:22.26 to share their faith in that environment. 00:09:22.29\00:09:23.76 Exactly. Yeah. 00:09:23.79\00:09:25.26 That reminds me of another case. 00:09:25.29\00:09:26.80 Not necessarily in schools, but in employment law. 00:09:26.83\00:09:30.77 A person contacted me, 00:09:30.80\00:09:32.13 my cell phone rang and it was a church member 00:09:32.17\00:09:35.24 of the Seventh-day Adventist Church, 00:09:35.27\00:09:36.60 named Jeffrey Britt. 00:09:36.64\00:09:37.97 Jeffrey Britt had a great career in the Navy. 00:09:38.01\00:09:40.84 And then after he retired from the Navy, 00:09:40.88\00:09:43.95 he wanted to go back to work for the Navy on the civil side, 00:09:43.98\00:09:47.85 helping with the library for mechanics 00:09:47.88\00:09:51.85 on very sensitive areas. 00:09:51.89\00:09:54.19 And his employer was very hostile to him 00:09:54.22\00:09:58.76 having Sabbath's off, 00:09:58.79\00:10:00.13 from sundown Friday to sundown Saturday. 00:10:00.16\00:10:02.33 They started writing him up. 00:10:02.36\00:10:03.73 They made him use his vacation time. 00:10:03.77\00:10:05.50 That was direct hostility. 00:10:05.53\00:10:06.87 They didn't like the whole of it. 00:10:06.90\00:10:08.24 Direct hostility. 00:10:08.27\00:10:09.60 And my cell phone rang, and Jeff told me that 00:10:09.64\00:10:11.94 they want me to sign this document 00:10:11.97\00:10:13.41 and they said, it'll all go away. 00:10:13.44\00:10:15.04 He faxes me the document, I read it, 00:10:15.08\00:10:16.91 and it says that his boss 00:10:16.95\00:10:18.51 would take sensitivity training. 00:10:18.55\00:10:20.82 And he could get fired 00:10:20.85\00:10:22.78 if he didn't report on the Sabbath, essentially, 00:10:22.82\00:10:25.19 is the summary of the form that they thought 00:10:25.22\00:10:27.26 was an accommodation. 00:10:27.29\00:10:28.62 The boss would take or he would have to take it? 00:10:28.66\00:10:30.93 He would get written that... 00:10:30.96\00:10:32.29 The boss would take the sensitivity training, 00:10:32.33\00:10:34.60 and that he'd still get fired 00:10:34.63\00:10:36.00 and no accommodation for the Sabbath. 00:10:36.03\00:10:37.37 Oh, I see. Yeah. 00:10:37.40\00:10:38.73 So anyway, we intervene, 00:10:38.77\00:10:40.64 the Northwest Religious Liberty Association intervened. 00:10:40.67\00:10:43.57 We had a day long mediator 00:10:43.61\00:10:46.27 with two federal mediators on the case. 00:10:46.31\00:10:49.08 He actually got a refund of his vacation pay that he had taken. 00:10:49.11\00:10:51.08 Wow! It was very good. 00:10:51.11\00:10:52.45 So it worked out well. 00:10:52.48\00:10:53.82 Yes, it worked out very well. 00:10:53.85\00:10:55.92 But that's not always the case. 00:10:55.95\00:10:57.89 But it's important to have people 00:10:57.92\00:10:59.25 that stand up for their religious liberty, 00:10:59.29\00:11:01.16 whether it be in the school, 00:11:01.19\00:11:03.06 in the workplace, even in athletics, 00:11:03.09\00:11:05.76 in high school athletics, 00:11:05.79\00:11:07.86 standing up for your faith, 00:11:07.90\00:11:09.43 'cause someone will be there to take it away from you 00:11:09.46\00:11:11.20 if you're not standing up for it. 00:11:11.23\00:11:15.34 I've always been attracted to history, 00:11:15.37\00:11:18.04 the study of history. 00:11:18.07\00:11:19.71 But I must admit, 00:11:19.74\00:11:21.08 I've not always seen it the same way. 00:11:21.11\00:11:25.01 When I was young history was dates, 00:11:25.05\00:11:27.12 and places, and times, and people. 00:11:27.15\00:11:31.02 Most people today see history more as the trend of events 00:11:31.05\00:11:34.86 and a grand story. 00:11:34.89\00:11:37.89 When I look at religious liberty 00:11:37.93\00:11:39.59 in the United States, 00:11:39.63\00:11:40.96 and as this program underlined in the North West, 00:11:41.00\00:11:45.33 there's no question 00:11:45.37\00:11:47.00 that the story of religious liberty protected 00:11:47.04\00:11:50.01 and advanced 00:11:50.04\00:11:52.07 is a story. 00:11:52.11\00:11:53.74 There are many wonderful anecdotal instances 00:11:53.78\00:11:57.41 of great victories 00:11:57.45\00:11:58.78 and a few stumbles along the way. 00:11:58.81\00:12:01.62 But there's no question that great people, 00:12:01.65\00:12:04.09 and great moments have all come together 00:12:04.12\00:12:07.76 to tell a story at this telling, at this day, 00:12:07.79\00:12:11.76 a religious liberty safe and sound. 00:12:11.79\00:12:15.23 I pray that the continuing efforts 00:12:15.26\00:12:18.10 of Attorney Steinberg 00:12:18.13\00:12:20.47 and many of his fellows and other groups 00:12:20.50\00:12:22.54 and other locations within that area 00:12:22.57\00:12:25.44 that they can continue those great successes. 00:12:25.47\00:12:29.81 For Liberty Insider, this is Lincoln Steed. 00:12:29.84\00:12:32.45
