Welcome to the Liberty Insider. 00:00:26.09\00:00:27.89 This is a program designed to bring you up-to-date 00:00:27.92\00:00:30.86 on religious liberty and the dynamic 00:00:30.89\00:00:32.93 that lies behind it in our world today. 00:00:32.96\00:00:36.00 My name is Lincoln Steed, editor of Liberty Magazine. 00:00:36.03\00:00:39.63 And my guest on the program is Charles Steinberg, 00:00:39.67\00:00:44.84 attorney and vice president 00:00:44.87\00:00:47.54 of the Northwest Religious Liberty Association. 00:00:47.58\00:00:49.91 Thank you, Lincoln. 00:00:49.94\00:00:51.28 Welcome to the program. 00:00:51.31\00:00:53.62 I want to talk about 00:00:53.65\00:00:54.98 the Northwest Religious Liberty Association 00:00:55.02\00:00:56.69 and what you've discovered in, 00:00:56.72\00:00:59.05 what is it 20 years or so, you've been associated with it. 00:00:59.09\00:01:02.06 Yes. 00:01:02.09\00:01:03.59 I know a lot of things have happened. 00:01:03.63\00:01:05.09 I know some but I want you to tell me and, 00:01:05.13\00:01:07.83 of course, our viewers. 00:01:07.86\00:01:09.96 You know, what are the some of the highlights, 00:01:10.00\00:01:12.40 you don't have to do them in chronological point? 00:01:12.43\00:01:14.77 But let's go over some of the things that 00:01:14.80\00:01:16.67 this wonderful organization 00:01:16.71\00:01:18.07 has been able to do in that quadrant 00:01:18.11\00:01:20.21 of the United States for religious liberty. 00:01:20.24\00:01:22.34 Yeah, very happy to share that with you. 00:01:22.38\00:01:25.25 One of the things that we've done 00:01:25.28\00:01:27.18 is it actually started out, 00:01:27.22\00:01:28.55 I think was my second year 00:01:28.58\00:01:29.92 being involved in the organization. 00:01:29.95\00:01:32.25 We had to do some legislative advocacy 00:01:32.29\00:01:34.56 and with threats of litigation. 00:01:34.59\00:01:36.76 One of the largest population centers 00:01:36.79\00:01:38.56 in Washington State is the town of Seattle. 00:01:38.59\00:01:41.40 And Seattle's within this larger county 00:01:41.43\00:01:44.77 called King County. 00:01:44.80\00:01:46.67 And King County enacted 00:01:46.70\00:01:48.04 these great large comprehensive land use rules, 00:01:48.07\00:01:53.81 saying what you can and can't do 00:01:53.84\00:01:55.18 with your land in rural areas. 00:01:55.21\00:01:57.65 And one of the things that they said was that, 00:01:57.68\00:02:00.18 if you were a private school or a church 00:02:00.22\00:02:03.39 in rural King County, 00:02:03.42\00:02:05.75 you could not remodel it 00:02:05.79\00:02:07.62 and you could not build on your land. 00:02:07.66\00:02:11.03 And in this large update of documents, 00:02:11.06\00:02:14.23 they didn't come right out and say that. 00:02:14.26\00:02:16.23 How they said it was that, 00:02:16.26\00:02:17.97 if you are a public school with a large footprint, 00:02:18.00\00:02:21.54 and you needed to either remodel your public school 00:02:21.57\00:02:24.91 in the rural area, 00:02:24.94\00:02:26.88 you could have a, or build a new one, 00:02:26.91\00:02:29.44 you could have a septic tank 00:02:29.48\00:02:32.01 and a drain field to take care of your necessary business. 00:02:32.05\00:02:34.68 Now did you find out what really lay behind this? 00:02:34.72\00:02:37.75 Was this a purposeful, 00:02:37.79\00:02:40.69 a plan to drive church schools out of areas 00:02:40.72\00:02:45.16 or was it just a byproduct of some other intent? 00:02:45.19\00:02:49.36 I believe it was a probably a byproduct 00:02:49.40\00:02:51.70 of some other intent. 00:02:51.73\00:02:53.07 They were very much against gentrification. 00:02:53.10\00:02:55.04 They wanted to preserve these wide swathes 00:02:55.07\00:02:58.14 of rural land away from development. 00:02:58.17\00:03:01.41 And believe it or not, in my personal belief, 00:03:01.44\00:03:03.75 there was a very anti Catholic issue going on 00:03:03.78\00:03:07.92 because the Catholic Archdiocese of Seattle 00:03:07.95\00:03:11.49 owned a lot of land by Snoqualmie Falls. 00:03:11.52\00:03:14.22 If you ever driven between Seattle and Spokane on I-90, 00:03:14.26\00:03:17.39 Snoqualmie Falls is a beautiful place to see. 00:03:17.43\00:03:20.56 But they were going to develop their retreat center. 00:03:20.60\00:03:23.13 I did numerology work for the tourist company. 00:03:23.16\00:03:25.67 Retreat center, retreat center and conference room. 00:03:25.70\00:03:29.04 It's a lovely part of the world. 00:03:29.07\00:03:30.41 Yeah, it is. 00:03:30.44\00:03:31.77 The Northwest quadrant, I think is, 00:03:31.81\00:03:33.14 I better be careful or I'll be in trouble, 00:03:33.17\00:03:34.51 but it's arguably one of the most beautiful sections 00:03:34.54\00:03:38.11 of the United States. 00:03:38.15\00:03:39.48 Anyway, they were going to build a conference center 00:03:39.51\00:03:40.85 and a retreat center on their own land 00:03:40.88\00:03:43.28 that they owned since the early 1920s. 00:03:43.32\00:03:46.25 And some folks in King County said, 00:03:46.29\00:03:48.62 "No, we can't have that." 00:03:48.66\00:03:49.99 So we're going to enact a moratorium. 00:03:50.03\00:03:51.86 And the vote was 11 to 2 to enact a moratorium 00:03:51.89\00:03:55.36 on any building permits for churches or private schools 00:03:55.40\00:03:58.57 in rural areas of King County. 00:03:58.60\00:04:00.94 And that's, it has a drastic impact 00:04:00.97\00:04:03.24 on any church. 00:04:03.27\00:04:05.67 And so we formed a coalition of the Catholic Church, 00:04:05.71\00:04:10.21 the Seventh-day Adventist Church, 00:04:10.25\00:04:12.48 Baptist Churches, and went and testified 00:04:12.51\00:04:16.15 in front of the King County Metropolitan County Council. 00:04:16.18\00:04:19.02 And just six years earlier, President Bill Clinton, 00:04:19.05\00:04:21.92 I'm showing my age now, 00:04:21.96\00:04:23.39 President Bill Clinton signed this federal law 00:04:23.43\00:04:25.86 into effect called the Religious Land Use 00:04:25.89\00:04:28.86 and Institutionalized Persons Act, 1994. 00:04:28.90\00:04:32.67 I was wondering when you gonna bring this into it. 00:04:32.70\00:04:34.04 Yeah. Anyway... 00:04:34.07\00:04:35.40 But this was before or after that. 00:04:35.44\00:04:36.77 So Clinton signed that into law. 00:04:36.81\00:04:38.14 Because that was he really answering 00:04:38.17\00:04:40.48 a generalized concern. 00:04:40.51\00:04:41.84 It's not just in your area 00:04:41.88\00:04:43.21 that this sort of thing was happening. 00:04:43.24\00:04:44.58 That was on a nationwide basis... 00:04:44.61\00:04:45.95 And in some places, 00:04:45.98\00:04:47.32 and this is what I was fishing for, 00:04:47.35\00:04:48.68 in some places, 00:04:48.72\00:04:50.85 I remember one particular case in Georgia. 00:04:50.89\00:04:55.79 There was a Hispanic company that wanted to build a church 00:04:55.82\00:04:59.19 in a certain neighborhood, 00:04:59.23\00:05:00.96 and the neighborhood rallied 00:05:01.00\00:05:02.96 to drive them out of their area. 00:05:03.00\00:05:04.83 They said they had a hearing, they said, 00:05:04.87\00:05:06.70 "We don't want you people there. 00:05:06.74\00:05:08.10 We don't want your faith, we don't want you." 00:05:08.14\00:05:11.24 So it was, on occasion this was very prejudicial. 00:05:11.27\00:05:14.38 Yeah. 00:05:14.41\00:05:15.74 And it's basically prejudicial because people don't know you, 00:05:15.78\00:05:19.08 they think it's a strange thing. 00:05:19.11\00:05:20.48 So therefore, they're going to get 00:05:20.52\00:05:21.85 the force of law to oust you, 00:05:21.88\00:05:23.92 even after you bought the land, 00:05:23.95\00:05:25.29 even after you close the loan on your mortgage. 00:05:25.32\00:05:26.65 Now in their defense, 00:05:26.69\00:05:28.12 not that it's generally defensible 00:05:28.16\00:05:31.23 but there's social changes I think. 00:05:31.26\00:05:34.36 And like one for example, 00:05:34.40\00:05:36.03 I drive an hour and a half to work 00:05:36.06\00:05:38.13 before the mobility of cars 00:05:38.17\00:05:42.74 is more easily available today and lower price gas 00:05:42.77\00:05:46.71 and all the rest of people wouldn't go so far. 00:05:46.74\00:05:49.38 And a church community, 00:05:49.41\00:05:51.15 usually the people were drawn from around the area 00:05:51.18\00:05:53.45 so it is a social stress often 00:05:53.48\00:05:57.05 to have a church building in neighborhood, 00:05:57.09\00:05:58.89 but all the attendees or a large number of them 00:05:58.92\00:06:01.36 come from somewhere else. 00:06:01.39\00:06:03.59 It doesn't justify their prejudice, 00:06:03.63\00:06:05.26 but there is a social shift and the social stress 00:06:05.29\00:06:09.96 that might not have been in a more traditional era. 00:06:10.00\00:06:12.93 Yeah. 00:06:12.97\00:06:14.30 What King County did basically was they used basically a tank 00:06:14.34\00:06:17.61 when probably something a little more surgical 00:06:17.64\00:06:19.51 could have been appropriate. 00:06:19.54\00:06:22.91 I still remember 00:06:22.94\00:06:24.28 the Maple Valley Community Church, 00:06:24.31\00:06:26.35 they had done all their pre-application meetings 00:06:26.38\00:06:28.95 to do what they could do 00:06:28.98\00:06:30.32 to build a multiple multi use facility 00:06:30.35\00:06:33.79 for banquets and potlucks and also a gymnasium 00:06:33.82\00:06:38.39 at the back of their worship hall. 00:06:38.43\00:06:40.40 And they actually had won the lottery 00:06:40.43\00:06:43.16 in Washington State Water Resources 00:06:43.20\00:06:45.37 at that time probably still are scarce. 00:06:45.40\00:06:48.14 And you'd have to actually enter a lottery 00:06:48.17\00:06:50.14 with the Department of Ecology 00:06:50.17\00:06:51.81 to be able to get a water right. 00:06:51.84\00:06:53.68 And they had won the lottery, 00:06:53.71\00:06:55.81 and they also closed on their loan, 00:06:55.84\00:06:57.65 their building loan. 00:06:57.68\00:06:59.01 So here they're paying interest on this loan. 00:06:59.05\00:07:00.92 And then King County comes along and says, 00:07:00.95\00:07:02.45 "No, you can't build." 00:07:02.48\00:07:04.19 A moratorium, so they had actual real damages... 00:07:04.22\00:07:06.92 Doesn't pass the fairness test, do they? 00:07:06.96\00:07:08.29 No. 00:07:08.32\00:07:09.66 So they had actual real damages mounting. 00:07:09.69\00:07:11.13 And so I got to testify 00:07:11.16\00:07:12.83 at the King County Council meeting 00:07:12.86\00:07:14.53 and they looked at every council member in the eye 00:07:14.56\00:07:16.56 and said, "You know, this new federal law 00:07:16.60\00:07:18.63 provides actual money damages 00:07:18.67\00:07:21.20 to people that are harmed in there 00:07:21.24\00:07:24.21 because of their faith 00:07:24.24\00:07:26.17 in their land use decisions that you guys have made." 00:07:26.21\00:07:28.84 And they had another vote to lift the ban, 00:07:28.88\00:07:33.11 and the vote in favor of lifting the ban. 00:07:33.15\00:07:34.95 And the moratorium was seven to six. 00:07:34.98\00:07:38.05 And then believe it or not... 00:07:38.09\00:07:39.92 So it wasn't the resounding victory. 00:07:39.95\00:07:41.99 No, but it was to lift the moratorium immediately 00:07:42.02\00:07:44.66 under threat of litigation. 00:07:44.69\00:07:46.36 And then the other thing was 00:07:46.39\00:07:48.43 is that even after the ban was lifted, 00:07:48.46\00:07:50.33 the Department of Construction Land Use 00:07:50.37\00:07:52.67 in King County, 00:07:52.70\00:07:54.04 they were still having problems 00:07:54.07\00:07:55.40 processing applications from churches 00:07:55.44\00:07:56.91 and people of faith and private schools. 00:07:56.94\00:07:59.61 And they actually, the King County Council 00:07:59.64\00:08:03.41 did a referendum and said 00:08:03.45\00:08:05.08 to the all the voters of King County, 00:08:05.11\00:08:07.38 "Should we enact the protections 00:08:07.42\00:08:08.88 of the Washington State Constitution 00:08:08.92\00:08:11.25 and the US Constitution into our building 00:08:11.29\00:08:13.62 and land use code?" 00:08:13.66\00:08:15.82 And even in Washington State and King County, 00:08:15.86\00:08:20.93 that was a resounding victory. 00:08:20.96\00:08:22.86 Seventy percent people voted in favor of that referendum. 00:08:22.90\00:08:26.37 But for me, it's common sense, you know, 00:08:26.40\00:08:29.97 you don't discriminate on that basis. 00:08:30.01\00:08:32.34 And they were justifying with all sorts of reasons. 00:08:32.37\00:08:35.01 Now, I was listening to you before, 00:08:35.04\00:08:37.08 but this was before the passage of the Clinton. 00:08:37.11\00:08:42.28 This is after. 00:08:42.32\00:08:43.65 We used our loophole within I think four years 00:08:43.69\00:08:45.65 after passing this view. 00:08:45.69\00:08:47.02 No, the religious land usage. 00:08:47.06\00:08:48.39 Yes, and to go after it. 00:08:48.42\00:08:49.76 And then we've done quite a bit 00:08:49.79\00:08:51.13 in the Northwest Religious Liberty Association, 00:08:51.16\00:08:53.23 not only on the advocacy point of view on that side, 00:08:53.26\00:08:57.57 we've also assisted in changing laws to... 00:08:57.60\00:09:00.77 So what I read from that, even with a bill in place, 00:09:00.80\00:09:05.44 you still had to argue the toss pretty vigorously. 00:09:05.47\00:09:08.21 You do. Yeah, you know, okay. 00:09:08.24\00:09:10.45 So in law school, 00:09:10.48\00:09:11.81 one of my professors always taught me 00:09:11.85\00:09:13.18 if you don't use your rights, you lose them. 00:09:13.21\00:09:15.32 If you don't stand up, 00:09:15.35\00:09:16.69 someone's gonna be there to put you down. 00:09:16.72\00:09:18.15 So it's not quite like a boxer, but you do need to stand up. 00:09:18.19\00:09:21.19 Well, and it's true. That's what I've learned. 00:09:21.22\00:09:23.36 I mean, the US Constitution 00:09:23.39\00:09:24.73 is not being directly tinkered with much. 00:09:24.76\00:09:28.16 But there was a statement made by Ellen White, 00:09:28.20\00:09:34.14 "A person that early Adventist belief 00:09:34.17\00:09:36.81 heads divine insights." 00:09:36.84\00:09:40.81 And she wrote about at the end of time, 00:09:40.84\00:09:42.21 and she said that they will come a time 00:09:42.24\00:09:43.65 when the US will put aside 00:09:43.68\00:09:45.11 every principle of its constitution. 00:09:45.15\00:09:47.98 And at different times, I thought, 00:09:48.02\00:09:49.85 "How could that happen?" 00:09:49.88\00:09:51.22 And I know other people have even thought reading that. 00:09:51.25\00:09:54.12 Well, maybe there'll be some sort 00:09:54.16\00:09:55.49 of constitutional convention where you repudiated. 00:09:55.52\00:09:58.49 I don't think so 00:09:58.53\00:09:59.86 because you can have even such major principles. 00:09:59.89\00:10:02.66 And if they're not defended and confirmed regularly, 00:10:02.70\00:10:05.87 they just sort of fall away, don't they? 00:10:05.90\00:10:08.27 People forget about them. 00:10:08.30\00:10:10.17 And then if you forget about them 00:10:10.21\00:10:13.34 or don't use them 00:10:13.38\00:10:14.71 and don't constantly remind them, 00:10:14.74\00:10:16.08 "Oh, you can't do that, Mr. Constable," 00:10:16.11\00:10:18.71 even in the area of search and seizure. 00:10:18.75\00:10:20.68 Well, and the Supreme Court are constantly picking up 00:10:20.72\00:10:23.42 on laws that are passed at different levels. 00:10:23.45\00:10:27.22 When you see it, it's sort of playing 00:10:27.26\00:10:28.69 but somehow when they pass, 00:10:28.72\00:10:30.56 they either didn't recognize or care 00:10:30.59\00:10:32.33 that they were in direct opposition 00:10:32.36\00:10:34.20 to basic constitutional principles. 00:10:34.23\00:10:37.03 So I've learned that. Yes. 00:10:37.07\00:10:39.10 You need to defend the laws, watching scrupulously. 00:10:39.13\00:10:41.84 And then unfortunately, 00:10:41.87\00:10:43.84 if it's not challenged early on, 00:10:43.87\00:10:46.11 it becomes part of the legal precedent 00:10:46.14\00:10:48.04 and it has... 00:10:48.08\00:10:49.48 It can write a weight of its own. 00:10:49.51\00:10:50.85 It can be a very negative legal precedent. 00:10:50.88\00:10:52.91 In 1976, the US Supreme Court 00:10:52.95\00:10:55.65 decided the case and I'm sorry, folks, 00:10:55.68\00:10:57.42 I'm going to bore you into some legalese. 00:10:57.45\00:10:59.92 They decided a case called TWA versus Hardison. 00:10:59.95\00:11:03.96 And Mr. Hardison wanted a religious accommodation 00:11:03.99\00:11:09.83 for working for their religious beliefs. 00:11:09.86\00:11:14.04 And the Supreme Court's came out and said that, 00:11:14.07\00:11:16.94 "We don't have to accommodate your religious beliefs 00:11:16.97\00:11:20.38 if it is a de minimis expense." 00:11:20.41\00:11:22.88 Now, for those of you to... 00:11:22.91\00:11:24.25 Yeah, had a few articles on this. 00:11:24.28\00:11:25.61 Yeah, if you are managing a household budget, 00:11:25.65\00:11:28.82 a de minimis expense is, 00:11:28.85\00:11:30.79 instead of buying six oranges, 00:11:30.82\00:11:32.49 I'm only going to buy five oranges. 00:11:32.52\00:11:35.09 I actually heard a lawyer argue against me 00:11:35.12\00:11:37.03 that the de minimis expense is even doing, 00:11:37.06\00:11:40.06 writing the ink to do a shift swap. 00:11:40.10\00:11:43.00 So they're vanishing enough, I often say 00:11:43.03\00:11:44.73 it's like a dollars worth of trouble might satisfied. 00:11:44.77\00:11:47.20 Yes. 00:11:47.24\00:11:48.57 But in the Northwest Religious Liberty Association, 00:11:48.60\00:11:50.91 one of our great victories was to... 00:11:50.94\00:11:54.01 And up till then it would have to be an undue hardship. 00:11:54.04\00:11:58.31 An undue hardship and de minimis expense, 00:11:58.35\00:12:02.55 those don't seem to jive right. 00:12:02.58\00:12:04.69 And so in Oregon, 00:12:04.72\00:12:06.05 what the Northwest Religious Liberty Association 00:12:06.09\00:12:07.86 was able to do, 00:12:07.89\00:12:09.22 along with the coalition of people of other faith 00:12:09.26\00:12:11.19 and the legislature and the governor's desk 00:12:11.23\00:12:13.56 was to basically overturn that 00:12:13.60\00:12:16.00 from all employees in Oregon. 00:12:16.03\00:12:18.70 That now an employer has to show 00:12:18.73\00:12:20.07 a significant difficulty or expense. 00:12:20.10\00:12:23.37 Otherwise they have to accommodate 00:12:23.41\00:12:24.74 a person's religious faith in the workplace. 00:12:24.77\00:12:26.61 That's a huge victory, Lincoln! Yeah, it's a victory. 00:12:26.64\00:12:28.74 But even as you say it significant, 00:12:28.78\00:12:31.28 what does that mean? 00:12:31.31\00:12:32.65 It means more than de minimis. 00:12:32.68\00:12:34.02 That's for sure. That's for sure. 00:12:34.05\00:12:35.58 Okay. I'll agree with that. 00:12:35.62\00:12:36.95 But we're close to a break 00:12:36.99\00:12:41.16 but the risk of diverting too much. 00:12:41.19\00:12:43.86 It seems to me that 00:12:43.89\00:12:45.73 that strength and the weakness 00:12:45.76\00:12:47.86 at the same time have a lot of what's written 00:12:47.90\00:12:49.70 into the Constitution 00:12:49.73\00:12:51.53 is what amounts to generalize broad language. 00:12:51.57\00:12:56.87 I think that it when you consider 00:12:56.91\00:12:59.67 that the Constitution and the Bill of Rights 00:12:59.71\00:13:03.38 when you take those together, 00:13:03.41\00:13:05.28 they're meant to be a roadmap 00:13:05.31\00:13:07.62 for the Federal Government. 00:13:07.65\00:13:09.05 There was a reaction 00:13:09.08\00:13:10.42 to the Articles of Confederation. 00:13:10.45\00:13:11.79 That was a very loose federal system. 00:13:11.82\00:13:14.12 And then when you read the documents 00:13:14.16\00:13:15.49 in the Federalist, 00:13:15.52\00:13:17.26 you get to see that 00:13:17.29\00:13:18.63 there's a strong argument to be made, 00:13:18.66\00:13:20.23 that these are the areas that the federal government 00:13:20.26\00:13:22.63 should be active in. 00:13:22.66\00:13:24.90 I, in my during law school, 00:13:24.93\00:13:26.67 I had arguments with my law school professor over, 00:13:26.70\00:13:32.24 can the United States govern 00:13:32.27\00:13:33.81 how much a farmer in Tennessee grows on a corner of his crop? 00:13:33.84\00:13:38.95 And the Supreme Court said, "Yes, you can legislate that." 00:13:38.98\00:13:43.22 That sounds like another program. 00:13:43.25\00:13:44.85 We'll take a short break and be back. 00:13:44.89\00:13:47.82 Talking about the Northwest Religious Liberty Association 00:13:47.86\00:13:50.73 and maybe the Constitution too. 00:13:50.76\00:13:52.46 Stay with us. 00:13:52.49\00:13:53.83
