Welcome to the Liberty Insider. 00:00:29.82\00:00:31.66 This is your program, bringing you news, 00:00:31.69\00:00:34.46 views, updates, and discussion, and analyses 00:00:34.50\00:00:37.53 of religious liberty developments 00:00:37.57\00:00:39.50 in the US and around the world. 00:00:39.53\00:00:41.70 My name is Lincoln Steed, Editor of Liberty magazine. 00:00:41.74\00:00:45.27 And my guest on the program is attorney, Alan Reinach, 00:00:45.31\00:00:49.28 Executive Director 00:00:49.31\00:00:50.65 of the Church State Council in California, 00:00:50.68\00:00:53.05 based in California. 00:00:53.08\00:00:55.18 And the fact that you're an attorney 00:00:55.22\00:00:56.62 leads directly into what I want to talk about. 00:00:56.65\00:00:58.82 Sure. 00:00:58.85\00:01:00.19 You know, the law is a big part 00:01:00.22\00:01:01.56 of our lives in the modern world. 00:01:01.59\00:01:04.99 And I'm reminded in the gospel dispensation, 00:01:05.03\00:01:08.36 you know, the Apostle Paul 00:01:08.40\00:01:11.03 changed the world on behalf of Christianity, 00:01:11.07\00:01:13.03 but he appealed to the law time after time 00:01:13.07\00:01:15.37 his citizenship status, right? 00:01:15.40\00:01:17.87 So it seems to me, 00:01:17.91\00:01:19.24 it's a legitimate aspect of living a life of faith 00:01:19.27\00:01:22.41 in the modern world that... 00:01:22.44\00:01:24.15 We use the law when we can to defend what it offers, 00:01:24.18\00:01:27.88 particularly in the United States, 00:01:27.92\00:01:29.48 protection for religious practice. 00:01:29.52\00:01:31.85 Now is this a big part or a big problem 00:01:31.89\00:01:35.09 in the United States 00:01:35.12\00:01:36.46 defending people's religious sensibilities, 00:01:36.49\00:01:39.19 probably mostly in the workplace? 00:01:39.23\00:01:40.66 You know, I don't know what most Americans think of 00:01:40.70\00:01:43.97 when they think of religious liberty problems. 00:01:44.00\00:01:45.93 Maybe they think of, 00:01:45.97\00:01:47.30 you know, the baker and the photographer, 00:01:47.34\00:01:49.90 and that sort of thing 00:01:49.94\00:01:51.27 or maybe they think of Ten Commandments monument, 00:01:51.31\00:01:54.78 and, you know, crosses on hills, 00:01:54.81\00:01:56.61 and the battles, those sorts of things. 00:01:56.64\00:01:59.61 But you know, the cases that don't get the publicity. 00:01:59.65\00:02:03.49 The number one religious freedom problem 00:02:03.52\00:02:06.65 in America today 00:02:06.69\00:02:08.02 and for many years has been every business day, 00:02:08.06\00:02:11.93 Americans are losing their jobs 00:02:11.96\00:02:14.53 for no other crime than their faith. 00:02:14.56\00:02:17.73 Now it's not just Seventh-day Adventists. 00:02:17.77\00:02:19.47 You and I are Seventh-day Adventists. 00:02:19.50\00:02:21.34 And you, I know, defend many Adventists, 00:02:21.37\00:02:24.77 but this wouldn't be just a problem of accommodation 00:02:24.81\00:02:28.11 for Adventists. 00:02:28.14\00:02:29.51 No, it's not at all. 00:02:29.54\00:02:31.45 I can think of a few others, Jews, 00:02:31.48\00:02:33.18 Muslims have faith for example. 00:02:33.21\00:02:34.75 But every... 00:02:34.78\00:02:36.42 People of any faith can suffer discrimination. 00:02:36.45\00:02:40.79 You know, it's true. 00:02:40.82\00:02:42.16 I started out primarily representing 00:02:42.19\00:02:45.46 Seventh-day Adventists 00:02:45.49\00:02:46.83 with Sabbath accommodation problems 00:02:46.86\00:02:48.63 because of our belief and practice of taking the time 00:02:48.66\00:02:53.50 from sundown Friday to sundown Saturday 00:02:53.54\00:02:56.37 is a day of rest and worship 00:02:56.40\00:02:58.07 and not working on those hours and being pretty strict about, 00:02:58.11\00:03:01.74 you know, not working, it causes a lot of conflict, 00:03:01.78\00:03:05.48 especially for blue collar-hourly-wage workers. 00:03:05.51\00:03:09.68 People can't change their job at will. 00:03:09.72\00:03:13.05 They don't have the flexibility. 00:03:13.09\00:03:14.42 But we've developed the Church State Council 00:03:14.46\00:03:16.52 into the foremost legal services organization 00:03:16.56\00:03:19.63 providing representation for people of all faiths. 00:03:19.66\00:03:23.40 So for example, let me tell you a story about a case 00:03:23.43\00:03:27.14 that was not a Seventh-day Adventist. 00:03:27.17\00:03:28.67 And I can tell it 00:03:28.70\00:03:30.04 because it was a case against a government entity, 00:03:30.07\00:03:33.91 and when you settle cases against the government, 00:03:33.94\00:03:36.24 because it's a government, 00:03:36.28\00:03:37.61 they can't have these nondisclosure agreements. 00:03:37.65\00:03:40.22 There's no confidentiality. I didn't know that. 00:03:40.25\00:03:43.25 I'm not going to use names, 00:03:43.28\00:03:44.85 you know, but at least I can talk. 00:03:44.89\00:03:47.19 So it's in the public record. 00:03:47.22\00:03:48.56 Yeah, it's a public record, sure. 00:03:48.59\00:03:49.92 So our client was a very lovely gentleman, 00:03:49.96\00:03:53.90 African-American, Baptist. 00:03:53.93\00:03:56.36 And his dad had started a church 00:03:56.40\00:03:58.50 in Oakland, California. 00:03:58.53\00:04:01.40 He had many years of federal service 00:04:01.44\00:04:04.84 in the military and otherwise, 00:04:04.87\00:04:07.24 and he decided when the real estate business 00:04:07.28\00:04:10.68 he was in collapsed back in, 00:04:10.71\00:04:13.01 you know, 2009, 2010, he took a position, 00:04:13.05\00:04:16.15 very humble position, 00:04:16.18\00:04:17.85 as a custodian for a national park 00:04:17.89\00:04:22.76 on the ocean there in San Francisco, 00:04:22.79\00:04:26.26 right by Pier 39 for those 00:04:26.29\00:04:28.63 who are familiar with the city at all. 00:04:28.66\00:04:31.43 I've been to Pier 39 myself 00:04:31.47\00:04:33.00 and I'm not familiar with the city. 00:04:33.03\00:04:34.40 He encountered not only pervasive harassment 00:04:34.44\00:04:38.67 and discrimination on the basis of race, 00:04:38.71\00:04:40.98 but then the thing that got him fired, 00:04:41.01\00:04:45.15 he had befriended one of the homeless people 00:04:45.18\00:04:47.82 that came to visit the park 00:04:47.85\00:04:50.12 and eventually the gentleman was no longer homeless. 00:04:50.15\00:04:55.02 You know, he had a place to live, 00:04:55.06\00:04:56.49 but he still came to visit the park. 00:04:56.52\00:04:58.86 And he asked my client to be baptized, 00:04:58.89\00:05:02.86 and so he got very excited, 00:05:02.90\00:05:06.60 he said, "You know, wait till the end of my shift." 00:05:06.63\00:05:10.61 And at the end of his shift... 00:05:10.64\00:05:12.41 He took his lunch break at the end 00:05:12.44\00:05:14.38 instead of during the middle, changed out of his uniform, 00:05:14.41\00:05:17.65 took him down to the ocean, baptized him. 00:05:17.68\00:05:20.98 He got fired over that. Incredible. 00:05:21.02\00:05:22.95 We had a federal agency then defending this case. 00:05:22.98\00:05:29.56 You know, they eventually settled it, 00:05:29.59\00:05:31.06 but defending it saying, 00:05:31.09\00:05:33.09 "We did nothing wrong by firing him." 00:05:33.13\00:05:35.50 They didn't deny 00:05:35.53\00:05:36.87 that he was fired over the baptism 00:05:36.90\00:05:38.23 'cause there was a whole paper trail about it. 00:05:38.27\00:05:39.97 What was the reason given for his firing though? 00:05:40.00\00:05:46.34 How did he offend the supervisor? 00:05:46.37\00:05:50.21 Look, it was probably just pure bigotry, 00:05:50.25\00:05:54.08 race and religious bigotry. 00:05:54.12\00:05:55.95 That's probably what was really going on. 00:05:55.98\00:05:58.45 They tried to defend it as somehow he would be... 00:05:58.49\00:06:04.79 People who would see him were at risk 00:06:04.83\00:06:08.00 of some kind of endorsement of religion. 00:06:08.03\00:06:10.40 Well, first of all, he's had a uniform, 00:06:10.43\00:06:12.43 so how many people are going to recognize 00:06:12.47\00:06:14.30 that he is the custodian there anyway? 00:06:14.34\00:06:16.91 And they admitted deposition testimony that, 00:06:16.94\00:06:21.78 "Well, it was perfectly legal 00:06:21.81\00:06:23.21 for him to do it on his day off." 00:06:23.24\00:06:24.61 So how did they know if he was working 00:06:24.65\00:06:26.25 or if he's on his day off? 00:06:26.28\00:06:27.88 You know, you go down to the beach there 00:06:27.92\00:06:29.72 and there's lots of people doing 00:06:29.75\00:06:31.29 all kinds of things on the beach, 00:06:31.32\00:06:33.79 and this is San Francisco after all, you know? 00:06:33.82\00:06:36.86 And nobody's paying any attention. 00:06:36.89\00:06:39.63 My son's girlfriend, we had a baptism 00:06:39.66\00:06:42.66 at the beach down in Malibu a couple years ago. 00:06:42.70\00:06:46.43 And we had a loud speaker, you know, so we could hear, 00:06:46.47\00:06:51.47 you know, the service and what have you. 00:06:51.51\00:06:53.88 And I'm looking around 00:06:53.91\00:06:55.31 while the preacher is introducing things, 00:06:55.34\00:06:58.28 and he's preaching, he's reading from the Bible. 00:06:58.31\00:07:00.58 I'm looking around. 00:07:00.62\00:07:01.95 There isn't a soul on the beach 00:07:01.98\00:07:04.65 that's paying a lick of attention, you know? 00:07:04.69\00:07:06.92 Interesting. 00:07:06.96\00:07:08.29 So it was absurd that there was any kind of fear 00:07:08.32\00:07:12.83 that this lowly... 00:07:12.86\00:07:14.50 that anyone is going to look at this lowly custodian. 00:07:14.53\00:07:17.57 And imagine, because he's baptizing 00:07:17.60\00:07:19.83 somebody in the ocean... 00:07:19.87\00:07:21.20 First of all, what's a baptism? 00:07:21.24\00:07:23.64 They're going down in the water and coming back up. 00:07:23.67\00:07:26.44 And does anybody even... 00:07:26.47\00:07:27.81 They're not singing, they're not praying, 00:07:27.84\00:07:29.71 they're not doing anything to publicize it. 00:07:29.74\00:07:31.75 Just a private prayer. Right. 00:07:31.78\00:07:35.42 You know, the idea that this would be 00:07:35.45\00:07:38.75 an endorsement of religion 00:07:38.79\00:07:40.22 by the United States government, 00:07:40.26\00:07:42.12 this lowly African-American custodian 00:07:42.16\00:07:44.16 is just ludicrous. 00:07:44.19\00:07:45.53 You know, but I tell that story just as an illustration 00:07:45.56\00:07:49.53 that religious discrimination can happen to anybody 00:07:49.56\00:07:53.34 and to everybody. 00:07:53.37\00:07:54.70 It doesn't matter whether you're a majority faith, 00:07:54.74\00:07:56.81 minority faith. 00:07:56.84\00:07:58.17 You know, we talk about, for example, 00:07:58.21\00:08:00.14 laws against discrimination 00:08:00.18\00:08:01.91 on the base of sexual orientation. 00:08:01.94\00:08:03.55 Guess what, gays are not the only people 00:08:03.58\00:08:06.72 who have a sexual orientation, 00:08:06.75\00:08:08.98 you and I have a sexual orientation, 00:08:09.02\00:08:11.12 it's not the same, you know? 00:08:11.15\00:08:12.49 Yeah, it's true. 00:08:12.52\00:08:13.86 As a gay person, you know... 00:08:13.89\00:08:16.52 So anybody can be discriminated against. 00:08:16.56\00:08:19.16 And we found as we have gotten the experience and grown 00:08:19.19\00:08:22.86 that we're getting calls for help 00:08:22.90\00:08:24.83 from across the board 00:08:24.87\00:08:26.74 from Muslims being harassed, from Jews, 00:08:26.77\00:08:29.94 from, you know, Christians of other faiths, 00:08:29.97\00:08:32.34 we've got some... 00:08:32.37\00:08:33.71 those not working on Sunday, and of course, 00:08:33.74\00:08:36.78 still predominantly, a lot of Seventh-day Adventists 00:08:36.81\00:08:39.18 with Sabbath problems. 00:08:39.21\00:08:40.55 And it seems to me... 00:08:40.58\00:08:41.92 I don't know whether the numbers 00:08:41.95\00:08:43.28 of this sort of thing have gone up. 00:08:43.32\00:08:45.12 But the types of cases are bureaucratic. 00:08:45.15\00:08:50.83 And I just wonder 00:08:50.86\00:08:52.73 is the litigious nature of the US 00:08:52.76\00:08:56.56 has made employers fearful 00:08:56.60\00:09:00.07 of any sort of activity like this 00:09:00.10\00:09:02.30 and then they just sort of jumping on it 00:09:02.34\00:09:04.44 because it's obvious 00:09:04.47\00:09:05.81 that 50-60 years ago or further, 00:09:05.84\00:09:08.38 so let's say 100 years ago, 00:09:08.41\00:09:10.45 religious activity of employees informally 00:09:10.48\00:09:14.32 in the workplace 00:09:14.35\00:09:15.68 wouldn't have got anyone's attention very much. 00:09:15.72\00:09:18.25 But since, you know... 00:09:18.29\00:09:20.02 at the drop of a hat, people... 00:09:20.06\00:09:21.66 maybe even the Government in this case 00:09:21.69\00:09:24.33 and others just don't want any trouble, 00:09:24.36\00:09:25.89 so they're sort of pushing it away reflexly 00:09:25.93\00:09:29.36 where they might not have done that before. 00:09:29.40\00:09:30.73 Do you think there's an element of that? 00:09:30.77\00:09:32.63 I think there's certain hostility 00:09:32.67\00:09:35.17 to religion that we see... 00:09:35.20\00:09:37.87 I don't know that I would... 00:09:37.91\00:09:39.24 That has developed too. Government. 00:09:39.27\00:09:41.74 No, not by government. 00:09:41.78\00:09:43.11 The government happens to be with employee. 00:09:43.14\00:09:44.48 Most of our cases 00:09:44.51\00:09:45.85 are private employers, are not... 00:09:45.88\00:09:47.82 You know, we do have some government cases. 00:09:47.85\00:09:51.72 But again, it's people who are harassing, 00:09:51.75\00:09:55.32 it's people who are discriminating, 00:09:55.36\00:09:57.63 you know, they're in positions of authority 00:09:57.66\00:10:00.06 within the government or within companies, 00:10:00.10\00:10:02.90 but it's people, you know? 00:10:02.93\00:10:07.04 We may yet have to file another case 00:10:07.07\00:10:09.70 against Federal Express. 00:10:09.74\00:10:11.57 Well, we've had some previously. 00:10:11.61\00:10:14.78 Federal Express has policies 00:10:14.81\00:10:17.38 like all these companies do against discrimination, 00:10:17.41\00:10:20.45 but it's people who are failing to follow the policies. 00:10:20.48\00:10:26.25 Yeah. And it's true. 00:10:26.29\00:10:27.62 Tolerance in our society for everything, 00:10:27.66\00:10:29.59 including religion is at a low point. 00:10:29.62\00:10:32.83 The battle lines are drawn very quickly. 00:10:32.86\00:10:36.16 And if people get up in arms, 00:10:36.20\00:10:37.57 and they don't like what's going on 00:10:37.60\00:10:38.93 or they're frosty 00:10:38.97\00:10:40.64 about some criticism of their actions... 00:10:40.67\00:10:43.37 I'm sure this is feeding through into more litigation 00:10:43.41\00:10:48.74 on Sabbath, in our case, accommodation. 00:10:48.78\00:10:51.75 Well, you know, part of this story, 00:10:51.78\00:10:53.78 when it comes to the Civil Rights Act 00:10:53.82\00:10:56.58 and the national protections 00:10:56.62\00:10:58.19 we have against religious discrimination 00:10:58.22\00:11:01.96 in our laws has to be 00:11:01.99\00:11:05.89 a faulty view 00:11:05.93\00:11:09.53 of the separation of church and state, 00:11:09.56\00:11:11.93 of the Establishment Clause. 00:11:11.97\00:11:13.57 The first case that went to the Supreme Court 00:11:13.60\00:11:16.54 back in the 1970s, that was decided... 00:11:16.57\00:11:21.31 it was applying the obligation to accommodate 00:11:21.34\00:11:26.01 the religious practices of employees 00:11:26.05\00:11:27.95 and involved a mechanic for a TWA, remember TWA? 00:11:27.98\00:11:32.72 Hardison. Hardison. Correct. 00:11:32.75\00:11:35.56 TWA against Hardison. 00:11:35.59\00:11:37.89 And one of the arguments made on behalf of TWA 00:11:37.93\00:11:42.43 was that having special rules to accommodate people of faith 00:11:42.46\00:11:48.54 was an establishment of religion. 00:11:48.57\00:11:50.51 This violated the First Amendment. 00:11:50.54\00:11:53.88 And the Supreme Court did not go back far, 00:11:53.91\00:11:56.98 but they watered down the obligation. 00:11:57.01\00:11:59.95 It was... 00:11:59.98\00:12:01.32 The statute reads that company's employers 00:12:01.35\00:12:05.52 have to provide reasonable accommodation 00:12:05.55\00:12:07.69 short of an undue hardship. 00:12:07.72\00:12:09.49 Well, the court watered down undue hardship 00:12:09.52\00:12:11.76 and deprived to practically nothing. 00:12:11.79\00:12:14.40 Dominimus. Dominimus. Exactly. 00:12:14.43\00:12:16.56 Dominimous which means pretty much bogus. 00:12:16.60\00:12:18.57 Nothing. Right. 00:12:18.60\00:12:20.14 Now we have been successful in California 00:12:20.17\00:12:23.20 and in a couple of other states 00:12:23.24\00:12:25.21 at adopting a different standard 00:12:25.24\00:12:27.91 that was first done with the Americans 00:12:27.94\00:12:30.35 With Disabilities Act, 00:12:30.38\00:12:32.18 which is a significant difficulty 00:12:32.21\00:12:34.68 or expense standard of undue hardship, 00:12:34.72\00:12:37.32 and we've been pushing for two decades 00:12:37.35\00:12:39.45 to get this standard 00:12:39.49\00:12:40.86 written into Title 7 at the federal level 00:12:40.89\00:12:44.03 and neither party has been 00:12:44.06\00:12:45.39 especially helpful in pushing this forward. 00:12:45.43\00:12:50.27 We might have discussed it in the past. 00:12:50.30\00:12:52.70 But I think what's getting in the way more and more 00:12:52.73\00:12:55.34 is this tilt by the Supreme Court 00:12:55.37\00:12:57.51 to recognizing the rights 00:12:57.54\00:12:59.11 and writing them large for corporations. 00:12:59.14\00:13:02.18 A corporate, I think, goes against individual rights. 00:13:02.21\00:13:05.01 And as well as that, I have heard, in particular, 00:13:05.05\00:13:08.92 the Roman Catholic Church stating, 00:13:08.95\00:13:12.19 from a legitimate point, 00:13:12.22\00:13:13.56 but I don't like to hear it in view of what's happening 00:13:13.59\00:13:16.22 with the civil idea of corporations, 00:13:16.26\00:13:18.36 they stated that there needs to be less fixation 00:13:18.39\00:13:22.30 on individual's conscience rights 00:13:22.33\00:13:24.70 and more on corporate rights for the church. 00:13:24.73\00:13:26.94 This corporate thinking bothers me. 00:13:26.97\00:13:29.24 Well, there's no question 00:13:29.27\00:13:30.61 that we have always had a bias in our laws that favors... 00:13:30.64\00:13:34.51 Oh, absolutely, this was founded on corporate, 00:13:34.54\00:13:37.18 was settled with corporations before independence. 00:13:37.21\00:13:41.38 And yeah, there is an imbalance in favor of the corporations, 00:13:41.42\00:13:46.55 like I say, 00:13:46.59\00:13:47.92 some of our state laws in California. 00:13:47.96\00:13:49.56 We've made enormous headway 00:13:49.59\00:13:52.33 in crafting a set of laws 00:13:52.36\00:13:56.10 that really does provide vigorous protection 00:13:56.13\00:13:58.90 for people of faith in the workplace. 00:13:58.93\00:14:02.30 I'll tell you the nut 00:14:02.34\00:14:04.11 that we need to crack right now, 00:14:04.14\00:14:05.84 and we're on the verge of cracking it in California, 00:14:05.87\00:14:09.21 has to do with what can employers ask 00:14:09.24\00:14:13.18 in the hiring process. 00:14:13.21\00:14:15.28 When you ask about availability, 00:14:15.32\00:14:17.45 and increasingly, 00:14:17.49\00:14:18.82 there are online job applications... 00:14:18.85\00:14:20.72 Trying to filter it before you even offer them... 00:14:20.76\00:14:22.09 If you're not... 00:14:22.12\00:14:23.46 If you don't say 00:14:23.49\00:14:24.83 you're available seven days a week, 00:14:24.86\00:14:26.19 you don't even... 00:14:26.23\00:14:27.56 you just get bounced out of the application process. 00:14:27.60\00:14:28.93 It's a very important aspect.
