Yes. 00:01:20.91\00:01:22.48 It's your last moment on earth, 00:01:22.51\00:01:25.55 you know? 00:01:25.58\00:01:26.92 We usually think of the priest, 00:01:26.95\00:01:28.85 for the Catholics shriving someone, 00:01:28.88\00:01:31.15 you know, at the last moment 00:01:31.19\00:01:32.75 or the chaplain in the military bending over 00:01:32.79\00:01:35.42 and giving those last words, that's the last charity, 00:01:35.46\00:01:38.09 even if it's your worst enemy, right? 00:01:38.13\00:01:39.46 Right. 00:01:39.49\00:01:40.83 You at least be kind to them. 00:01:40.86\00:01:42.23 You give them a Bible or whatever. 00:01:42.26\00:01:43.60 But here, it's withheld by government edict, right? 00:01:43.63\00:01:45.63 Right. 00:01:45.67\00:01:47.00 Now, what led to such a thing in the United States? 00:01:47.04\00:01:49.40 Well, that's an interesting question, 00:01:49.44\00:01:52.11 and I don't really know the answer. 00:01:52.14\00:01:54.04 I don't know why the court ruled the way it did. 00:01:54.08\00:01:56.34 There's been a lot of speculation about that. 00:01:56.38\00:01:59.95 I know why they said they ruled the way they did, 00:01:59.98\00:02:02.02 but I don't believe it. 00:02:02.05\00:02:03.39 So recount it again. Okay. 00:02:03.42\00:02:04.75 I sort of hopscotched in the middle of the story. 00:02:04.79\00:02:07.12 Just to get people's attention, but what happened? 00:02:07.16\00:02:09.12 So Dominique Ray 00:02:09.16\00:02:10.49 was a Muslim prisoner in Alabama 00:02:10.53\00:02:13.70 who is being executed? 00:02:13.73\00:02:16.00 What was his crime, by the way? 00:02:16.03\00:02:17.93 I'm sure, murder or something? 00:02:17.97\00:02:19.30 Murder, yes. 00:02:19.33\00:02:20.67 But I don't remember 00:02:20.70\00:02:22.04 the circumstances of the murder. 00:02:22.07\00:02:23.47 It was pretty brutal 'cause most capital crimes are brutal. 00:02:23.51\00:02:25.57 Yeah. 00:02:25.61\00:02:26.94 But regardless of that, 00:02:26.98\00:02:30.01 the prison had a policy that only allowed... 00:02:30.05\00:02:33.72 They had a Christian chaplain, no other chaplains. 00:02:33.75\00:02:36.82 They only allowed the Christian chaplain 00:02:36.85\00:02:38.85 to be present in the chamber. 00:02:38.89\00:02:41.02 Other people could watch from the viewing room, 00:02:41.06\00:02:43.26 but only the Christian chaplain was allowed in the chamber. 00:02:43.29\00:02:45.26 I have a question. 00:02:45.29\00:02:46.63 I read your article, but I don't remember this. 00:02:46.66\00:02:48.83 When did he convert to Islam? 00:02:48.86\00:02:51.57 I don't remember. 00:02:51.60\00:02:53.44 Was it in prison? 00:02:53.47\00:02:55.04 I don't remember. 00:02:55.07\00:02:56.40 I don't know 00:02:56.44\00:02:57.77 if that was a factor in the case. 00:02:57.81\00:02:59.14 It just occurred to me. 00:02:59.17\00:03:00.51 It doesn't change the legal situation, 00:03:00.54\00:03:02.41 but it may explain the resistance 00:03:02.44\00:03:05.91 if he had been a convert in prison 00:03:05.95\00:03:07.88 because I know the authorities are very troubled 00:03:07.92\00:03:10.49 against recruitment to radical Islam in prisons. 00:03:10.52\00:03:14.06 Well, I don't think that that was a factor. 00:03:14.09\00:03:16.12 It certainly wasn't a factor in the circuit court decision 00:03:16.16\00:03:18.96 because the 11th circuit, which in Alabama, 00:03:18.99\00:03:21.26 as you can imagine, 00:03:21.30\00:03:22.63 is one of the most conservative circuits. 00:03:22.66\00:03:24.00 Yeah. 00:03:24.03\00:03:25.37 So their decision was very strong. 00:03:25.40\00:03:28.57 They basically said, it's clear in the Constitution, 00:03:28.60\00:03:32.41 which it is, under laws, 00:03:32.44\00:03:35.24 under decisions that go back 70 years, 00:03:35.28\00:03:38.71 that the government can't discriminate 00:03:38.75\00:03:40.45 between religions, 00:03:40.48\00:03:41.88 that it has to treat all religions equally. 00:03:41.92\00:03:45.19 So that decision by the circuit court 00:03:45.22\00:03:48.62 was very, very clear. 00:03:48.66\00:03:51.63 So it went up to the Supreme Court, 00:03:51.66\00:03:54.26 and the Supreme Court basically, 00:03:54.30\00:03:56.46 the majority decision was essentially one paragraph 00:03:56.50\00:04:00.54 saying his appeal was not timely. 00:04:00.57\00:04:03.54 Now that decision was, 00:04:03.57\00:04:06.64 in my opinion, and many people, 00:04:06.68\00:04:08.51 many commentators I've read, 00:04:08.54\00:04:10.35 completely disingenuous 00:04:10.38\00:04:13.35 because although he knew 00:04:13.38\00:04:15.78 he was going to be executed back 00:04:15.82\00:04:17.75 in November, 00:04:17.79\00:04:19.12 he only became aware 00:04:19.15\00:04:20.56 that his request to have the imam 00:04:20.59\00:04:22.12 in the chamber was denied on January 23... 00:04:22.16\00:04:25.73 Too close for the appeal, right? 00:04:25.76\00:04:27.20 He appealed it on January 28. 00:04:27.23\00:04:29.76 So he waited less than five days. 00:04:29.80\00:04:31.87 So there is really no... 00:04:31.90\00:04:33.94 And this is what the dissent... 00:04:33.97\00:04:36.20 Elena Kagan wrote the dissent. 00:04:36.24\00:04:38.47 And she pointed out 00:04:38.51\00:04:40.11 that their timeliness argument really didn't make any sense, 00:04:40.14\00:04:43.75 but that was the only rationale they gave. 00:04:43.78\00:04:46.18 So the implication was clear. 00:04:46.21\00:04:48.88 And Kagan wrote a very clear dissent 00:04:48.92\00:04:50.85 as well talking about how... 00:04:50.89\00:04:54.16 Citing the multiple cases 00:04:54.19\00:04:56.12 that say you can't discriminate 00:04:56.16\00:04:57.79 based on somebody's religious beliefs. 00:04:57.83\00:05:01.96 And, of course, 00:05:02.00\00:05:04.23 the majority ignored it and he died without the imam. 00:05:04.27\00:05:08.30 So that was a very, very disturbing. 00:05:08.34\00:05:10.37 But I don't even understand the timely argument 00:05:10.41\00:05:13.41 on certain things where it's an inherent right. 00:05:13.44\00:05:18.88 I'm sure there was a chaplain in close proximity. 00:05:18.91\00:05:21.62 Couple of hours before the event, 00:05:21.65\00:05:23.72 they could have easily gotten someone. 00:05:23.75\00:05:25.59 Well, there was also discussion. 00:05:25.62\00:05:26.96 So that's an argument of protocol 00:05:26.99\00:05:28.96 on a principle that should be automatic. 00:05:28.99\00:05:31.66 Well, yes, 00:05:31.69\00:05:33.29 and you find the court doing that a lot 00:05:33.33\00:05:36.77 when they want to dodge the merits of an issue. 00:05:36.80\00:05:41.44 They will rely on procedural grounds 00:05:41.47\00:05:44.71 that happened in the Masterpiece Cake, 00:05:44.74\00:05:46.57 by the way, that it was a decision 00:05:46.61\00:05:48.21 made on procedural grounds, not on the merits. 00:05:48.24\00:05:50.35 Yeah, I know. And so that's why... 00:05:50.38\00:05:52.38 And we can talk about that elsewhere, right? 00:05:52.41\00:05:54.02 On that cake thing, very little was settled. 00:05:54.05\00:05:57.15 And so I understand that they only, 00:05:57.19\00:05:59.35 not only, they primarily were favorable 00:05:59.39\00:06:01.99 to the cake baker because he had been vilified 00:06:02.02\00:06:04.83 after the fact by some gang groups. 00:06:04.86\00:06:06.39 Right because statements that were made 00:06:06.43\00:06:08.13 by the antidiscrimination organization. 00:06:08.16\00:06:09.50 Yeah, so it really doesn't settle anything. 00:06:09.53\00:06:10.87 So it was not. 00:06:10.90\00:06:12.77 It was not a decision on the merits. 00:06:12.80\00:06:14.30 So they like to avoid making decisions on the merits 00:06:14.34\00:06:16.87 when the merits are uncomfortable. 00:06:16.91\00:06:18.77 So in this case, they used timeliness, 00:06:18.81\00:06:20.71 which is clearly, in my opinion, 00:06:20.74\00:06:22.64 not at all a viable explanation. 00:06:22.68\00:06:25.81 The other issue in the case that was very interesting 00:06:25.85\00:06:28.75 was strict scrutiny, 00:06:28.78\00:06:32.12 which is the highest level of constitutional review. 00:06:32.15\00:06:36.86 Strict scrutiny means that it has to be narrowly tailored, 00:06:36.89\00:06:40.53 that means that it's the most narrow thing 00:06:40.56\00:06:43.03 that you can do to restrict somebody's rights. 00:06:43.06\00:06:45.30 And it also has to be the least restrictive means. 00:06:45.33\00:06:48.24 Yeah. 00:06:48.27\00:06:49.60 So the circuit court's opinion pointed out clearly 00:06:49.64\00:06:53.24 that this... 00:06:53.27\00:06:54.61 What the prison was trying to do 00:06:54.64\00:06:57.28 didn't meet either of those criteria. 00:06:57.31\00:06:59.98 So it was clear that they didn't meet 00:07:00.02\00:07:02.95 the constitutional standard. 00:07:02.98\00:07:04.32 In fact, they didn't even really try... 00:07:04.35\00:07:06.15 They didn't meet the fairness state. 00:07:06.19\00:07:08.09 They didn't give any real option 00:07:08.12\00:07:12.29 to the prisoner, 00:07:12.33\00:07:14.90 other than just having the Christian chaplain 00:07:14.93\00:07:17.50 or not having anyone at all. 00:07:17.53\00:07:19.03 Yeah. 00:07:19.07\00:07:20.40 And they didn't give reasons and that's... 00:07:20.44\00:07:22.60 Constitutional review requires 00:07:22.64\00:07:24.97 that you justify the decision that you're making. 00:07:25.01\00:07:28.84 Yeah. I've got to admit... 00:07:28.88\00:07:30.21 Personally, that bothered me more than 00:07:30.25\00:07:32.88 almost any other article I've read 00:07:32.91\00:07:35.05 because I understand, 00:07:35.08\00:07:36.42 you're explaining the legal line, 00:07:36.45\00:07:38.09 but, you know, executed man, 00:07:38.12\00:07:40.46 you know, maybe it's more holy than anything. 00:07:40.49\00:07:44.46 But an idea, a last cigarette or whatever, 00:07:44.49\00:07:48.56 that's the most severe thing 00:07:48.60\00:07:49.93 that a government can do to someone, 00:07:49.96\00:07:51.60 take away their life. 00:07:51.63\00:07:53.00 And here, you're not going to show them 00:07:53.03\00:07:54.77 this modicum of humanity at that last moment, 00:07:54.80\00:07:58.71 deprive them there. 00:07:58.74\00:08:01.84 Religion is close to the person's very soul, 00:08:01.88\00:08:05.11 right? 00:08:05.15\00:08:06.48 You've deprived them of that dignity. 00:08:06.51\00:08:07.85 Yes. 00:08:07.88\00:08:09.22 I just think it's a gross injustice 00:08:09.25\00:08:11.59 and the most prejudice slack against another human being. 00:08:11.62\00:08:15.56 Well, yes. 00:08:15.59\00:08:16.93 And as the circuit court pointed out, 00:08:16.96\00:08:18.66 the prison didn't even really make a good attempt 00:08:18.69\00:08:21.56 to justify 00:08:21.60\00:08:22.93 why they couldn't have the imam in the chamber. 00:08:22.96\00:08:25.17 They said, the circuit court said, 00:08:25.20\00:08:27.27 they could potentially justify it, 00:08:27.30\00:08:29.34 but they would have to make a showing 00:08:29.37\00:08:31.21 of why that it's somehow affected security. 00:08:31.24\00:08:36.11 There was some discussion about 00:08:36.14\00:08:37.95 how the chaplain was trained in execution procedures. 00:08:37.98\00:08:42.22 But there was no discussion of why the imam 00:08:42.25\00:08:44.45 couldn't have received the same training. 00:08:44.49\00:08:46.72 But I can think of a thousand variants. 00:08:46.76\00:08:48.86 Most executions, aren't they still witnesses? 00:08:48.89\00:08:52.49 Yes, they're witnesses in the viewing room. 00:08:52.53\00:08:54.96 Right. 00:08:55.00\00:08:56.40 I didn't know this whole story, 00:08:56.43\00:08:57.77 but even as the most minimal thing, 00:08:57.80\00:08:59.90 they could have had some of his fellow faith 00:08:59.93\00:09:03.71 and other imams and all are sitting there 00:09:03.74\00:09:05.64 to be a support. 00:09:05.67\00:09:07.01 Well, to be clear, 00:09:07.04\00:09:09.31 the imam was allowed in the viewing room. 00:09:09.34\00:09:11.55 He just wasn't allowed in the chamber. 00:09:11.58\00:09:13.98 So that's... 00:09:14.02\00:09:15.35 Well, that's at least something. 00:09:15.38\00:09:16.72 Yeah. 00:09:16.75\00:09:18.09 But this doesn't fully... It doesn't... 00:09:18.12\00:09:19.45 No, because the Christians... 00:09:19.49\00:09:20.82 Even partially satisfy the legal requirement. 00:09:20.86\00:09:22.29 Because the Christians had the opportunity 00:09:22.32\00:09:25.26 to have their Christian chaplain 00:09:25.29\00:09:27.66 in the viewing room, I'm sorry, in the chamber. 00:09:27.70\00:09:29.33 Now was the imam allowed in his cell closely before? 00:09:29.36\00:09:33.03 I believe so. 00:09:33.07\00:09:34.40 Yeah. 00:09:34.44\00:09:35.77 But not to have someone there by your side 00:09:35.80\00:09:39.64 at the moment of execution, to me, 00:09:39.67\00:09:41.78 that's where the cruelty comes in. 00:09:41.81\00:09:43.55 Yeah, that's a lonely moment. 00:09:43.58\00:09:45.11 So that and even more than that, 00:09:45.15\00:09:49.85 the implication was, 00:09:49.88\00:09:51.22 at the time, and I believe this 00:09:51.25\00:09:53.29 and many other commentators had similar views 00:09:53.32\00:09:57.39 that the court was essentially thumbing its nose 00:09:57.43\00:10:00.70 at the principle of non-neutrality 00:10:00.73\00:10:03.26 that government is not supposed to discriminate 00:10:03.30\00:10:06.77 between religious faiths. 00:10:06.80\00:10:08.77 So that appeared... 00:10:08.80\00:10:11.31 It appeared that the court was essentially 00:10:11.34\00:10:14.51 just doing away with that, or at least by implication, 00:10:14.54\00:10:18.85 they were ignoring that whole line 00:10:18.88\00:10:22.15 of legal argument. 00:10:22.18\00:10:24.12 Have you read any of their comments? 00:10:24.15\00:10:28.09 I don't... 00:10:28.12\00:10:29.62 They didn't really make comments. 00:10:29.66\00:10:31.36 The decision was so minimal. 00:10:31.39\00:10:33.19 And well, 00:10:33.23\00:10:34.86 Gorsuch made some really nasty comments 00:10:34.90\00:10:38.63 in his decision in a subsequent case 00:10:38.67\00:10:41.87 about how defendants shouldn't use these bogus means 00:10:41.90\00:10:47.04 to try to delay their executions, 00:10:47.08\00:10:49.08 and it was real nastiness. 00:10:49.11\00:10:54.98 This was a case that somebody was basically tortured to death 00:10:55.02\00:10:58.89 because of their condition, 00:10:58.92\00:11:00.76 reacted to the lethal injection. 00:11:00.79\00:11:03.43 And he said that that was okay 00:11:03.46\00:11:05.46 because that was okay under the original but... 00:11:05.49\00:11:07.93 Well, it's worth mentioning 00:11:07.96\00:11:09.33 that the US is somewhat out of sync 00:11:09.36\00:11:11.50 with at least the rest of the civilized world 00:11:11.53\00:11:14.20 in executions of these notes or any execution. 00:11:14.24\00:11:17.14 Right. 00:11:17.17\00:11:19.51 I know, for many Protestants, 00:11:19.54\00:11:22.24 we get our back up a bit 00:11:22.28\00:11:23.65 because the pope is sort of taken so publicly 00:11:23.68\00:11:26.75 an anti-execution stance, 00:11:26.78\00:11:28.95 but the reality is the Western world 00:11:28.98\00:11:30.89 doesn't see this as a fully appropriate way 00:11:30.92\00:11:33.76 to deal with the... 00:11:33.79\00:11:35.19 Well, there are a lot of problems 00:11:35.22\00:11:36.66 with the concept of execution in general... 00:11:36.69\00:11:40.23 Not least with DNA testing. 00:11:40.26\00:11:42.40 Yes, yes. 00:11:42.43\00:11:44.63 People who have been freed after decades 00:11:44.67\00:11:47.07 of imprisonment... 00:11:47.10\00:11:48.54 On death row, yeah. 00:11:48.57\00:11:50.34 When it was determined that they were innocent. 00:11:50.37\00:11:52.07 Yeah. 00:11:52.11\00:11:53.48 Yes, that is. 00:11:53.51\00:11:55.18 And also, their racial components 00:11:55.21\00:11:57.18 to why people or how people are convicted. 00:11:57.21\00:12:00.82 So it's... 00:12:00.85\00:12:03.49 The death penalty is a problematic issue. 00:12:03.52\00:12:06.05 I mean, it's very obvious if anyone thinks it's true, 00:12:06.09\00:12:09.32 you and I were talking privately 00:12:09.36\00:12:10.79 about the American War of Independence 00:12:10.83\00:12:15.10 and the role of the convicts from England 00:12:15.13\00:12:18.23 and then Australia being settled. 00:12:18.27\00:12:20.17 And I made the comment, which I know is the fact 00:12:20.20\00:12:22.90 that there was a class war in England at the time. 00:12:22.94\00:12:26.11 But that was that time, 00:12:26.14\00:12:27.68 but there's a class war in this country 00:12:27.71\00:12:29.78 and in most western countries, 00:12:29.81\00:12:31.48 and the prisoner makeup reflects that. 00:12:31.51\00:12:35.98 A very wealthy person for any number of reasons 00:12:36.02\00:12:39.02 is not very likely to end up on death row. 00:12:39.05\00:12:42.52 Right. 00:12:42.56\00:12:43.89 So it's the less fortunate 00:12:43.93\00:12:48.40 that suffer this and, 00:12:48.43\00:12:50.53 you know, I'm not willing to say 00:12:50.57\00:12:52.17 and, you know, we're not putting a political position, 00:12:52.20\00:12:55.34 but I think the death penalty 00:12:55.37\00:12:57.11 should be looked at long and hard 00:12:57.14\00:12:59.24 in modern civilizations or modern countries. 00:12:59.27\00:13:01.64 Well, certainly the way 00:13:01.68\00:13:03.01 it's administered should be looked at. 00:13:03.04\00:13:04.38 Yes. 00:13:04.41\00:13:05.75 And, you know, this hard and rigid approach 00:13:05.78\00:13:07.88 that's unfeeling is not a good signal 00:13:07.92\00:13:10.95 to throw it to around citizens. 00:13:10.99\00:13:13.39 Right, to throw back 00:13:13.42\00:13:14.76 to the 18th century methods of capital punishment 00:13:14.79\00:13:18.49 is a very scary concept. 00:13:18.53\00:13:20.50 Right. 00:13:20.53\00:13:22.43 Anyhow, your article continues, 00:13:22.46\00:13:27.17 that's what you were talking. 00:13:27.20\00:13:28.60 What's the flip side of this story? 00:13:28.64\00:13:33.31 Well, very interestingly, 00:13:33.34\00:13:35.68 just a few weeks later, 00:13:35.71\00:13:37.98 I think less than maybe six weeks later, 00:13:38.01\00:13:41.28 there was another case on almost identical facts. 00:13:41.32\00:13:46.02 This happened in Texas, the prisoner... 00:13:46.05\00:13:49.52 By the way, Texas pops up disturbingly 00:13:49.56\00:13:51.69 often on executions basically. 00:13:51.73\00:13:54.43 Yes, that's why this case is interesting, particularly, 00:13:54.46\00:13:58.47 well, one among many reasons. 00:13:58.50\00:14:01.54 But this case was almost identical facts, 00:14:01.57\00:14:04.94 except that this prisoner was a Buddhist. 00:14:04.97\00:14:08.34 There were Christian and Islamic chaplains 00:14:08.38\00:14:13.31 at the prison, 00:14:13.35\00:14:14.68 but he wanted his Buddhist spiritual advisor 00:14:14.72\00:14:17.65 to be with him. 00:14:17.69\00:14:19.02 And this was denied based on the former case, Dunn v Ray. 00:14:19.05\00:14:23.16 I don't think I named it before. 00:14:23.19\00:14:25.89 So the court in that case said based on Dunn v Ray, 00:14:25.93\00:14:29.96 he doesn't have a right, blah, blah, blah. 00:14:30.00\00:14:31.77 Incredible, incredible. 00:14:31.80\00:14:33.27 Before we continue on that, let's take a short break. 00:14:33.30\00:14:35.67 We'll be back. 00:14:35.70\00:14:37.04 Stay with us in very interesting court case. 00:14:37.07\00:14:40.28
