We are fine here. 00:02:07.16\00:02:10.76 With regard to notice. 00:02:10.79\00:02:13.09 Yeah, that was the term I could... 00:02:13.13\00:02:14.70 Notice was a trap in the past that would give the coach 00:02:14.73\00:02:19.83 an opportunity to rule against the employee of faith. 00:02:19.87\00:02:23.20 And in fact, the lower courts had ruled against Samantha 00:02:23.24\00:02:26.91 and off the Muslim on the basis of lack of notice. 00:02:26.94\00:02:31.65 But an outrageous case in my opinion 00:02:31.68\00:02:35.85 is a case to decided 00:02:35.88\00:02:37.22 by the United States Court of Appeals 00:02:37.25\00:02:38.59 for the Fourth Circuit, 00:02:38.62\00:02:39.95 which covers the area where I live. 00:02:39.99\00:02:42.22 In that case there was a little Christian employee 00:02:42.26\00:02:46.29 in a company called Toulon, in Richmond. 00:02:46.33\00:02:50.10 She wrote a letter to her employer saying, 00:02:50.13\00:02:54.40 "I think you need to get closer to God 00:02:54.44\00:02:56.91 and I think you need to examine your relationship with God." 00:02:56.94\00:03:02.58 She was writing about the, 00:03:02.61\00:03:05.65 her boss' failure to promise when the work would be done. 00:03:05.68\00:03:12.22 He would lie about the time 00:03:12.25\00:03:15.12 things will be done and she had to do that work. 00:03:15.16\00:03:17.99 So she's being very nice 00:03:18.03\00:03:19.36 but she's writing to him about faith 00:03:19.39\00:03:21.30 and how he needs to be honesty. 00:03:21.33\00:03:23.16 Come to find out this fellow had a previous affairs 00:03:23.20\00:03:28.00 and she, that little Christian witness wrote the letter 00:03:28.04\00:03:31.81 and sent to his home, his wife looked at the letter, 00:03:31.84\00:03:35.01 apparently saw a women's hand writing and said, 00:03:35.04\00:03:39.95 "My husband is having an affair again." 00:03:39.98\00:03:43.49 So she called the little Christian witness 00:03:43.52\00:03:46.05 to confirm this, 00:03:46.09\00:03:47.46 the Christian witness said, "What? 00:03:47.49\00:03:50.03 This is not about that, this is about business." 00:03:50.06\00:03:52.43 But the wife had gone over the edge 00:03:52.46\00:03:56.00 and as you might imagine could happen 00:03:56.03\00:03:59.37 and didn't believe the Christian witness. 00:03:59.40\00:04:02.30 She's thought she was lying about, 00:04:02.34\00:04:04.01 so she called her husband up, brought him out of a meeting, 00:04:04.04\00:04:08.24 yelled at him. 00:04:08.28\00:04:09.84 He didn't like this embarrassment 00:04:09.88\00:04:12.01 and she was fired. 00:04:12.05\00:04:13.65 Now here's... 00:04:13.68\00:04:15.02 This isn't really a religious liberty, is it? 00:04:15.05\00:04:17.52 No, it's a religious liberty case 00:04:17.55\00:04:19.32 because she was writing the letter 00:04:19.35\00:04:20.99 because she said, "God told me to write to you. 00:04:21.02\00:04:24.19 I'm your little missionary, 00:04:24.23\00:04:26.13 telling you that you need to be honest." 00:04:26.16\00:04:29.10 But it would have been the same dynamic 00:04:29.13\00:04:30.57 if just as the matter of a depressed immorality. 00:04:30.60\00:04:34.50 She wrote and said, you should be more honest 00:04:34.54\00:04:36.74 about giving us assignments or whatever. 00:04:36.77\00:04:38.47 Well, here's the thing... 00:04:38.51\00:04:39.84 That would have come out the... 00:04:39.87\00:04:41.21 well, it may wouldn't have come out the same 00:04:41.24\00:04:42.58 but it would have been the same dynamic, wouldn't it? 00:04:42.61\00:04:43.95 See, there are protected categories under Title VII, 00:04:43.98\00:04:46.98 and categories that aren't protected, 00:04:47.02\00:04:48.35 religion is protected. 00:04:48.38\00:04:49.85 She was clearly motivated by her religious faith 00:04:49.88\00:04:52.62 to write this letter. 00:04:52.65\00:04:54.52 The US Court of Appeals for the Fourth Circuit 00:04:54.56\00:04:56.93 ruled against her because it said this, 00:04:56.96\00:05:00.16 "Even though there was no company policy 00:05:00.20\00:05:02.70 against writing letters to co-workers," they said, 00:05:02.73\00:05:07.44 "She should have known that writing a letter like that 00:05:07.47\00:05:11.81 would be inappropriate," and therefore, 00:05:11.84\00:05:14.64 she's going to write a letter like that, 00:05:14.68\00:05:16.51 she should've give notice to the company 00:05:16.54\00:05:19.68 prior to writing the letter 00:05:19.71\00:05:21.18 that she intended to write the letter. 00:05:21.22\00:05:22.92 Now of course, this is completely ridiculous. 00:05:22.95\00:05:25.09 How could she, she had to be a prophet to figure out 00:05:25.12\00:05:28.59 that they had a rule like that 00:05:28.62\00:05:30.96 and then she have to write a letter saying, 00:05:30.99\00:05:32.89 "I know you don't have a rule 00:05:32.93\00:05:34.26 but I'm going to write a letter," 00:05:34.30\00:05:35.63 and that was the only way. 00:05:35.66\00:05:37.00 The court ruled against her for lack of notice. 00:05:37.03\00:05:40.00 That decision has gone down the drain as it were, 00:05:40.04\00:05:44.57 it's in the garbage can 00:05:44.61\00:05:46.44 after the Abercrombie & Fitch decision. 00:05:46.47\00:05:50.25 Yeah, I can see that it set a bad precedent. 00:05:50.28\00:05:52.78 Yeah. Not good at all. 00:05:52.81\00:05:54.18 See, and this is not the only court 00:05:54.22\00:05:56.85 because I teach employment discrimination 00:05:56.89\00:05:59.39 and teach class called Religion in the Workplace. 00:05:59.42\00:06:03.66 Courts often do this. 00:06:03.69\00:06:05.19 Will say, well, we're going to rule against you 00:06:05.23\00:06:08.06 based on notice, you didn't clearly give notice. 00:06:08.10\00:06:11.57 So it's a wonderful decision. Let me throw in something else. 00:06:11.60\00:06:17.07 It just occurred to me, 00:06:17.11\00:06:18.44 I've got a legal expert here. 00:06:18.47\00:06:24.48 You know, we have a system of laws and obviously, 00:06:24.51\00:06:27.25 when we're talking about religious accommodation, 00:06:27.28\00:06:29.75 lawyers get involved. 00:06:29.78\00:06:32.22 How does the element of a public defendant work 00:06:32.25\00:06:36.99 in these religious liberty case. 00:06:37.03\00:06:39.43 Probably not at all. Not at all? 00:06:39.46\00:06:41.40 Because there's been cases. Yes. 00:06:41.43\00:06:43.20 Public defenders exist for criminal cases. 00:06:43.23\00:06:46.53 Here is what the government does... 00:06:46.57\00:06:49.74 What I was getting at, 00:06:49.77\00:06:51.11 seems like a lot of people get bad legal advice, 00:06:51.14\00:06:53.81 which you easily get. 00:06:53.84\00:06:57.11 So is there a need for people, well, I'll rephrase it then. 00:06:57.15\00:07:00.92 Do you think in our area, 00:07:00.95\00:07:04.45 we all seem to know the general layout of the lane 00:07:04.49\00:07:06.96 but do lawyers who would defend people with different cases, 00:07:06.99\00:07:10.39 do they understand these nuances 00:07:10.43\00:07:13.16 for religious accommodation? 00:07:13.19\00:07:14.70 This is the reason why I teach employment discrimination, 00:07:14.73\00:07:17.70 so that lawyers will know these things 00:07:17.73\00:07:19.97 and will be equipped to do this. 00:07:20.00\00:07:22.47 Instead, public defenders, 00:07:22.50\00:07:24.01 they're some powerful private organizations 00:07:24.04\00:07:27.81 that fund these cases. 00:07:27.84\00:07:29.48 Not only is the National Right to Work 00:07:29.51\00:07:31.88 Legal Defense Foundation, 00:07:31.91\00:07:33.38 my employer funding these cases in the area 00:07:33.42\00:07:35.98 of Compulsory Union Dues, but the Alliance Defense Fund 00:07:36.02\00:07:39.72 is a very powerful organization that helps employees 00:07:39.75\00:07:43.86 and other citizens for free, defend their religion. 00:07:43.89\00:07:47.00 I can name several organizations 00:07:47.03\00:07:50.10 the Beckett fund. 00:07:50.13\00:07:52.67 The American Center of Law and Justice 00:07:52.70\00:07:55.10 is connected with... 00:07:55.14\00:07:56.97 No, and anyone that reads liberty magazines knows 00:07:57.01\00:08:00.24 that we take issue against each of those on occasion, 00:08:00.28\00:08:02.91 but overall they do a wonderful, 00:08:02.94\00:08:06.35 wonderful work, I know that. 00:08:06.38\00:08:07.72 They allow these cases to be brought in addition, 00:08:07.75\00:08:11.32 and for any of your listeners 00:08:11.35\00:08:13.12 are thinking about a case like this, 00:08:13.15\00:08:16.29 the law says if you bring a Title VII, 00:08:16.32\00:08:19.83 religious accommodation case and you win, 00:08:19.86\00:08:23.20 the other side pays your attorney's fees. 00:08:23.23\00:08:26.74 So this is a powerful incentive for... 00:08:26.77\00:08:29.90 Isn't that the law, generally? No, no. 00:08:29.94\00:08:33.48 Fee shifting is, this is called fee shifting. 00:08:33.51\00:08:37.11 Fee shifting is very rare in the United States. 00:08:37.15\00:08:40.45 The law in the United States is that each litigant 00:08:40.48\00:08:44.32 bears their own cost and pays their own attorney's fees. 00:08:44.35\00:08:48.76 But because congress want to encourage people 00:08:48.79\00:08:52.39 who wouldn't have money 00:08:52.43\00:08:53.86 to be able to vindicate their civil rights, 00:08:53.90\00:08:57.03 they have this fee shifting statue. 00:08:57.07\00:08:59.43 And so individuals who win can collect fees. 00:08:59.47\00:09:03.00 I could be wrong, but I think in British, 00:09:03.04\00:09:05.24 the system in Australia, I think it is fee shifting. 00:09:05.27\00:09:09.48 That's right, in the British system. 00:09:09.51\00:09:11.38 I always understood, in it's functions, 00:09:11.41\00:09:14.65 what you said is true, 00:09:14.68\00:09:16.22 but it can function is a disincentive 00:09:16.25\00:09:18.52 for someone just suing someone because they have, you know, 00:09:18.55\00:09:22.89 other some means or aggravated, 00:09:22.92\00:09:25.73 but then if there's a penalty for them 00:09:25.76\00:09:27.40 and they have to pay for dragging it on. 00:09:27.43\00:09:29.70 Right, and the British system the winner gets paid 00:09:29.73\00:09:35.17 and the looser pays, but it's not that way 00:09:35.20\00:09:39.24 in the fee shifting for civil right's case 00:09:39.27\00:09:41.44 and this is very important. 00:09:41.48\00:09:42.98 If the plaintiff, that is the personal claims 00:09:43.01\00:09:46.65 the religious accommodation right 00:09:46.68\00:09:48.48 or gender discrimination or whatever it is, 00:09:48.52\00:09:51.12 if they win, they are entitle the fees. 00:09:51.15\00:09:53.76 They only pay fees if their sue is frivolous. 00:09:53.79\00:09:59.09 Yeah, and the judge decides that. 00:09:59.13\00:10:01.16 Judge decides that. 00:10:01.20\00:10:02.76 So that means almost every time the winning plaintiff 00:10:02.80\00:10:07.54 in the religious discrimination case gets the fees rarely. 00:10:07.57\00:10:12.37 If the person who's the plaintiff 00:10:12.41\00:10:15.21 in the religious accommodation case looses, 00:10:15.24\00:10:17.65 do they pay fees, very rarely. 00:10:17.68\00:10:19.51 If you would have to be frivolous, 00:10:19.55\00:10:21.12 you have to have a lawyer 00:10:21.15\00:10:23.32 who wasn't carefully evaluating your case 00:10:23.35\00:10:26.12 in order for you to have to pay fees. 00:10:26.15\00:10:28.39 Well, you know, we started with this discussion 00:10:28.42\00:10:30.29 of the Samantha. 00:10:30.33\00:10:33.03 Yes. A young Muslim woman. 00:10:33.06\00:10:35.13 But it's, I don't know if we mentioned it before, 00:10:35.16\00:10:37.13 but it was mentioned. 00:10:37.17\00:10:38.50 This case was a Muslim, but the positive effect 00:10:38.53\00:10:42.10 that spread across all people of faith, isn't it? 00:10:42.14\00:10:43.97 That's correct. 00:10:44.01\00:10:45.34 And it might be at the moment in a curious twist of history 00:10:45.37\00:10:50.75 that even though Islam is connected 00:10:50.78\00:10:53.65 with some terrorist actions 00:10:53.68\00:10:55.05 but there's a fairly good diligence 00:10:55.08\00:10:58.02 to accommodate Muslims 00:10:58.05\00:10:59.42 in the workplace and other places. 00:10:59.45\00:11:01.22 That's right. 00:11:01.26\00:11:02.59 I'm a big advocate that facts make a difference. 00:11:02.62\00:11:05.59 And so in certain cases, you've got to be sure 00:11:05.63\00:11:09.50 that you're facts are the best. 00:11:09.53\00:11:12.20 So if you're a listener, you're involved 00:11:12.23\00:11:14.57 in a religious accommodation case, 00:11:14.60\00:11:16.71 I think it's very important for you 00:11:16.74\00:11:18.61 to do your very best to cooperate with your employer 00:11:18.64\00:11:22.58 in the accommodation. 00:11:22.61\00:11:23.95 Do what makes your side appear most reasonable and helpful. 00:11:23.98\00:11:30.15 As the school boy growing up in Australia, 00:11:30.19\00:11:32.19 I will remember taking the train quite a few stations 00:11:32.22\00:11:37.03 to my school, being amazed that the myriads of uniform 00:11:37.06\00:11:41.36 that the different school boys and school girls wore. 00:11:41.40\00:11:44.20 Each school had a very distinctive uniform. 00:11:44.23\00:11:48.40 I sometimes miss that. 00:11:48.44\00:11:50.27 But when you think about religion, 00:11:50.31\00:11:51.81 very often with intention or not 00:11:51.84\00:11:56.08 different religious groups are defined by their dress 00:11:56.11\00:12:00.62 and indeed sometimes their very uniform. 00:12:00.65\00:12:04.95 We need to respect that, its part of the culture 00:12:04.99\00:12:08.86 and indeed, the presentation of one's faith. 00:12:08.89\00:12:13.46 It's very often seen as sort of something 00:12:13.50\00:12:16.80 that grudgingly we will grant. 00:12:16.83\00:12:18.40 But for those people like the young girl 00:12:18.43\00:12:20.67 at Abercrombie and Fitch, 00:12:20.70\00:12:23.81 this is an expression of her deeply held faith. 00:12:23.84\00:12:27.48 And it must be accommodated 00:12:27.51\00:12:29.34 if we had to make any pretense law 00:12:29.38\00:12:32.31 of truly accommodating religious conviction. 00:12:32.35\00:12:37.89 For Liberty Insider, this is Lincoln Steed. 00:12:37.92\00:12:41.12
