was very much involved with Proposition 8, right? 00:00:47.43\00:00:51.80 We did advocate, try to teach people 00:00:51.83\00:00:54.75 why marriage is a good thing in the law. 00:00:54.78\00:00:58.16 Right, and so as a natural consequence, 00:00:58.19\00:01:00.77 I'm sure you have opinions over recent Supreme Court decisions 00:01:00.80\00:01:04.45 and a particular one really setting aside 00:01:04.48\00:01:08.53 through lack of standing the California case. 00:01:08.56\00:01:11.79 You know, and I have to say, Lincoln, my real concern is not 00:01:11.82\00:01:16.37 that same sex couples are gaining rights. 00:01:16.40\00:01:19.83 I have no problem with extending rights 00:01:19.86\00:01:23.56 to same sex couples. 00:01:23.59\00:01:25.23 What my concern is, 00:01:25.26\00:01:26.74 is if this is gonna be the knockout punch 00:01:26.77\00:01:29.51 to the rights of conscience. 00:01:29.54\00:01:31.38 The first knockout blow was the Peyote case 00:01:31.41\00:01:36.50 more than 20 years ago where the Supreme Court, 00:01:36.53\00:01:39.72 you know, Scalia's rhetoric was, 00:01:39.75\00:01:42.63 well, if we protect free exercise of religion, 00:01:42.66\00:01:44.93 then every conscience becomes a law unto itself. 00:01:44.96\00:01:48.56 And so from a traditional Roman Catholic perspective, 00:01:48.59\00:01:52.55 he was much more concerned about 00:01:52.58\00:01:54.98 the authority of the community 00:01:55.01\00:01:56.71 than the rights of the individual. 00:01:56.74\00:01:58.58 So you explain what happened--peyote, 00:01:58.61\00:02:01.86 what is peyote? 00:02:01.89\00:02:02.97 Well, peyote is cactus. 00:02:03.00\00:02:05.29 Is that another name for marijuana? 00:02:05.32\00:02:07.34 It's a hallucinogenic cactus 00:02:07.37\00:02:09.00 that is used by some Native American physicians. 00:02:09.03\00:02:13.69 As part of their religious spiritual traditions. 00:02:13.72\00:02:21.55 And what was the logic of the conclusion 00:02:21.58\00:02:23.15 or how does it state there? 00:02:23.18\00:02:25.24 The logic was that religious conscience has no standing, 00:02:25.27\00:02:31.72 no right to object to laws, in this case, 00:02:31.75\00:02:36.74 a criminal prohibition on the use of peyote 00:02:36.77\00:02:39.34 that applies broadly to everybody. 00:02:39.37\00:02:41.58 It completely turned the whole concept 00:02:41.61\00:02:44.27 of the first amendment upside down, 00:02:44.30\00:02:46.67 that we no longer have any respect 00:02:46.70\00:02:49.63 for free exercise of religion. 00:02:49.66\00:02:51.88 I agree with you, 00:02:51.91\00:02:52.94 I mean it's just patently obvious 00:02:52.97\00:02:54.35 because that cited in so many cases 00:02:54.38\00:02:56.26 that it's a negative effect 00:02:56.29\00:02:58.42 on the free exercise of religion. 00:02:58.45\00:03:00.24 So first we devalue free exercise 00:03:00.27\00:03:04.27 and the rights of conscience 00:03:04.30\00:03:05.63 and now what we're doing legally 00:03:05.66\00:03:08.43 is we are elevating the rights 00:03:08.46\00:03:11.09 of same sex relationships and homosexuals, 00:03:11.12\00:03:15.63 so that their rights are respected legally 00:03:15.66\00:03:20.49 are greater than religious freedom. 00:03:20.52\00:03:24.07 And so we have an imbalance in the legal system. 00:03:24.10\00:03:27.11 It's a neither or isn't it? 00:03:27.14\00:03:30.17 That since religious viewpoint 00:03:30.20\00:03:33.50 toward homosexuality holds moral stands on it, 00:03:33.53\00:03:36.91 therefore it must be removed 00:03:36.94\00:03:38.51 since it's at odds with this new found right. 00:03:38.54\00:03:41.01 Well, before... 00:03:41.04\00:03:42.93 So it's pitting one right against the other 00:03:42.96\00:03:44.00 which is not good. 00:03:44.03\00:03:45.21 There is a conflict but let me say at the outset, 00:03:45.24\00:03:47.71 I don't think there's a necessary conflict because.. 00:03:47.74\00:03:50.30 And that's what we need to discuss no need whatsoever. 00:03:50.33\00:03:52.35 In my view if you are going to respect the individual's right 00:03:52.38\00:03:57.47 before God to have their own values, 00:03:57.50\00:04:00.12 their own beliefs to worship God 00:04:00.15\00:04:02.32 according to the dictates of conscience, 00:04:02.35\00:04:04.13 then it means that the same right 00:04:04.16\00:04:06.78 that you extend to the Christian, 00:04:06.81\00:04:08.22 you extend to the gay to order their own lives peacefully 00:04:08.25\00:04:13.73 according to their own values, 00:04:13.76\00:04:15.75 a right, basic right of self determination. 00:04:15.78\00:04:18.31 Now you put a loaded word there, the Christian and the gay. 00:04:20.31\00:04:23.02 Well, it's not just the Christian, 00:04:23.05\00:04:25.73 I mean it's the Jews, it's the Muslims, 00:04:25.76\00:04:27.85 it's people with many faiths. 00:04:27.88\00:04:29.05 There are gays who take the name Christian, 00:04:29.08\00:04:31.59 obviously this are, taken at the plain 00:04:31.62\00:04:36.54 reading the Bible enjoins Christians 00:04:36.57\00:04:41.77 not to behave that way, 00:04:41.80\00:04:44.32 but I know that many gays would like to say, you know, 00:04:44.35\00:04:47.51 I'm a Christian, boy, you can't say I'm not a Christian 00:04:47.54\00:04:49.27 because so it isn't really gays versus Christian, 00:04:49.30\00:04:52.51 it's a Christian viewpoint or Christian community viewpoint 00:04:52.54\00:04:57.25 that should be protected as it normally 00:04:57.28\00:05:00.27 or in the past was by the first amendment. 00:05:00.30\00:05:02.54 Here's society and its civil sphere 00:05:02.57\00:05:05.52 has chose to give new rights 00:05:05.55\00:05:08.50 that historically were not available to a group 00:05:08.53\00:05:11.32 that even secular society saw as immoral 00:05:11.35\00:05:13.76 but that's been granted. 00:05:13.79\00:05:15.19 And just because that's been granted 00:05:15.22\00:05:17.20 should not be used to restrict the thoughts, 00:05:17.23\00:05:21.42 behavior and prerogative religious people 00:05:21.45\00:05:23.98 and neither should they try to... 00:05:24.01\00:05:26.86 But that's where the danger comes. 00:05:26.89\00:05:28.10 In California as in other parts of the country, 00:05:28.48\00:05:33.06 religious freedom has been sent 00:05:33.09\00:05:35.09 to the back of the civil rights bus and even though 00:05:35.12\00:05:39.13 religious freedom is a constitutional right, 00:05:39.16\00:05:41.79 free speech is a constitutional right, 00:05:41.82\00:05:44.37 our court has elevated gay rights as a stand 00:05:44.40\00:05:50.48 which is protected by statue is trumps, 00:05:50.51\00:05:56.20 these fundamental constitutional rights 00:05:56.23\00:05:59.12 and they said so explicitly in a case 00:05:59.15\00:06:02.32 where family planning doctors in a clinic declined 00:06:02.35\00:06:08.11 to provide in-vitro fertilization 00:06:08.14\00:06:11.47 for a lesbian woman 00:06:11.50\00:06:13.38 and the court said explicitly that the rights of gays 00:06:13.41\00:06:18.10 trump free speech and religious freedom. 00:06:18.13\00:06:20.94 And it's very ironic to me 00:06:20.97\00:06:22.42 because you've mentioned civil rights, 00:06:22.45\00:06:25.06 the civil rights movement didn't 00:06:25.09\00:06:27.14 just come from a Christian basis, 00:06:27.17\00:06:30.78 it arrived, it's very logic 00:06:30.81\00:06:33.03 from Christian imperatives, right? 00:06:33.06\00:06:37.87 And so to use that model and then tend it on religion, 00:06:37.90\00:06:41.60 to me it's not just dangerous, it's illogical. 00:06:41.63\00:06:46.27 And I think the point of illogic 00:06:46.30\00:06:49.02 is to call the movement for gay rights 00:06:49.05\00:06:52.20 as civil rights movement, it's not the same, 00:06:52.23\00:06:55.10 it's certainly legitimate, 00:06:55.13\00:06:56.32 I mean from the secular point of view, 00:06:56.35\00:06:58.30 if these are people protected by law, 00:06:58.33\00:07:00.37 you know we long ago 00:07:00.40\00:07:02.26 decriminalized homosexual behavior, 00:07:02.29\00:07:05.40 people tend to forget there's a two step here. 00:07:05.43\00:07:07.43 I think many Christians are really in fact trying to stop 00:07:07.46\00:07:13.45 and condemn and argue against gay behavior 00:07:13.48\00:07:16.39 but we're way over that, 00:07:16.42\00:07:18.77 the gay marriage thing is really just civil construct. 00:07:18.80\00:07:22.58 It's not really talking about morality anymore, 00:07:22.61\00:07:24.27 that's talking about things like inheritance, visitation 00:07:24.30\00:07:27.63 and you know with the staple register this arrangement, 00:07:27.66\00:07:32.01 but it's not moral in itself. 00:07:32.04\00:07:35.03 It's the human behavior there, 00:07:35.06\00:07:37.50 but I just do not like the fact 00:07:37.53\00:07:39.48 that African-Americans brought into slavery 00:07:39.51\00:07:43.46 in the United States during, you know, 00:07:43.49\00:07:46.88 whole period before the Civil War, 00:07:46.91\00:07:49.53 where they were chattel after the Civil War, 00:07:49.56\00:07:52.27 with Jim Crow and the lynching here and so on, 00:07:52.30\00:07:55.69 you know right up to the '60s when I came to the USA, 00:07:55.72\00:07:58.62 it was still, I've been down at south 00:07:58.65\00:08:00.23 where there were different water fountains and over it. 00:08:00.26\00:08:02.15 And it was purely because of the racial origins of someone, 00:08:02.18\00:08:06.72 they look different, they are different, 00:08:06.75\00:08:08.62 I mean I'm different from an African, from an Asian, 00:08:08.65\00:08:11.30 whatever this is a human state, 00:08:11.33\00:08:14.31 an inherit state, you can't change it. 00:08:14.34\00:08:16.46 Remember what does the Bible says 00:08:16.49\00:08:17.63 the leopard change its spots. 00:08:17.66\00:08:18.78 Well, and of course that... 00:08:18.81\00:08:20.54 So to equate that with behavior 00:08:20.57\00:08:22.94 and of course some in the gay and human behavior, 00:08:22.97\00:08:28.40 Rome tried to argue that it's inherent, 00:08:28.43\00:08:32.06 we don't even need to definitely define that. 00:08:32.09\00:08:34.38 The facts are its behavior, 00:08:34.41\00:08:35.72 that human beings have control over 00:08:35.75\00:08:38.51 and they've opted for that and we now respect it civilly 00:08:38.54\00:08:41.91 but to equate that with the Civil Rights movement, 00:08:41.94\00:08:44.39 I think it's wrong on many fronts. 00:08:44.42\00:08:46.66 So let's take a look at some examples 00:08:46.69\00:08:49.16 of how it is that gay rights have worked 00:08:49.19\00:08:53.48 to disadvantage religious freedom. 00:08:53.51\00:08:56.40 Our case in point, 00:08:56.43\00:08:57.96 I've been a lifelong member of the Christian Legal Society 00:08:57.99\00:09:02.18 which is a fellowship of Christian Lawyers. 00:09:02.21\00:09:04.65 I joined our Student Chapter 00:09:04.68\00:09:07.62 University of North Carolina Law School in the '80s, 00:09:07.65\00:09:10.84 when I was in law school. 00:09:10.87\00:09:12.62 CLS, Christian Legal Society 00:09:12.65\00:09:15.02 has a very broad statement to faith that does two things. 00:09:15.05\00:09:20.72 You affirm, your faith in Christ 00:09:20.75\00:09:22.72 as your savior and you pledge yourself 00:09:22.75\00:09:25.10 to biblical faithfulness and sexual relations. 00:09:25.13\00:09:29.16 Well, not surprisingly it was in San Francisco of all places 00:09:29.19\00:09:34.20 at the University of California Hastings Law School 00:09:34.23\00:09:37.82 that the Christian Legal Society was excluded 00:09:37.85\00:09:43.11 because of their statement of faith. 00:09:43.14\00:09:45.72 And the case went all the way to the Supreme Court 00:09:45.75\00:09:48.68 and the Supreme Court ruled in favor of the University 00:09:48.71\00:09:53.31 in a case that many of us really thought 00:09:53.34\00:09:56.04 was a no-brainer, because here for the first time, 00:09:56.07\00:10:00.82 a religious group is being told 00:10:00.85\00:10:04.41 that it cannot determine 00:10:04.44\00:10:10.93 who deserves to be a member 00:10:10.96\00:10:13.79 based on their religious beliefs and practices, 00:10:13.82\00:10:18.22 that they have to, 00:10:18.25\00:10:19.79 you know they can call themselves Christian, 00:10:19.82\00:10:22.03 but effectively they have to allow 00:10:22.06\00:10:25.43 anybody of any belief to join. 00:10:25.46\00:10:28.57 Now the school... 00:10:28.60\00:10:29.63 It's one of the worst decisions that ever came down. 00:10:29.66\00:10:31.10 The school had never applied this policy. 00:10:31.13\00:10:34.36 For example, there are Asian students groups, 00:10:34.39\00:10:38.09 black students groups, Latino student groups, 00:10:38.12\00:10:41.53 had they require these groups to open up their membership? 00:10:41.56\00:10:45.92 These are groups that effectively discriminated 00:10:45.95\00:10:49.07 on the basis of race, on national origin 00:10:49.10\00:10:52.48 and they were permitted to do so, 00:10:52.51\00:10:54.51 but the Christian group could not discriminate 00:10:54.54\00:10:57.15 on the basis of religion and I think the thing 00:10:57.18\00:11:00.07 that really set off the administration was 00:11:00.10\00:11:03.04 that they would effectively exclude practicing homosexuals 00:11:03.07\00:11:07.00 because of their sexuality. 00:11:07.03\00:11:10.20 And so we see here a very clear case 00:11:10.23\00:11:13.50 where religious freedom takes a backseat 00:11:13.53\00:11:15.81 to the right of gays to be free of discrimination. 00:11:15.84\00:11:20.91 And by the way, I'm a big believer 00:11:20.94\00:11:24.00 in the right of gays not to be discriminated against. 00:11:24.03\00:11:27.33 I don't think that Christians 00:11:27.36\00:11:28.73 should discriminate or anybody should discriminate 00:11:28.76\00:11:31.87 against gays, that's not right. 00:11:31.90\00:11:33.37 It's not just gays 00:11:33.40\00:11:34.84 and this is the one aspect of this discussion 00:11:34.87\00:11:37.22 that always makes me increasingly uncomfortable. 00:11:37.25\00:11:40.67 You know, there's the-- in of the world 00:11:40.70\00:11:42.65 in the flesh of the devil, 00:11:42.68\00:11:44.91 you know we call the holiness to godly living, 00:11:44.94\00:11:48.86 but out there anybody that doesn't 00:11:48.89\00:11:51.46 take the name of Christ or profess 00:11:51.49\00:11:53.25 the same moral construct as me, 00:11:53.28\00:11:55.18 they do many, many things all the way 00:11:55.21\00:11:58.10 from eating sometimes different food than me, 00:11:58.13\00:12:00.25 they operate differently on the moral thing, 00:12:00.28\00:12:02.76 their priorities are different. 00:12:02.79\00:12:06.43 Yes, homosexuality is a sort of lightning rod 00:12:06.46\00:12:09.39 for many of us not just on religion, 00:12:09.42\00:12:11.18 you know, it has a baggage but why we should focus on this? 00:12:11.21\00:12:16.29 I mean we're forced to now, 00:12:16.32\00:12:17.38 but we need to keep explaining to people 00:12:17.41\00:12:19.44 that it's not the only prohibition in the Bible, 00:12:19.47\00:12:24.04 it's not the only marker of someone 00:12:24.07\00:12:25.67 who hasn't come on to a biblical idea. 00:12:25.70\00:12:28.40 Well, you know, Lincoln, you were to reminding them. 00:12:28.43\00:12:31.83 I teach church audiences 00:12:31.86\00:12:33.66 that if you want to join our church, 00:12:33.69\00:12:35.53 you have to learn to sin like we do 00:12:35.56\00:12:37.80 because all churches, you know, 00:12:37.83\00:12:40.20 and our Seventh-day Adventist church among them, 00:12:40.23\00:12:42.54 you know, there are certain sins 00:12:42.57\00:12:44.52 we will exclude you because of those sins, 00:12:44.55\00:12:47.63 but then there's other sins 00:12:47.66\00:12:49.02 that run rampant within the church and... 00:12:49.05\00:12:51.49 And to be morally consistent 00:12:51.52\00:12:53.25 and to be morally consistent as a Christian is 00:12:53.28\00:12:56.01 what Jesus said to the woman found in adultery, 00:12:56.04\00:12:59.68 who was a fellow believer, 00:12:59.71\00:13:01.47 she was a Jew, she wasn't a Gentile. 00:13:01.50\00:13:03.41 But He says, I don't condemn you 00:13:03.44\00:13:05.07 but go and sin no more. 00:13:05.10\00:13:06.13 So the most we can say to someone is, 00:13:06.16\00:13:09.18 you know, this is not good behavior, 00:13:09.21\00:13:10.58 you shouldn't be doing it, 00:13:10.61\00:13:11.71 but if they have made a profession of Christ, 00:13:11.74\00:13:14.09 we have no right to even say that, we just, 00:13:14.12\00:13:16.57 our message should be to clarify what we believe 00:13:16.60\00:13:19.82 that we believe to follow God is 00:13:19.85\00:13:22.94 to follow certain moral norms, 00:13:22.97\00:13:24.45 but we can't condemn a non believer. 00:13:24.48\00:13:27.32 The tragedy of the culture wars is it 00:13:27.35\00:13:30.25 somehow Christianity has become exclusive 00:13:30.28\00:13:33.88 and hostile to homosexuals. 00:13:33.91\00:13:38.10 The fact is Christ died to save everyone. 00:13:38.13\00:13:41.64 And we're all sinners. 00:13:41.67\00:13:42.78 All have sinned and fallen short. 00:13:42.81\00:13:44.03 The gospel is inclusive and we have somehow made 00:13:44.06\00:13:48.41 the gospel made Christ the enemy of gays 00:13:48.44\00:13:51.04 and that's just wrong. 00:13:51.07\00:13:52.29 But I do believe, and we're running 00:13:52.32\00:13:53.70 out of time in the first thing, 00:13:53.73\00:13:55.03 but prior to what's going on here in United States 00:13:55.06\00:13:57.40 where there's the most opposition is this assumption 00:13:57.43\00:14:00.57 that this is a Christian republic 00:14:00.60\00:14:03.10 and even our civil society 00:14:03.13\00:14:04.70 is an extension of a Christian America, and it's not. 00:14:04.73\00:14:08.83 I wish it we're more societally, uniformly Bible believing. 00:14:08.86\00:14:14.57 That's another question but it's certainly not 00:14:14.60\00:14:16.70 governmentally or in a structure way 00:14:16.73\00:14:19.84 religious old Christian. 00:14:19.87\00:14:21.96 We'll be back after a short break
