Welcome back to the Liberty Insider. 00:00:05.63\00:00:07.37 Before the break with guest Nick Miller, 00:00:07.40\00:00:09.44 we were talking about the Johnson, 00:00:09.47\00:00:11.91 I used the term, was it an amendment? 00:00:11.94\00:00:13.58 What was the term of the Johnson rule? 00:00:13.61\00:00:15.38 Johnson Bill or Johnson Act, I think. 00:00:15.41\00:00:16.95 Johnson Act, I think, yeah, 00:00:16.98\00:00:18.65 which restricted the ability of churches 00:00:18.68\00:00:22.78 to act directly in a nakedly political manner. 00:00:22.82\00:00:25.65 And I think we agreed that 00:00:25.69\00:00:27.66 there were good reasons for that 00:00:27.69\00:00:29.22 and security for both the state and church. 00:00:29.26\00:00:32.73 But this question of 00:00:32.76\00:00:36.13 how publicly religious views should be held and promoted 00:00:36.16\00:00:41.24 is very vibrant at the moment. 00:00:41.27\00:00:44.04 In another context on this gay marriage 00:00:44.07\00:00:46.94 and gay rights issue. 00:00:46.98\00:00:49.31 And, in fact, our new vice president 00:00:49.34\00:00:52.41 pins that was his last major act. 00:00:52.45\00:00:57.25 Governor of Indiana. 00:00:57.29\00:00:58.62 Governor of Indiana defended, hit the headlines, 00:00:58.65\00:01:01.06 he actually signed into, vote for at one point, 00:01:01.09\00:01:03.76 a referral bill that had as a writer, 00:01:03.79\00:01:07.56 an incredible authorization for people of faith 00:01:07.60\00:01:10.63 to refuse service of cakes, 00:01:10.67\00:01:12.50 and wedding photos, and the whole thing. 00:01:12.53\00:01:13.87 Right. 00:01:13.90\00:01:15.24 And then as I remember he had to back down. 00:01:15.27\00:01:16.71 Yes. 00:01:16.74\00:01:18.07 And it's probably gonna be the last of the state refers 00:01:18.11\00:01:21.18 for a long time. 00:01:21.21\00:01:22.54 Well, now that there's been a new administration though 00:01:22.58\00:01:24.75 and Mike Pence is now the Vice-President, 00:01:24.78\00:01:26.82 other winds could blow. 00:01:26.85\00:01:28.65 Well, that would have to be a wind, 00:01:28.68\00:01:30.02 because the federal government can't easily mandate 00:01:30.05\00:01:32.02 to the states too. 00:01:32.05\00:01:33.39 No, but a lot of states are wanting to do it. 00:01:33.42\00:01:35.19 Yeah, that's true. Yeah, you're right. 00:01:35.22\00:01:36.56 It changed the dynamic, there's no question. 00:01:36.59\00:01:39.46 But, you know, this is a bigger issue. 00:01:39.49\00:01:42.06 You and I may disagree on it. 00:01:42.10\00:01:46.10 Should a Christian expect that a law 00:01:46.13\00:01:49.44 will empower them to treat a non-believer differently, 00:01:49.47\00:01:54.44 if they are running a business 00:01:54.48\00:01:55.88 or even just any set of public interchange? 00:01:55.91\00:01:58.45 So let me ask a slightly different question. 00:01:58.48\00:02:01.02 Should the law protect a Christian businessman 00:02:01.05\00:02:04.62 in conducting their business 00:02:04.65\00:02:07.82 according to their moral convictions? 00:02:07.86\00:02:11.46 Let me throw another one at you. 00:02:11.49\00:02:14.13 We'll find out who's interviewing who. 00:02:14.16\00:02:16.60 But, you know, I'm old enough 00:02:16.63\00:02:18.30 when I first came to the US in 1966, 00:02:18.33\00:02:20.90 because the civil rights thing was blossoming. 00:02:20.94\00:02:23.61 We drove down south a few times 00:02:23.64\00:02:25.44 and I saw the signs on restaurants and other places. 00:02:25.47\00:02:29.88 Now I forget what the words... 00:02:29.91\00:02:32.95 No colors allowed? It's colors. 00:02:32.98\00:02:34.35 I was fishing for the word. No colors, no Jews. 00:02:34.38\00:02:36.62 No Jews, really? Wow. 00:02:36.65\00:02:38.05 Yup, and the other day... 00:02:38.09\00:02:42.12 My wife is Hispanic from Guatemala 00:02:42.16\00:02:44.76 and her brother was visiting from Guatemala, 00:02:44.79\00:02:48.00 but he studied in Texas, 00:02:48.03\00:02:49.86 and he told me how the police ejected him from a restaurant 00:02:49.90\00:02:53.13 that signed no Mexicans either. 00:02:53.17\00:02:56.27 He's not Mexican but, you know, was all Spanish... 00:02:56.30\00:02:58.71 It was a broad basis of discrimination. 00:02:58.74\00:03:00.48 Now I've studied enough to know 00:03:00.51\00:03:02.14 those were not just bigoted statements, 00:03:02.18\00:03:04.25 which they were. 00:03:04.28\00:03:05.61 Yeah. They were bigoted. 00:03:05.65\00:03:06.98 But there was a theology that lay behind it 00:03:07.02\00:03:08.62 and good Christian people felt that 00:03:08.65\00:03:11.09 this was their view that was being empowered by law. 00:03:11.12\00:03:14.69 Right. 00:03:14.72\00:03:16.06 So it was an erroneous theology which has never been widely 00:03:16.09\00:03:17.93 held in the church. 00:03:17.96\00:03:19.29 Well, is it erroneous? 00:03:19.33\00:03:20.66 It arose in particular societies 00:03:20.70\00:03:22.73 that were bigoted to begin with. 00:03:22.76\00:03:25.43 The south... 00:03:25.47\00:03:26.80 We are all bigoted to begin with. 00:03:26.84\00:03:28.17 Well, we know that's the faith statement, 00:03:28.20\00:03:29.80 it's the faith statement. 00:03:29.84\00:03:31.21 But there are historians have recognized 00:03:31.24\00:03:33.98 that the use of the Bible 00:03:34.01\00:03:35.34 to defend racial distinctions arose in the south 00:03:35.38\00:03:38.68 long after slavery was implemented. 00:03:38.71\00:03:41.22 It was a new argument to make against the moral arguments 00:03:41.25\00:03:44.19 that were being made against them. 00:03:44.22\00:03:45.92 Now, of course, I'm against these sorts of 00:03:45.95\00:03:50.93 improper uses of theology to defend discrimination, 00:03:50.96\00:03:54.56 but let me tell you how they are different. 00:03:54.60\00:03:56.50 But they are not putting signs up now. 00:03:56.53\00:03:58.60 I wouldn't feel too good, I mean, 00:03:58.63\00:04:00.30 I'm not a part of those communities, 00:04:00.34\00:04:02.34 but still just the effect on me, 00:04:02.37\00:04:04.24 if I went to a cake shop 00:04:04.27\00:04:07.14 and I see, "We do not serve gays." 00:04:07.18\00:04:10.18 Well, no. Okay, that would be inappropriate. 00:04:10.21\00:04:12.58 But that's what they wanted. 00:04:12.61\00:04:13.95 No, that's not what they wanted. 00:04:13.98\00:04:15.32 They don't want the sign, but they want to act that way. 00:04:15.35\00:04:16.79 No, this is an important distinction. 00:04:16.82\00:04:19.22 None of the cases I know involve discrimination 00:04:19.25\00:04:21.96 against gays. 00:04:21.99\00:04:23.32 In fact, in almost all, many of the cases... 00:04:23.36\00:04:25.39 Oh, I know, it's provocation 00:04:25.43\00:04:26.96 where they go there and try to... 00:04:27.00\00:04:28.53 No, no, no, no, this is the difference 00:04:28.56\00:04:30.03 between distinction, 00:04:30.07\00:04:31.67 I'm sorry, between identity and between moral act. 00:04:31.70\00:04:36.20 So in the cases, the race cases, 00:04:36.24\00:04:39.51 people are being turned down just because of their identity. 00:04:39.54\00:04:42.88 Who they are? 00:04:42.91\00:04:44.25 But in these issues relating to same sex marriage, 00:04:44.28\00:04:47.78 in many instances, the gay individuals 00:04:47.82\00:04:49.85 are long time customers of the florist or the bakery. 00:04:49.88\00:04:53.59 They are being served, 00:04:53.62\00:04:55.02 the owners know that these persons are gay, 00:04:55.06\00:04:57.26 they don't have a problem with serving them, 00:04:57.29\00:04:59.16 selling them cakes, or cupcakes, or whatever. 00:04:59.19\00:05:02.10 But what happens is, it's not about identity, 00:05:02.13\00:05:05.13 it's about moral choices. 00:05:05.17\00:05:07.94 So when that gay person decides to choose 00:05:07.97\00:05:11.64 to enter into a lifelong 00:05:11.67\00:05:13.14 or some sort of same sex relationship 00:05:13.17\00:05:15.81 and then wants to celebrate that, 00:05:15.84\00:05:17.78 that is taking a moral standing position 00:05:17.81\00:05:21.18 that they then want to involve the business owner in, 00:05:21.22\00:05:24.35 in promoting in some way. 00:05:24.39\00:05:26.05 So I think it's quite a different thing to say, 00:05:26.09\00:05:28.72 "I'm discriminating against someone based on who they are, 00:05:28.76\00:05:30.93 their status." 00:05:30.96\00:05:32.29 And I'm against that. 00:05:32.33\00:05:33.66 You know, if there was a Seventh-day Adventist 00:05:33.70\00:05:35.03 diner of a fast food, semi-fast food restaurant 00:05:35.06\00:05:38.87 that caters for parties. 00:05:38.90\00:05:40.34 Yeah. 00:05:40.37\00:05:41.70 Are they going to provide food at a beer party 00:05:41.74\00:05:44.91 where there's beer, dancing, and probably more. 00:05:44.94\00:05:48.14 So they may not choose to, right? 00:05:48.18\00:05:50.55 And that would be their moral choice to be able to. 00:05:50.58\00:05:53.52 They can say, I don't like your party, 00:05:53.55\00:05:55.08 I'm not gonna cater to it. 00:05:55.12\00:05:56.72 And let's make it as a professional, as a lawyer, 00:05:56.75\00:05:59.65 if I am approached by a pornographer, 00:05:59.69\00:06:02.39 Playboy Magazine or some such outfit, 00:06:02.42\00:06:05.96 and they want me to take their case, 00:06:05.99\00:06:08.56 I have the ability to say, 00:06:08.60\00:06:11.07 "No, I don't morally agree with your production 00:06:11.10\00:06:14.60 and I'm gonna chose not to." 00:06:14.64\00:06:16.40 Now if I can do that, 00:06:16.44\00:06:17.77 and I'm essentially protected 00:06:17.81\00:06:19.14 under my legal ethics and standards, 00:06:19.17\00:06:20.74 I have the right to do that. 00:06:20.78\00:06:22.84 Why is it that a blue collar worker 00:06:22.88\00:06:26.75 doesn't have the same moral protection? 00:06:26.78\00:06:29.05 And think about the Christians in the early Roman Empire. 00:06:29.08\00:06:33.19 You have thrown another spanner 'cause I forgotten that lawyers 00:06:33.22\00:06:37.23 and some other professionals would act that way. 00:06:37.26\00:06:39.19 We make moral distinctions 00:06:39.23\00:06:41.20 about the clients we will serve. 00:06:41.23\00:06:42.83 And if you think about the early Roman Empire, 00:06:42.86\00:06:45.83 Christians drew the line and sometimes lost their lives 00:06:45.87\00:06:50.77 not for doing some obviously immoral act, 00:06:50.81\00:06:54.28 but for refusing to burn a pinch of incense 00:06:54.31\00:06:57.31 to the emperors, it was highly symbolic. 00:06:57.35\00:07:00.45 It was hardly crossing the line on some issues. 00:07:00.48\00:07:03.08 They wouldn't incite the pledge of allegiance. 00:07:03.12\00:07:04.92 And so these persons, 00:07:04.95\00:07:07.32 these Christian florists or bakers are saying, 00:07:07.36\00:07:10.99 "If I make a cake with a wedding with two men on it 00:07:11.03\00:07:14.76 and provide it to the services there, 00:07:14.80\00:07:16.50 I'm endorsing, I'm supporting by my behavior this act 00:07:16.53\00:07:20.20 which I morally disagree with." 00:07:20.24\00:07:21.84 I actually see the moral quandary, 00:07:21.87\00:07:25.91 but I do believe that 00:07:25.94\00:07:27.28 there are many subtle interactions in life 00:07:27.31\00:07:31.35 where you apply your moral viewpoint 00:07:31.38\00:07:34.78 and you might pay up a penalty. 00:07:34.82\00:07:36.15 You might lose business, generally or specifically. 00:07:36.18\00:07:39.65 You may lose business, 00:07:39.69\00:07:41.02 but what's happened in many instances is that 00:07:41.06\00:07:42.76 they are then sued. 00:07:42.79\00:07:44.33 Well, we're in the developing phase of this new right. 00:07:44.36\00:07:47.43 Some businesses have been closed down. 00:07:47.46\00:07:48.86 I would have never granted it necessarily, but... 00:07:48.90\00:07:51.47 A business in Washington 00:07:51.50\00:07:52.83 for refusing to bake a cake. 00:07:52.87\00:07:55.00 What's going on is these are provocations 00:07:55.04\00:07:58.21 that flush out a bad attitude. 00:07:58.24\00:08:02.24 Well, let me ask you this. 00:08:02.28\00:08:03.61 But, you know, if you run a business, it seems to me, 00:08:03.65\00:08:06.88 you can guarantee that through that door will come 00:08:06.92\00:08:09.08 wife beaters, drug dealers, you know, 00:08:09.12\00:08:12.62 and people that are embezzling at work. 00:08:12.65\00:08:16.26 You don't know, you can't make that moral judgment, 00:08:16.29\00:08:18.03 but if here's something very obvious 00:08:18.06\00:08:21.96 sort of in your face thing, 00:08:22.00\00:08:23.47 does that make them a worst sinner than the others? 00:08:23.50\00:08:25.67 If you gonna disallow people 00:08:25.70\00:08:27.64 based on your distaste for their lifestyle, 00:08:27.67\00:08:30.31 you shouldn't be running a public business. 00:08:30.34\00:08:31.67 Well, let me ask you this. 00:08:31.71\00:08:33.04 If there was an African-American baker 00:08:33.07\00:08:35.68 and the local KKK high wizard came in and said, 00:08:35.71\00:08:40.45 "We want a cake saying white supremacy 00:08:40.48\00:08:43.22 with a burning cross on it, 00:08:43.25\00:08:44.75 should the black baker have to bake it? 00:08:44.79\00:08:47.02 Well, I don't know, because that's what seems to be 00:08:47.06\00:08:49.59 he's running foul some laws. 00:08:49.62\00:08:52.09 What? No, he can say that. 00:08:52.13\00:08:53.56 There is no law that prevents you from expressing 00:08:53.60\00:08:56.80 inappropriate racial views. 00:08:56.83\00:08:59.10 So if the answer to this one is no, 00:08:59.13\00:09:01.07 the black baker should be able to turn it down, 00:09:01.10\00:09:02.64 then why can't the Christian turn down a cake 00:09:02.67\00:09:04.87 that he is morally opposed to? 00:09:04.91\00:09:07.04 I believe in the real world. 00:09:07.08\00:09:08.94 You made a very interesting point. 00:09:08.98\00:09:10.58 In the real world these things sort them out 00:09:10.61\00:09:13.75 because something is personal 00:09:13.78\00:09:16.58 or becoming more personal like a customized cake 00:09:16.62\00:09:19.39 and that or your wedding pictures. 00:09:19.42\00:09:21.72 You go to someone that you're sympathetic with, right? 00:09:21.76\00:09:24.33 Well, you think so. What's happen normally... 00:09:24.36\00:09:25.99 These days people are seeking out, 00:09:26.03\00:09:27.93 ones with religious convictions and put them out to trial. 00:09:27.96\00:09:29.80 Well, they are seeking them out to prove a point. 00:09:29.83\00:09:31.37 Right. 00:09:31.40\00:09:32.73 But once the thing is settled, 00:09:32.77\00:09:34.70 I don't think this will come up very much. 00:09:34.74\00:09:37.17 Well, I hope not. 00:09:37.21\00:09:38.54 I mean, I think the point is 00:09:38.57\00:09:39.91 there's usually a number of different options 00:09:39.94\00:09:41.61 for cakes and flowers, 00:09:41.64\00:09:43.61 and it's not as though if the Christian one 00:09:43.65\00:09:45.21 doesn't provide it, 00:09:45.25\00:09:46.58 they are not going to have a wedding, 00:09:46.61\00:09:47.95 they are not gonna have access to it. 00:09:47.98\00:09:49.32 They want to force these individuals 00:09:49.35\00:09:51.55 to approve and support their moral choices. 00:09:51.59\00:09:54.76 And in a moral question, 00:09:54.79\00:09:56.56 and morally, the other side of it is exactly that. 00:09:56.59\00:09:58.46 Right. 00:09:58.49\00:09:59.83 And it's very abusive of peoples' 00:09:59.86\00:10:02.46 Christian sensibilities. 00:10:02.50\00:10:03.83 And if we're committed to morally pluralistic society, 00:10:03.87\00:10:07.54 then we need to preserve the ability of individuals. 00:10:07.57\00:10:11.11 That's why, in fact, 00:10:11.14\00:10:13.88 we agree that the gay community should have the right 00:10:13.91\00:10:16.85 to make the moral choices they do. 00:10:16.88\00:10:18.61 But then I should have the right 00:10:18.65\00:10:20.22 to make the moral choices I am convicted of. 00:10:20.25\00:10:22.08 But where they started, at least in my mind, 00:10:22.12\00:10:24.85 it didn't start with the gay thing, 00:10:24.89\00:10:27.56 it started with contraception, and chemists, 00:10:27.59\00:10:31.56 and others filling prescriptions, 00:10:31.59\00:10:34.20 and I didn't like that either. 00:10:34.23\00:10:35.80 Here you don't agree with their whole deal, 00:10:35.83\00:10:38.53 but it could make a huge difference in someone's life 00:10:38.57\00:10:41.17 whether they could get something over-the-counter 00:10:41.20\00:10:43.27 in this chemist or they go elsewhere 00:10:43.30\00:10:45.14 if it's available somewhere else in town. 00:10:45.17\00:10:46.71 But that's not a convenient thing at all. 00:10:46.74\00:10:49.31 You've affected other people's lives negatively 00:10:49.34\00:10:52.55 just because you have moral squeamishness about it. 00:10:52.58\00:10:57.72 But that was the state law. 00:10:57.75\00:10:59.12 I mean, in other words, the Supreme Court case 00:10:59.15\00:11:04.29 you're alluding to was about some states 00:11:04.33\00:11:06.90 forbid the sale of birth control. 00:11:06.93\00:11:09.00 And I think that was... 00:11:09.03\00:11:10.37 Supposedly there were moral objections 00:11:10.40\00:11:12.13 where the things would be denied to other people. 00:11:12.17\00:11:13.84 Yeah, well, the state has a complicated role 00:11:13.87\00:11:17.21 in trying to preserve morality, 00:11:17.24\00:11:19.44 but doing it in a way that doesn't infringe 00:11:19.47\00:11:21.94 on individual believer's freedom of conscience. 00:11:21.98\00:11:25.45 We need to learn how to stand up 00:11:25.48\00:11:26.92 for these issues as both Christian citizens 00:11:26.95\00:11:30.62 and citizens of the kingdom of heaven. 00:11:30.65\00:11:34.19 Quite a few years ago, I remember running an article 00:11:34.22\00:11:36.79 in Liberty Magazine by Dr. D. James Kennedy, 00:11:36.83\00:11:40.73 who had a TV program out of Coral Gables 00:11:40.76\00:11:43.30 and quite some national exposure. 00:11:43.33\00:11:46.30 In fact, he was to the fore 00:11:46.33\00:11:48.34 and pushing for a piece of legislation 00:11:48.37\00:11:50.31 then known as the Jones Bill, 00:11:50.34\00:11:53.17 and as Dr. Kennedy said, 00:11:53.21\00:11:55.51 "The Jones Bill would free the churches 00:11:55.54\00:11:58.38 to be a part of the community and a part of public life." 00:11:58.41\00:12:01.78 Well, let me free them by giving them political power. 00:12:01.82\00:12:04.69 I'm not so sure that, 00:12:04.72\00:12:06.69 that is the path to the best religious expression, 00:12:06.72\00:12:10.33 because in reality, as Jesus said, 00:12:10.36\00:12:12.49 "If the Son sets you free, you are free indeed." 00:12:12.53\00:12:15.26 And the freedom that we want to encourage 00:12:15.30\00:12:18.40 should bubble over from a spiritual life 00:12:18.43\00:12:20.94 and an indwelling hope in Christ 00:12:20.97\00:12:23.84 that is not able to be contained. 00:12:23.87\00:12:26.78 That spiritual revival doesn't need a Jones Bill. 00:12:26.81\00:12:32.28 It doesn't need the repudiation of the Johnson directives. 00:12:32.31\00:12:37.59 It needs the power of the spirit 00:12:37.62\00:12:39.62 lived out in the life and in the community. 00:12:39.65\00:12:42.72 For Liberty Insider, this is Lincoln Steed. 00:12:42.76\00:12:45.49
