Fair enough. Glad to be with you, Lincoln. 00:00:52.81\00:00:54.38 And as a lawyer, particularly, let's talk a little bit about 00:00:54.42\00:00:57.59 one of the recent decisions of the Supreme Court, 00:00:57.62\00:01:00.32 they dealt with the lay people, and I'm one of them, 00:01:00.36\00:01:03.56 we say Cake Case, right? 00:01:03.59\00:01:05.19 Masterpiece Cakeshop. 00:01:05.23\00:01:07.10 So Jack Phillips is a baker in Colorado, he's a Christian, 00:01:07.13\00:01:11.90 he was asked to bake a cake for a same-sex couple 00:01:11.93\00:01:16.57 and he refused. 00:01:16.60\00:01:18.41 And so he was brought up on charges 00:01:18.44\00:01:20.64 with the Colorado Civil Rights Commission 00:01:20.68\00:01:23.75 and found to have discriminated against them 00:01:23.78\00:01:26.45 on the basis of sexual orientation and, of course... 00:01:26.48\00:01:29.92 I think he went on appeal at the Supreme Court. 00:01:29.95\00:01:31.59 Went all the way to the Supreme Court. 00:01:31.62\00:01:33.05 Now both sides are claiming victory in this case 00:01:33.09\00:01:36.76 and in fact... 00:01:36.79\00:01:38.13 Now who are the sides? 00:01:38.16\00:01:39.49 Well, alright, so... 00:01:39.53\00:01:40.86 Maybe there's more than two. 00:01:40.90\00:01:42.56 This is a very... It's a very interesting... 00:01:42.60\00:01:44.37 Look, the number one conflict in America 00:01:44.40\00:01:48.34 in terms of religious freedom 00:01:48.37\00:01:50.74 is this conflict between LGBT rights 00:01:50.77\00:01:53.78 and religious freedom, 00:01:53.81\00:01:57.05 especially for Christians and for... 00:01:57.08\00:01:59.85 especially for Christian institutions that uphold 00:01:59.88\00:02:04.22 what I like to call 00:02:04.25\00:02:05.59 the biblical view of human sexuality 00:02:05.62\00:02:08.69 because properly understood, it's not discriminatory 00:02:08.72\00:02:13.56 against people with a same-sex orientation. 00:02:13.60\00:02:19.03 You know, it's a view of human sexuality 00:02:19.07\00:02:22.64 that consistently discourages 00:02:22.67\00:02:27.08 sex outside of heterosexual marriage, 00:02:27.11\00:02:30.78 for anyone, whether you're heterosexual or otherwise. 00:02:30.81\00:02:33.82 Yeah, don't you think it's unduly polarized 00:02:33.85\00:02:35.82 because in any biblically based Christian 00:02:35.85\00:02:39.29 reads their Bible and stands by 00:02:39.32\00:02:41.76 would think that to steal, you know, 00:02:41.79\00:02:44.93 whether it's at gunpoint on the street corner 00:02:44.96\00:02:47.66 or from a company embezzling from the company 00:02:47.70\00:02:50.07 that this is a crime, this is immoral. 00:02:50.10\00:02:52.97 But I don't know of any history of Christians, 00:02:53.00\00:02:57.11 you know, with posters out front of a prison 00:02:57.14\00:02:59.57 or mistreating ex-prisoners because of their crime. 00:02:59.61\00:03:03.55 We see this as the foible of fallen human beings, 00:03:03.58\00:03:05.98 and we try to witness to them and have the mend their ways 00:03:06.01\00:03:08.65 and join the Christian community, 00:03:08.68\00:03:10.12 it's not a holier-than-thou, 00:03:10.15\00:03:12.32 you know, go to hell and stay there type approach. 00:03:12.35\00:03:15.02 Well, look, religious freedom is suffering 00:03:15.06\00:03:17.63 as is the gospel itself 00:03:17.66\00:03:19.59 by the very harsh culture war hostility that, 00:03:19.63\00:03:24.43 you know, some Christians are nurturing. 00:03:24.47\00:03:27.07 Now a part of that, honestly, 00:03:27.10\00:03:29.24 I have to lay the blame at the feet of both preachers 00:03:29.27\00:03:33.71 and unaffiliated Christian organizations 00:03:33.74\00:03:38.01 that need conflict to raise money. 00:03:38.05\00:03:40.48 Yeah, I think you're right. 00:03:40.52\00:03:41.92 This is, you know, part of the whole equation, 00:03:41.95\00:03:44.49 I've seen this for decades, 00:03:44.52\00:03:46.62 and I've been so thankful to be part of 00:03:46.65\00:03:49.22 a denominationally-based organization, 00:03:49.26\00:03:52.19 we're affiliated with the Seventh-day Adventist Church, 00:03:52.23\00:03:54.86 we're not independently raising money. 00:03:54.90\00:03:57.53 I don't have to express, you know, a hysterical opinion 00:03:57.57\00:04:01.87 to get people scared enough to give me money, 00:04:01.90\00:04:04.74 you know, and that's what I see happening 00:04:04.77\00:04:07.58 both from the Liberals and the Conservatives. 00:04:07.61\00:04:10.21 I used to say that the likes of, 00:04:10.25\00:04:12.15 you know, the culture warriors in the Christian community 00:04:12.18\00:04:15.65 like Pat Robertson or Jerry Falwell, 00:04:15.68\00:04:17.65 they were in a sick, symbiotic relationship 00:04:17.69\00:04:20.32 with the culture warriors on the left like Barry Lynn 00:04:20.36\00:04:23.16 of Americans United for Separation of Church and State. 00:04:23.19\00:04:24.53 That's true, they needed each other. 00:04:24.56\00:04:25.96 You know, they needed each other to raise money 00:04:25.99\00:04:28.40 and to build up their own powerbase. 00:04:28.43\00:04:30.77 Well, let's get back to Jack Phillips though. 00:04:30.80\00:04:33.27 So Phillips has the... 00:04:33.30\00:04:34.64 Try to give a cultural backdrop. 00:04:34.67\00:04:36.00 Sure. 00:04:36.04\00:04:37.37 'Cause it doesn't make sense to some people. 00:04:37.41\00:04:38.74 Well, so he has an objection, 00:04:38.77\00:04:41.74 he feels, according to the records in the case, 00:04:41.78\00:04:44.65 it's his belief 00:04:44.68\00:04:46.01 that baking the special cake to honor a same-sex... 00:04:46.05\00:04:49.62 And probably it's not the baking, 00:04:49.65\00:04:50.99 it's the decorating that got to him mostly, right? 00:04:51.02\00:04:54.62 Putting an artistic input into it 00:04:54.66\00:04:56.76 where he would have to invest his feelings, 00:04:56.79\00:04:59.39 and creativity, and so on. 00:04:59.43\00:05:01.76 Bottom line, he felt that would be an expression, 00:05:01.80\00:05:06.90 an expression of speech, and endorsement, 00:05:06.94\00:05:09.47 and violation of his conscience. 00:05:09.50\00:05:11.31 So you have two sets of rights here, 00:05:11.34\00:05:14.21 Colorado has broad anti-discrimination laws 00:05:14.24\00:05:18.48 that apply to businesses, public accommodations laws. 00:05:18.51\00:05:22.48 Now these laws predate 00:05:22.52\00:05:25.89 the American civil rights movement 00:05:25.92\00:05:28.12 and the Civil Rights Act of 1964. 00:05:28.16\00:05:31.06 Colorado's laws go back to statehood 00:05:31.09\00:05:34.06 shortly after statehood in the 19th century, 00:05:34.10\00:05:36.63 they began to prohibit 00:05:36.67\00:05:38.70 discrimination and public accommodations. 00:05:38.73\00:05:40.70 So these laws are very ancient, 00:05:40.74\00:05:42.70 they were amended more recently to include sexual orientation 00:05:42.74\00:05:46.34 and businesses generally can't discriminate, 00:05:46.37\00:05:48.94 you have to serve people regardless of their age, 00:05:48.98\00:05:52.11 or sex, or, you know, disability, or religion, 00:05:52.15\00:05:55.45 you know, etcetera. 00:05:55.48\00:05:57.12 So you have these two sets of rights, 00:05:57.15\00:05:59.12 rights of conscience, 00:05:59.15\00:06:01.22 right not to be discriminated against. 00:06:01.26\00:06:03.26 They go all the way to the Supreme Court. 00:06:03.29\00:06:05.43 And what does the Supreme Court do, 00:06:05.46\00:06:07.83 it punts, and it gives a victory to nobody. 00:06:07.86\00:06:12.40 Yeah. 00:06:12.43\00:06:13.94 Well, I thought you were gonna explain how. 00:06:13.97\00:06:15.30 Well, yeah, no, I will. 00:06:15.34\00:06:16.67 I felt there was prejudice 00:06:16.71\00:06:18.04 on the part of those representing the gay lobby, 00:06:18.07\00:06:20.74 the way they'd expressed themselves ahead of time 00:06:20.78\00:06:22.98 showed that they really had the animus 00:06:23.01\00:06:25.18 even though they brought it out of him. 00:06:25.21\00:06:27.08 So you have an administrative judge that issues a decision 00:06:27.12\00:06:31.89 and then it's reviewed 00:06:31.92\00:06:33.25 by the Colorado Civil Rights Commission. 00:06:33.29\00:06:35.69 There were two hearings at the Commission 00:06:35.72\00:06:37.86 and two of the four commissioners 00:06:37.89\00:06:40.23 expressed significant hostility 00:06:40.26\00:06:43.40 to the notion of religious discrimination. 00:06:43.43\00:06:46.47 So they viewed Phillips as being discriminatory 00:06:46.50\00:06:50.44 and they lumped it with the Nazi Holocaust, 00:06:50.47\00:06:54.04 they lumped it with the history of slavery, 00:06:54.08\00:06:56.51 and Jim Crow laws etcetera. 00:06:56.54\00:06:58.91 And the Supreme Court said, 00:06:58.95\00:07:00.65 "You know, when you adjudicate these conflicts of rights, 00:07:00.68\00:07:04.35 religion has a right to be treated fairly, 00:07:04.39\00:07:07.79 the government can't be hostile to religious claims." 00:07:07.82\00:07:12.59 Yeah. 00:07:12.63\00:07:13.96 Now there's a... but there's a back story here. 00:07:14.00\00:07:16.33 The back story is that the Supreme Court, 00:07:16.36\00:07:20.14 30 years ago, destroyed 00:07:20.17\00:07:22.84 the constitutional value of religious freedom 00:07:22.87\00:07:26.44 and this is something that... 00:07:26.47\00:07:27.81 Smith case. 00:07:27.84\00:07:29.18 The peyote case, 00:07:29.21\00:07:30.55 Employment Division against Smith. 00:07:30.58\00:07:31.91 Because religious-free exercise, 00:07:31.95\00:07:34.98 religious conscience has now been relegated to, 00:07:35.02\00:07:37.82 you know, I say the back of the civil rights bus 00:07:37.85\00:07:40.62 or even being dragged behind the civil rights bus, 00:07:40.66\00:07:44.36 like a lynching practically. 00:07:44.39\00:07:47.06 Because of that, 00:07:47.10\00:07:48.66 the Supreme Court did not... was not able to engage 00:07:48.70\00:07:53.84 in the traditional weighing of rights. 00:07:53.87\00:07:56.17 And let me explain what that would look like. 00:07:56.20\00:07:58.64 So you have a neutral law, when I say neutral, 00:07:58.67\00:08:04.05 the civil rights law in Colorado, 00:08:04.08\00:08:07.18 it doesn't target people of faith, 00:08:07.22\00:08:09.72 you know, especially, it applies to everybody. 00:08:09.75\00:08:12.35 So it's not discriminatory in its language, 00:08:12.39\00:08:16.76 but in its application to Mr. Phillips, arguably, 00:08:16.79\00:08:20.33 it's restricting his religious freedom. 00:08:20.36\00:08:23.37 Okay. 00:08:23.40\00:08:24.73 So the question is how do you resolve these conflicts. 00:08:24.77\00:08:27.00 Well, under the traditional view, 00:08:27.04\00:08:30.07 you would say, "Does the state have a compelling interest 00:08:30.11\00:08:34.34 in eradicating discrimination?" 00:08:34.38\00:08:36.41 That's a pretty easy question to answer. 00:08:36.44\00:08:38.01 Yes, state's interest 00:08:38.05\00:08:40.18 in prohibiting discrimination broadly, 00:08:40.22\00:08:43.08 that's a compelling interest. 00:08:43.12\00:08:44.45 Well, they have other compelling interests. 00:08:44.49\00:08:45.82 I always object to that statement that... 00:08:45.85\00:08:47.56 I know you do, but let's, 00:08:47.59\00:08:49.46 you know, but then the next question is, 00:08:49.49\00:08:52.56 is it necessary, in order to achieve that interest, 00:08:52.59\00:08:55.60 to restrict the religious conscience of Jack Phillips. 00:08:55.63\00:08:59.23 You know, you have to have... 00:08:59.27\00:09:00.60 it's called a least restrictive means analysis. 00:09:00.64\00:09:03.20 So his rights get considered. 00:09:03.24\00:09:07.88 That kind of analysis, the court no longer engages in, 00:09:07.91\00:09:12.15 they only ask, "Is the law itself discriminatory? 00:09:12.18\00:09:16.52 Is it neutral in its language?" 00:09:16.55\00:09:18.55 And the answer clearly is yes. 00:09:18.59\00:09:20.29 So free exercise doesn't even get to first base, 00:09:20.32\00:09:23.43 you don't have a claim, which is why 00:09:23.46\00:09:26.06 the lawyers for Jack Phillips litigated this 00:09:26.09\00:09:28.40 as a free speech case. 00:09:28.43\00:09:30.37 Now we don't traditionally think 00:09:30.40\00:09:32.70 of baking a cake as expression. 00:09:32.73\00:09:37.27 You know, there's another case involving Alain photography, 00:09:37.31\00:09:40.58 wedding photography, 00:09:40.61\00:09:42.04 you know, we can relate to a little bit more 00:09:42.08\00:09:45.05 as an art form, as, you know, expression, 00:09:45.08\00:09:48.68 but baking a cake, well, Jack is the unusual baker. 00:09:48.72\00:09:51.82 I mean, he calls it Masterpiece Cakeshop because, you know, 00:09:51.85\00:09:55.52 he fancies himself a bit of an artist, 00:09:55.56\00:09:58.33 and he engages with a couple to understand 00:09:58.36\00:10:01.70 where they're coming from and to craft a cake. 00:10:01.73\00:10:03.23 Yeah, they don't have any problem, 00:10:03.26\00:10:04.60 see, these are both creative endeavors. 00:10:04.63\00:10:07.50 You don't but, you know, 00:10:07.54\00:10:09.44 reasonable people differ on whether, 00:10:09.47\00:10:12.07 you know, this is free speech. 00:10:12.11\00:10:13.44 I'll give you an example. 00:10:13.48\00:10:14.81 One of the champions of free speech in the legal academy 00:10:14.84\00:10:18.58 is a law professor out of UCLA by the name of Eugene Wollock, 00:10:18.61\00:10:22.85 and he runs a religion law listserv, 00:10:22.88\00:10:26.96 so Eugene Wollock would side with 00:10:26.99\00:10:31.23 the baker in the Baker case... 00:10:31.26\00:10:34.40 I'm sorry, would side with the photographer 00:10:34.43\00:10:36.63 but, as free speech, but would not agree that 00:10:36.67\00:10:39.47 the cake is his free speech, you know. 00:10:39.50\00:10:43.04 Now that's not to say he's right but just that, 00:10:43.07\00:10:45.44 you know, a thoughtful academic... 00:10:45.47\00:10:47.41 Because they've started with a premise 00:10:47.44\00:10:49.44 that we would say is wrong 00:10:49.48\00:10:50.81 and then come to conclusions of the trouble. 00:10:50.85\00:10:53.01 So the problem in this case starts with 00:10:53.05\00:10:57.19 we have a faulty legal landscape 00:10:57.22\00:10:59.79 that does not properly value religious conscience claims. 00:10:59.82\00:11:03.73 And what I don't think helps things much that 00:11:03.76\00:11:05.86 this is clearly a provocation. 00:11:05.89\00:11:08.03 I've said it on this program before. 00:11:08.06\00:11:12.03 Things like wedding photography and making a wedding cake, 00:11:12.07\00:11:16.24 or... 00:11:16.27\00:11:17.61 it's not up for legal challenge, 00:11:17.64\00:11:19.31 but where you're going to have your wedding dress made, 00:11:19.34\00:11:21.94 you go with someone simpatico, right? 00:11:21.98\00:11:25.25 It's somewhat self-regulating, 00:11:25.28\00:11:27.72 and if gays knew that 00:11:27.75\00:11:30.19 this was a Christian cake-maker or whatever, 00:11:30.22\00:11:33.32 they probably wouldn't knock on the door to start with, 00:11:33.36\00:11:35.79 they would go where they feel they're among fellow travelers. 00:11:35.82\00:11:39.36 So I think it's a setup from the get-go and so... 00:11:39.39\00:11:43.93 Well, and the upshot of it is after two weeks, 00:11:43.97\00:11:48.70 after he wins or, you know, he wins in the sense that 00:11:48.74\00:11:53.04 the court reverses the decision against him. 00:11:53.07\00:11:55.11 So in that sense, it is a win for him. 00:11:55.14\00:11:56.78 Yeah. 00:11:56.81\00:11:58.15 But then a transgender person had ordered a cake 00:11:58.18\00:12:02.98 and the Colorado Commission rules against Jack Phillips 00:12:03.02\00:12:07.42 saying that he discriminated against this transgender person 00:12:07.46\00:12:10.99 'cause he wouldn't bake a blue and pink cake 00:12:11.03\00:12:14.10 to celebrate their transition. 00:12:14.13\00:12:16.40 Well, let me throw something in, 00:12:16.43\00:12:18.20 and we need to take a break shortly. 00:12:18.23\00:12:19.90 But, you know, I've heard over and over again 00:12:19.93\00:12:22.10 and I know that generally this is true 00:12:22.14\00:12:23.84 that it doesn't matter what your position is per se, 00:12:23.87\00:12:28.08 if you hold something as a point of conscience 00:12:28.11\00:12:31.21 that's a deeply held conviction that 00:12:31.25\00:12:33.78 that needs to be on it, so it does... 00:12:33.82\00:12:35.88 on one level it seems to me, 00:12:35.92\00:12:37.25 it doesn't have to be proven 00:12:37.29\00:12:38.62 that he's had a biblical position 00:12:38.65\00:12:40.76 or that is consistent with what other churches hold. 00:12:40.79\00:12:44.23 He's troubled by this 00:12:44.26\00:12:45.59 and his feelings on one level should be respected, right? 00:12:45.63\00:12:48.73 Well, but here's the rub, Lincoln, 00:12:48.76\00:12:52.17 historically, the southern white Christian Church held 00:12:52.20\00:12:57.84 either slavery or segregation as religious dogma. 00:12:57.87\00:13:02.88 Right. 00:13:02.91\00:13:04.25 You brought it up and I've brought it before. 00:13:04.28\00:13:05.88 I remember when I first came to the US, 00:13:05.91\00:13:08.82 people were being turned away from stores 00:13:08.85\00:13:11.02 on a biblical basis but underneath, it was racism. 00:13:11.05\00:13:14.96 I will tell you that my kids generation, 00:13:14.99\00:13:17.59 they see Christian attitudes towards gays of a same piece 00:13:17.63\00:13:24.50 with Christian attitudes towards blacks. 00:13:24.53\00:13:26.90 Yeah. 00:13:26.94\00:13:28.27 And that's the problem, 00:13:28.30\00:13:29.64 we can talk about liberty of conscience in the abstract, 00:13:29.67\00:13:32.64 but when you're talking about the right to discriminate, 00:13:32.67\00:13:35.84 it's a tough sell. 00:13:35.88\00:13:37.25 Yeah. 00:13:37.28\00:13:38.61 And before the program, 00:13:38.65\00:13:39.98 we were talking about some of the dynamic that preceded this, 00:13:40.02\00:13:43.02 and I've always objected to gay, 00:13:43.05\00:13:46.49 and transgender, and lesbian, 00:13:46.52\00:13:49.52 and so on rights being equated with the civil rights movement. 00:13:49.56\00:13:53.50 I don't think it's a direct comparison. 00:13:53.53\00:13:55.70 We'll take a
