Welcome back to the Liberty Insider. 00:00:07.72\00:00:10.29 And before the break, 00:00:10.32\00:00:12.04 with guest Attorney Allen Reinach, 00:00:12.07\00:00:14.21 we were really getting into discussion of this, 00:00:14.24\00:00:17.24 the whole movement toward gay rights. 00:00:17.27\00:00:19.51 And, and--yeah, 00:00:19.54\00:00:21.37 there is a developing threat to Christian expression 00:00:21.40\00:00:24.72 but how it really shouldn't be, 00:00:24.75\00:00:26.00 it doesn't have to be, does it? 00:00:26.03\00:00:28.13 But it's certainly emerging that way. 00:00:28.16\00:00:30.17 Well, as of we said the legal structure now 00:00:30.20\00:00:33.99 favors gay rights over religious freedom. 00:00:34.02\00:00:36.24 That's very unfortunate. 00:00:36.27\00:00:37.30 Implications of that are really profound 00:00:37.33\00:00:40.11 especially for institutions. 00:00:40.14\00:00:42.87 So for example, can you imagine 00:00:42.90\00:00:45.90 in our society a white supremacists group 00:00:45.93\00:00:50.40 being permitted to operate a school 00:00:50.43\00:00:52.94 according to racist teachings? 00:00:52.97\00:00:55.47 So that they would only admit white students 00:00:55.50\00:00:58.49 and only hire white teachers. 00:00:58.52\00:01:01.17 What would happen the first time, 00:01:01.20\00:01:03.13 an Asian, a Latina, an African-American 00:01:03.16\00:01:06.22 applied to be a student or applied to be a teacher 00:01:06.25\00:01:09.54 and was rejected, they filed the lawsuit? 00:01:09.57\00:01:12.19 What happens is... 00:01:12.22\00:01:13.43 You're actually-- your point is correct. 00:01:13.46\00:01:16.13 Speaking facetiously, 00:01:16.16\00:01:17.22 Bob Jones came under that charge in 2000. 00:01:17.25\00:01:21.15 Well, but my point is this because 00:01:21.18\00:01:24.17 we are legally acquitting homosexuality and race, okay. 00:01:24.20\00:01:29.42 And so the status of religious institutions, 00:01:29.45\00:01:34.47 schools, hospitals, social service agencies, 00:01:34.50\00:01:37.57 adoption agencies, childcare centers, 00:01:37.60\00:01:41.09 you name it, nursing homes, 00:01:41.12\00:01:43.02 the status of religious institutions 00:01:43.05\00:01:46.46 that hold to traditional, 00:01:46.49\00:01:48.44 moral and biblical views of marriage, 00:01:48.47\00:01:50.54 whether they are Christians, Jewish, Muslim, 00:01:50.57\00:01:53.28 you name it, are going to be the functional equivalent 00:01:53.31\00:01:58.15 of Iron Nations of a white supremacist group 00:01:58.18\00:02:01.91 and we will only be permitted to operate institutions 00:02:01.94\00:02:05.43 if we will conform to the thought police 00:02:05.46\00:02:08.53 and agree with values that say 00:02:08.56\00:02:12.81 that homosexual conduct 00:02:12.84\00:02:16.31 is morally equivalent to heterosexual conduct. 00:02:16.34\00:02:19.30 It's a total clash of value systems 00:02:19.33\00:02:21.74 as a secular value system is really adapted, 00:02:21.77\00:02:24.81 not a secular neutrality, 00:02:24.84\00:02:26.24 but an active promulgation of account of viewpoint 00:02:26.27\00:02:31.57 that it doesn't accept from religion-- 00:02:31.60\00:02:32.84 It's a zero-sum game 00:02:32.87\00:02:34.27 and in the name of equality and-- 00:02:34.30\00:02:37.53 Which is anything but... 00:02:37.56\00:02:38.59 And inclusiveness, traditional values, 00:02:38.62\00:02:42.18 Christians are being excluded. 00:02:42.21\00:02:45.19 And along the way we get this nonsense. 00:02:45.22\00:02:47.26 I know my son and daughter 00:02:47.29\00:02:49.76 go to public schools in-- 00:02:49.79\00:02:53.09 And they're already being softened up the idea that, 00:02:53.12\00:02:56.86 maybe students might go to any bathroom that strikes them. 00:02:56.89\00:03:02.64 That's becoming law in California that schools-- 00:03:02.67\00:03:06.35 But I heard my son talking about it 00:03:06.38\00:03:07.77 the other day and I was surprised, 00:03:07.80\00:03:09.05 you know what, you know what's going on? 00:03:09.08\00:03:12.21 Whether it will happen? I hope not. But anyhow-- 00:03:12.24\00:03:16.28 Also they're gonna start putting urinals in the ladies room, 00:03:16.31\00:03:20.23 I mean you know there is a biological difference. 00:03:20.26\00:03:23.60 Well, it's not the way it was meant, 00:03:23.63\00:03:27.19 but it seems to me that 00:03:27.22\00:03:28.25 there is a protection of privacy in the constitution 00:03:28.28\00:03:30.99 and this distracts to that in the worst way. 00:03:31.02\00:03:32.66 And state constitutions have much more explicit 00:03:32.69\00:03:36.93 and extended protections for privacy. 00:03:36.96\00:03:40.29 There is no explicit mention of privacy 00:03:40.32\00:03:42.82 in United States Constitution, 00:03:42.85\00:03:44.97 but there are in most of our state constitutions. 00:03:45.00\00:03:47.34 Explicit but it's the protection of the individuals. Right. 00:03:47.37\00:03:50.50 Well, I can tell you one, the quartering, 00:03:50.53\00:03:53.40 I mean it's a privacy issue 00:03:53.43\00:03:54.77 the quartering of troops in private homes. 00:03:54.80\00:03:59.14 We've spoken of them and the main objection 00:03:59.17\00:04:01.30 to look through the war of independence. 00:04:01.33\00:04:03.91 What muddy is this and we need to at least allude to it. 00:04:03.94\00:04:08.64 Yes, it's more and more developing unfortunately, 00:04:08.67\00:04:12.92 at least the secular argument sees the church as recalcitrant 00:04:12.95\00:04:17.64 and it has to be forced into line 00:04:17.67\00:04:19.64 which compromises its own stand. 00:04:19.67\00:04:22.02 But many within Christian and other religious communities 00:04:22.05\00:04:27.72 themselves proponents of gay rights and gay. Sure. 00:04:27.75\00:04:31.86 So, it isn't just the case of the Adventist church let say, 00:04:31.89\00:04:36.83 it isn't just that we have this view 00:04:36.86\00:04:39.78 and you know we're not going to hire gays 00:04:39.81\00:04:44.63 or wouldn't like to because it's inconsistent, 00:04:44.66\00:04:47.08 not personal prejudice but it's inconsistent with the message 00:04:47.11\00:04:50.49 that we're teaching to our young children and so on. 00:04:50.52\00:04:52.92 But many already are revealing themselves 00:04:52.95\00:04:58.35 to have this moral viewpoint and are calling on these laws. 00:04:58.38\00:05:03.75 So I don't know the way around but we have to recognize, 00:05:03.78\00:05:06.44 this is a huge complication to the faith position. 00:05:06.47\00:05:11.18 And not all faiths speak the same way already. Sure. 00:05:11.21\00:05:14.36 Some, it doesn't matter 00:05:14.39\00:05:16.07 if ordaining homosexual priests and so on and priest, well-- 00:05:16.10\00:05:20.53 Clergy. 00:05:20.56\00:05:21.83 Well, there are, some are priests 00:05:21.86\00:05:23.00 but not Roman Catholic priests. Right. Openly. 00:05:23.03\00:05:27.02 But you know there are things happening 00:05:27.05\00:05:28.42 that I think are just going to, 00:05:28.45\00:05:30.73 you know, the marginal line is not 00:05:30.76\00:05:32.09 where we imagine it is, it's within. 00:05:32.12\00:05:35.45 Well, that's true but I think talking about 00:05:35.48\00:05:38.94 within the questions that many have been asking are 00:05:38.97\00:05:42.79 whether pastors are going to be required 00:05:42.82\00:05:45.31 to perform same sex marriages, 00:05:45.34\00:05:47.72 whether churches are going to be required 00:05:47.75\00:05:50.80 to allow same sex weddings in their churches. 00:05:50.83\00:05:55.57 And at least at present to me those represent 00:05:55.60\00:05:59.92 the farthest extension of the so called pendulum. 00:05:59.95\00:06:04.69 I think it's fairly unlikely that in America, 00:06:04.72\00:06:09.45 we're gonna get to the place where the laws compel clergy 00:06:09.48\00:06:13.94 to perform weddings that they cannot morally conduct. 00:06:13.97\00:06:16.37 I could think of one scenario right away, 00:06:16.40\00:06:18.32 it's not uncommon, certainly with, 00:06:18.35\00:06:21.16 even with Adventist churches but other denominations, 00:06:21.19\00:06:24.05 they have the church, they have the services 00:06:24.08\00:06:26.70 and they rent it out to another denomination. 00:06:26.73\00:06:29.02 In our case it'll be on Sunday, 00:06:29.05\00:06:30.46 we have our services on Saturday 00:06:30.49\00:06:32.03 and then they're on Sunday. Right. 00:06:32.06\00:06:33.49 What's going to happen when that other denomination 00:06:33.52\00:06:35.58 say performs the gay marriage 00:06:35.61\00:06:37.46 and we begin to say we object because it's our property. 00:06:37.49\00:06:39.79 What's going to happen is we'll terminate the lease. 00:06:39.82\00:06:45.19 You can't easily terminate the lease 00:06:45.22\00:06:46.91 for reasons like that, can you? 00:06:46.94\00:06:48.74 You can terminate, well, 00:06:48.77\00:06:49.87 the lease will expire typically here on, 00:06:49.90\00:06:52.67 anyway, the point-- 00:06:52.70\00:06:53.75 But that's a wrinkle that just occurred to me 00:06:53.78\00:06:55.76 because I'm sure that will happen. 00:06:55.79\00:06:57.01 Yeah, when the church is being used 00:06:57.04\00:07:00.11 by another denomination, of course, 00:07:00.14\00:07:02.13 they're free to and you know it's not immoral, 00:07:02.16\00:07:07.85 I don't know that it somehow reflects badly 00:07:07.88\00:07:11.30 on the property owner if somebody does something 00:07:11.33\00:07:14.67 you don't like when they're renting your property. 00:07:14.70\00:07:18.48 No, I think that-- 00:07:18.51\00:07:19.54 The bigger problem is what happens... 00:07:19.57\00:07:21.52 Educational institutions. 00:07:21.55\00:07:23.18 Adventist churches in Hawaii for example, 00:07:23.21\00:07:25.51 some of them have done 00:07:25.54\00:07:26.57 a thriving business in weddings. 00:07:26.60\00:07:29.54 The Japanese like to come over and rent churches 00:07:29.57\00:07:32.04 and do Hawaiian weddings. 00:07:32.07\00:07:33.75 Well, in that case it could be very problematic 00:07:33.78\00:07:37.40 if you are advertising to the public 00:07:37.43\00:07:40.98 that you're open and doing a wedding business, 00:07:41.01\00:07:43.92 then I think you probably are not going to be in a position 00:07:43.95\00:07:48.29 to refuse a same sex wedding. 00:07:48.32\00:07:50.91 Then you become subject to the public accommodations laws 00:07:50.94\00:07:54.75 if you're willing to run the business. 00:07:54.78\00:07:55.81 But there is a whole front on this 00:07:55.84\00:07:56.87 and we know from Canada where the gay rights 00:07:56.90\00:08:03.24 are far more advance, 00:08:03.27\00:08:04.30 I mean the government is aggressively 00:08:04.33\00:08:05.88 pushing it against really-- 00:08:05.91\00:08:06.94 Well, and religious freedom is far less protected there. 00:08:06.97\00:08:08.61 Yeah, and we know that there'll be pastors 00:08:08.64\00:08:11.21 that declare themselves to be gay 00:08:11.24\00:08:12.71 and have the church to let them go. 00:08:12.74\00:08:15.80 There are pastors that apply for employment 00:08:15.83\00:08:18.91 saying they're gay, there will be schools 00:08:18.94\00:08:22.23 that again gay students, gay teachers, 00:08:22.26\00:08:25.78 it's just almost endless, 00:08:25.81\00:08:27.11 the test both already existing members 00:08:27.14\00:08:30.54 and others wanting to be employed. 00:08:30.57\00:08:32.28 Now thankfully, here in the United States, 00:08:32.31\00:08:36.03 there is Hannah Tabor case 00:08:36.06\00:08:37.15 I believe a leg up for church prerogative with its employees 00:08:37.18\00:08:40.74 in its clearly defined church operations. 00:08:40.77\00:08:44.38 So the church can fire you 00:08:44.41\00:08:45.44 and I for no good reason, we're discriminated against-- 00:08:45.47\00:08:47.05 Don't give ideas to-- 00:08:47.08\00:08:48.64 Yeah, we don't-- we don't have any recourse-- 00:08:48.67\00:08:50.86 I'm not a Supreme Court. 00:08:50.89\00:08:53.50 But still whether that, even that will be a bulkhead, 00:08:53.53\00:08:59.75 watertight bulkhead against this, I'm not so sure. 00:08:59.78\00:09:00.96 The problem is with our schools and especially, 00:09:00.99\00:09:03.77 I mean one of the first battle is gonna be curriculum, 00:09:03.80\00:09:07.10 our graduate programs and social works, psychology, 00:09:07.13\00:09:10.90 the accrediting bodies. Absolutely. 00:09:10.93\00:09:12.90 Eventually may wake up and say if you don't conform 00:09:12.93\00:09:16.52 to the values of homosexuality being moral 00:09:16.55\00:09:21.57 and teach this in your programs, 00:09:21.60\00:09:24.55 then you will lose your accreditation. 00:09:24.58\00:09:27.37 And that will be a new development 00:09:27.40\00:09:28.54 to have accreditation as an issue 00:09:28.57\00:09:31.05 over whether we retain control with it. 00:09:31.08\00:09:32.82 Well, Jerry Powell sued the American Bar Association 00:09:32.85\00:09:37.40 for denying accreditation to the law school 00:09:37.43\00:09:40.29 there at Liberty University. 00:09:40.32\00:09:42.15 And what the court said was that the American Bar Association 00:09:42.18\00:09:47.65 can't be sued for religious discrimination 00:09:47.68\00:09:49.76 because it's not a state actor, even though you can't-- 00:09:49.79\00:09:53.82 They're empowered by the state. 00:09:53.85\00:09:54.88 They're empowered by the state. 00:09:54.91\00:09:55.99 Government organization. 00:09:56.02\00:09:57.43 Exactly. So that's a big issue. 00:09:57.46\00:09:59.79 So it's going to be clearly 00:09:59.82\00:10:01.21 some very dynamic ongoing issues with this. 00:10:01.24\00:10:03.74 We've just seen the beginning of it, 00:10:03.77\00:10:06.02 rather than the Supreme Court thing is not the end of it, 00:10:06.05\00:10:08.11 it's probably just one of the opening shots 00:10:08.14\00:10:10.63 in a culture war of sort. 00:10:10.66\00:10:12.14 It's hard to talk about the conflict between gay rights 00:10:12.17\00:10:15.32 and religious liberty without somehow coming across 00:10:15.35\00:10:18.59 as hostile to homosexuals, 00:10:18.62\00:10:21.31 but without being hostile the reality is, 00:10:21.34\00:10:24.72 this conflict between gay rights and religious freedom 00:10:24.75\00:10:27.67 is likely to define the future of religious freedom 00:10:27.70\00:10:30.94 and future court cases 00:10:30.97\00:10:32.71 from many, many years to come. 00:10:32.74\00:10:34.71 It's a very serious conflict and right now, 00:10:34.74\00:10:38.16 religious freedom is at the back of the civil rights buzz. 00:10:38.19\00:10:41.50 Religious freedom is so important. 00:10:44.22\00:10:47.06 Very few people realize that in some countries 00:10:47.09\00:10:49.51 where there is little religious freedom, 00:10:49.54\00:10:51.74 like Saudi Arabia for example, 00:10:51.77\00:10:54.26 it's actually the death penalty to change your religion. 00:10:54.29\00:10:57.61 They don't realize that because 00:10:57.64\00:10:59.68 very few people are killed there. 00:10:59.71\00:11:02.19 In the war on terrorism where 00:11:02.22\00:11:04.41 so many people are being surveilled 00:11:04.44\00:11:06.51 and the easy assumption by authorities gathering 00:11:06.54\00:11:09.01 innumerable reams of information on people 00:11:09.04\00:11:11.17 is that they are, perhaps up to something no good. 00:11:11.20\00:11:14.68 The end of that is a stultifying of freedom itself. 00:11:14.71\00:11:19.85 As in Saudi Arabia, few people dare to step outside the norm, 00:11:19.88\00:11:24.90 so in this global security that's developing, 00:11:24.93\00:11:27.48 very few people dare to think independently. 00:11:27.51\00:11:30.30 Very few people dare to adapt a religious viewpoint 00:11:30.33\00:11:33.66 that might come under suspicion. 00:11:33.69\00:11:35.71 The net affect is a restriction on civil liberty, 00:11:35.74\00:11:39.03 a restriction on religious freedom. 00:11:39.06\00:11:42.49 For Liberty Insider, this is Lincoln Steed. 00:11:42.52\00:11:45.95
