They said that. 00:01:52.27\00:01:54.64 They were totally ridiculous. 00:01:54.68\00:01:56.51 Now we didn't want to end up filing that. 00:01:56.54\00:01:58.01 I told him, "You could make your whole summers, you know, 00:01:58.05\00:02:00.48 just sit with me for 15-20 minutes, 00:02:00.52\00:02:03.12 we'll file..." 00:02:03.15\00:02:04.49 But I wasn't going to do it for him, 00:02:04.52\00:02:05.85 you know, how parents are. 00:02:05.89\00:02:07.49 Kids have to show some initiative, you know. 00:02:07.52\00:02:10.79 Yeah. 00:02:10.83\00:02:12.83 I'll throw it in for discussions like 00:02:12.86\00:02:14.73 because you and I 00:02:14.76\00:02:16.20 have other thoughts on this topic. 00:02:16.23\00:02:18.43 But I wonder sometimes if it hasn't worsened 00:02:18.47\00:02:21.47 in the workplace because of the weakening, 00:02:21.50\00:02:24.97 most particularly under Reagan of the trade union situation. 00:02:25.01\00:02:28.84 Well, you know... 00:02:28.88\00:02:30.21 Workers rights are not defended generally as they once were. 00:02:30.25\00:02:34.15 You know, this is kind of a mixed bag for us, Lincoln. 00:02:34.18\00:02:37.99 It's true that union rights are weaker than they were. 00:02:38.02\00:02:43.89 Collective bargaining agreements often make it 00:02:43.93\00:02:46.83 much more difficult to accommodate 00:02:46.86\00:02:49.93 a Sabbath observance as schedule. 00:02:49.96\00:02:52.47 If you don't have the seniority, 00:02:52.50\00:02:54.07 it can be very difficult to work around that. 00:02:54.10\00:02:56.37 We have a case right now against AT&T. 00:02:56.40\00:02:59.97 Our client was hired in a wireless store 00:03:00.01\00:03:04.71 and because of seniority rules, 00:03:04.75\00:03:07.22 it was very difficult to accommodate him there 00:03:07.25\00:03:09.82 and he wound up being fired for attendance issues. 00:03:09.85\00:03:14.09 What AT&T did not do was say, "Oh, well, 00:03:14.12\00:03:17.13 it's kind of hard to accommodate you here, 00:03:17.16\00:03:19.19 but we have all these call centers 00:03:19.23\00:03:20.90 with 10 zillion people in them and, you know, 00:03:20.93\00:03:23.63 you can try your hand there and get swapped, 00:03:23.67\00:03:26.53 you know, 'cause there's more people to swap with 00:03:26.57\00:03:28.77 if you have an unfavorable schedule 00:03:28.80\00:03:30.67 and it's going to be a lot quicker 00:03:30.71\00:03:32.44 before you earn enough seniority 00:03:32.47\00:03:34.44 to get a favorable schedule." 00:03:34.48\00:03:36.11 And he'd been at a call center before 00:03:36.14\00:03:38.81 and had been accommodated. 00:03:38.85\00:03:40.65 But, you know, the rule is well, you know, 00:03:40.68\00:03:43.08 "We have a rule, you can't change jobs, 00:03:43.12\00:03:45.75 can't transfer 00:03:45.79\00:03:47.12 until you've been here for six months." 00:03:47.16\00:03:48.72 And they managed to fire him 00:03:48.76\00:03:50.09 before he'd been there for six months. 00:03:50.13\00:03:51.46 So, you know... 00:03:51.49\00:03:52.83 Well, then tell me, another question. 00:03:52.86\00:03:56.97 And our Seventh-day Adventist heritage is brought with it 00:03:57.00\00:04:00.57 a deep suspicion of the role of trade unions. 00:04:00.60\00:04:04.01 And so, you know, that's what I was referring to. 00:04:04.04\00:04:07.01 There's good reasons for someone 00:04:07.04\00:04:09.54 with an individual conscience position 00:04:09.58\00:04:11.38 to not deliver that 00:04:11.41\00:04:13.21 to the disposition of a trade union 00:04:13.25\00:04:15.68 that in its own way may restrict your rights. 00:04:15.72\00:04:18.85 You know, I have to say, Lincoln, 00:04:18.89\00:04:20.66 I think that Adventist church 00:04:20.69\00:04:24.03 has been one-sided here. 00:04:24.06\00:04:26.83 When I read Ellen White, I read her to have, 00:04:26.86\00:04:32.13 you know, concerns about trade union certainly, 00:04:32.17\00:04:35.07 but also concerns about the abuse of corporate power 00:04:35.10\00:04:38.91 and consolidation of corporations. 00:04:38.94\00:04:40.91 And we need to keep that in mind 00:04:40.94\00:04:42.81 because we tend to be 00:04:42.84\00:04:44.65 one-sided in our application of that advice. 00:04:44.68\00:04:46.92 Exactly. 00:04:46.95\00:04:48.28 And clearly there is 00:04:48.32\00:04:49.92 considerable oppression of labor 00:04:49.95\00:04:52.29 from the corporate side. 00:04:52.32\00:04:53.96 And the Bible that I read 00:04:53.99\00:04:55.76 give us one of the clear markers 00:04:55.79\00:04:58.13 of the end times that the workers' 00:04:58.16\00:05:00.26 wages are held back by fraud. 00:05:00.30\00:05:02.23 Right. 00:05:02.26\00:05:03.60 In James 5. Right. 00:05:03.63\00:05:05.13 But another thing that I sometimes wonder 00:05:05.17\00:05:08.20 hasn't skewed it against 00:05:08.24\00:05:10.01 religious accommodation of these sates 00:05:10.04\00:05:11.94 and I don't know if how many with right to work laws. 00:05:11.97\00:05:15.38 So the workers' rights community 00:05:15.41\00:05:16.88 has long been opposed to these right to work laws, 00:05:16.91\00:05:20.42 there's been a real push for just cause. 00:05:20.45\00:05:24.85 You know, the problem is 00:05:24.89\00:05:27.72 we treat labor as a commodity, 00:05:27.76\00:05:30.93 you know, we don't treat people as... 00:05:30.96\00:05:34.56 You know, we don't value people. 00:05:34.60\00:05:36.56 You have large corporations, for example, 00:05:36.60\00:05:38.73 that depend upon the quality of their workforce 00:05:38.77\00:05:42.70 for their entire economic model, 00:05:42.74\00:05:44.97 like the large delivery firms, 00:05:45.01\00:05:47.24 and yet they treat their workers 00:05:47.28\00:05:49.34 like their widgets and they will throw them out, 00:05:49.38\00:05:52.75 they're just numbers and what have you. 00:05:52.78\00:05:54.98 It's really... 00:05:55.02\00:05:56.35 The way we treat people, there's... 00:05:56.38\00:05:57.95 No wonder the Bible 00:05:57.99\00:05:59.72 rails against the oppression of labor 00:05:59.75\00:06:02.16 in the last days. 00:06:02.19\00:06:03.53 It is a sign of the last days. 00:06:03.56\00:06:05.59 Yeah. 00:06:05.63\00:06:07.36 And there's not too many discussions that I've heard 00:06:07.40\00:06:10.40 on the merits of capitalism versus communism, 00:06:10.43\00:06:14.04 which is discredited and largely gone. 00:06:14.07\00:06:17.17 But we tend to think, it's gone, it's discredited, 00:06:17.21\00:06:20.51 capitalism is great. 00:06:20.54\00:06:21.88 There's elements of capitalism 00:06:21.91\00:06:23.24 that are distinctly unchristian, 00:06:23.28\00:06:24.98 especially the way it's carried forward, 00:06:25.01\00:06:26.82 and I think this is one part of it. 00:06:26.85\00:06:28.92 It shouldn't be in pursuit of money, 00:06:28.95\00:06:31.49 shouldn't be used to drag and to drag down 00:06:31.52\00:06:34.36 or oppress the rights of an individual. 00:06:34.39\00:06:36.83 Well... 00:06:36.86\00:06:38.19 The Bible says that, "Workman is worthy of his hire." 00:06:38.23\00:06:41.03 To me, there is a fatal flaw in the way capitalism 00:06:41.06\00:06:44.93 is currently established here in the United States. 00:06:44.97\00:06:48.40 And that is that the rights of capital are supreme 00:06:48.44\00:06:54.04 as against the rights of labor. 00:06:54.08\00:06:57.61 You know, the workers are the ones 00:06:57.65\00:07:00.02 who are actually producing the profits 00:07:00.05\00:07:03.49 that the people who have the capital 00:07:03.52\00:07:05.79 get to sit back and not work for it, 00:07:05.82\00:07:07.92 invest and enjoy 00:07:07.96\00:07:09.49 the fruits of somebody else's labor. 00:07:09.52\00:07:12.49 Now it sounds very communist or socialist to say that, 00:07:12.53\00:07:17.03 but that's just a dynamic structural fact, 00:07:17.07\00:07:20.24 it's nothing to do with ideology. 00:07:20.27\00:07:22.94 But I think morally the Bible does speak to this, 00:07:22.97\00:07:26.68 we need to be careful not to be, 00:07:26.71\00:07:28.78 in the case of employer, not to be abusive toward the... 00:07:28.81\00:07:33.01 The trust relationship should exist. 00:07:33.05\00:07:35.45 Well, look. 00:07:35.48\00:07:36.82 I think there are other models that a free society 00:07:36.85\00:07:40.89 and a free economy can have that better balance 00:07:40.92\00:07:44.39 the interest of capital and the workforce 00:07:44.43\00:07:48.40 that reward labor for their productivity. 00:07:48.43\00:07:53.00 You know, what we've had in the last generation 00:07:53.03\00:07:55.40 is the hollowing out of the middle class. 00:07:55.44\00:07:57.51 The rich get richer 00:07:57.54\00:07:59.01 and the working class gets poorer, 00:07:59.04\00:08:01.68 it used to be that, you know, one... 00:08:01.71\00:08:04.98 You know, the head of household, 00:08:05.01\00:08:06.72 the man could support the family. 00:08:06.75\00:08:09.72 It can't happen anymore. 00:08:09.75\00:08:11.09 They're accredited on two incomes typically. 00:08:11.12\00:08:12.75 And two incomes are still struggling 00:08:12.79\00:08:14.62 to support the family in many cases. 00:08:14.66\00:08:16.66 And, you know, I don't know that 00:08:16.69\00:08:18.03 that's any master plan, 00:08:18.06\00:08:19.39 but I think from a point of morality, 00:08:19.43\00:08:21.20 we need to resist the tendency that that's created to, 00:08:21.23\00:08:25.83 if not mistreat, then to disregard 00:08:25.87\00:08:27.90 the rights of the worker. 00:08:27.94\00:08:29.27 And back to our starting point, 00:08:29.30\00:08:31.51 litigation to support moral and religious stands by people 00:08:31.54\00:08:36.51 I think it's suffering because of this, isn't it? 00:08:36.54\00:08:38.68 Well, look. 00:08:38.71\00:08:40.05 I'd like to make one point here before we close this out 00:08:40.08\00:08:43.85 because there are a lot of Christian organizations 00:08:43.89\00:08:45.85 that are very belligerent. 00:08:45.89\00:08:47.56 "You know, you better do what we say is right 00:08:47.59\00:08:50.33 or we're going to beat you up in court." 00:08:50.36\00:08:51.89 Our approach, I have always called biblical peacemaking. 00:08:51.93\00:08:55.60 We have conflicts, 00:08:55.63\00:08:56.97 we encourage companies to do the right thing, 00:08:57.00\00:08:59.67 we express our confidence 00:08:59.70\00:09:02.30 that they will do the right thing, 00:09:02.34\00:09:03.97 if they get a letter from our lawyer, 00:09:04.01\00:09:05.34 they know what's going to happen if they don't. 00:09:05.37\00:09:07.31 We don't need to rub their noses in it. 00:09:07.34\00:09:09.24 But, you know, what we like to do 00:09:09.28\00:09:10.95 then is try to get their attention, 00:09:10.98\00:09:13.62 get their cooperation, 00:09:13.65\00:09:14.98 resolve conflict as early as possible. 00:09:15.02\00:09:19.02 But God has given us 00:09:19.05\00:09:20.92 a legal system to resolve conflict. 00:09:20.96\00:09:24.46 Absolutely. 00:09:24.49\00:09:25.83 And, you know, I'd kind of like to close with this illustration 00:09:25.86\00:09:29.16 of what turn the other cheek means 00:09:29.20\00:09:31.60 because I think many people think 00:09:31.63\00:09:33.64 it means being a doormat. 00:09:33.67\00:09:35.24 Well, far from it. 00:09:35.27\00:09:37.37 You know, our natural tendency 00:09:37.41\00:09:40.04 when we get to conflict is fight or flight. 00:09:40.08\00:09:42.94 Either we're going to punch somebody back 00:09:42.98\00:09:45.15 or we're going to run away. 00:09:45.18\00:09:47.12 Well, if we turn the other cheek, 00:09:47.15\00:09:49.08 we're not doing either one, we're not running away, 00:09:49.12\00:09:51.99 we're not hitting them back, 00:09:52.02\00:09:54.02 we're really confronting their wrongdoing 00:09:54.06\00:09:56.32 and giving an opportunity to rethink it. 00:09:56.36\00:09:59.69 And I think that's what we do 00:09:59.73\00:10:01.36 when we bring these religious freedom claims. 00:10:01.40\00:10:04.10 It's a matter of confronting what a company has done wrong. 00:10:04.13\00:10:09.90 The only way they're going to make it right... 00:10:09.94\00:10:11.81 They're not going to admit anything, 00:10:11.84\00:10:13.98 maybe they'll put up some money to settle a case, 00:10:14.01\00:10:17.11 but in rare occasions, 00:10:17.15\00:10:18.95 we actually get to accomplish more than that, 00:10:18.98\00:10:21.78 and they'll do training and we'll get somewhere 00:10:21.82\00:10:27.06 in terms of eradicating discrimination. 00:10:27.09\00:10:31.59 It's amazing how often the Bible uses 00:10:31.63\00:10:33.46 what amounts to legal imagery, 00:10:33.50\00:10:35.73 as the accuser of the brethren standing off to the side 00:10:35.76\00:10:39.23 when someone's brought before the great judge. 00:10:39.27\00:10:41.77 Of course, he's a judge but also 00:10:41.80\00:10:45.07 we have an advocate Jesus. 00:10:45.11\00:10:47.48 And I think that gives some justification, 00:10:47.51\00:10:51.51 some background to what happens every day 00:10:51.55\00:10:54.25 somewhere in the world 00:10:54.28\00:10:55.62 and particularly in the United States, 00:10:55.65\00:10:56.99 where people depend upon lawyers and advocates 00:10:57.02\00:11:01.19 against the secular legal system 00:11:01.22\00:11:03.53 to uphold their profession of faith. 00:11:03.56\00:11:05.86 It is important, it's something that we do gladly 00:11:05.89\00:11:09.60 and we take full advantage 00:11:09.63\00:11:10.97 of whatever legal help there can be. 00:11:11.00\00:11:13.23 And of course, when all of that is exhausted, 00:11:13.27\00:11:16.27 we serve the Lord and our legal authority 00:11:16.30\00:11:19.01 is before Him. 00:11:19.04\00:11:20.38 We should never lose sight of that. 00:11:20.41\00:11:21.91 But like Paul using his citizenship as a tool 00:11:21.94\00:11:26.11 if not a weapon to proclaim throughout the Roman Empire, 00:11:26.15\00:11:29.25 so too we can use the Lord to our advantage. 00:11:29.28\00:11:32.95 For Liberty Insider, this is Lincoln Steed. 00:11:32.99\00:11:35.96
