Welcome back to the "Liberty Insider." 00:00:08.36\00:00:10.22 Before the break, our viewers will remember 00:00:10.25\00:00:12.93 that Allen Reinach and I were talking about 00:00:12.96\00:00:15.21 the Workplace Religious Freedom Act, 00:00:15.24\00:00:17.53 first on the federal level 00:00:17.56\00:00:18.92 which was well discussed, well supported 00:00:18.95\00:00:22.76 but ultimately pitted out 00:00:22.79\00:00:25.08 but now in California we have seen some light 00:00:25.11\00:00:28.44 in the tunnel, you had some great success. 00:00:28.47\00:00:30.25 So explain little bit of the background 00:00:30.28\00:00:33.50 on what specifically you are trying 00:00:33.53\00:00:35.38 to accomplish there in California 00:00:35.41\00:00:37.06 with the Workplace Religious Freedom initiative. 00:00:37.09\00:00:39.25 Well, first a little bit of the history 00:00:39.28\00:00:41.37 of how we got it-- how we got it done. 00:00:41.40\00:00:43.80 One of our assembly members had attended a rally 00:00:43.83\00:00:46.94 that was sponsored by the Muslim and Sikh communities 00:00:46.97\00:00:50.74 about the violence that they have suffered 00:00:50.77\00:00:53.87 in the wake of 9/11 and she-- 00:00:53.90\00:00:58.93 this assembly woman Mariko Yamada 00:00:58.96\00:01:02.05 was very sympathetic and asked 00:01:02.08\00:01:04.03 what she could do to help. 00:01:04.06\00:01:05.32 What could we do legally with passing laws 00:01:05.35\00:01:09.33 and the director of the Sikh Coalition said, really, 00:01:09.36\00:01:13.84 you know by law what we can do most effectively 00:01:13.87\00:01:17.76 is deal with the workplace discrimination issues. 00:01:17.79\00:01:21.08 Sikh's wear turbans and are often excluded. 00:01:21.11\00:01:24.86 There wear beards, they are excluded from law enforcement 00:01:24.89\00:01:27.99 and from many sectors of the economy 00:01:28.02\00:01:30.27 because of their religious expression and their appearance. 00:01:30.30\00:01:34.02 So they drafted a workplace religious freedom act. 00:01:34.05\00:01:37.39 We quickly jumped on board 00:01:37.42\00:01:39.23 and we are able to put together a large coalition 00:01:39.26\00:01:42.22 that included many faith groups 00:01:42.25\00:01:44.26 and also civil rights groups 00:01:44.29\00:01:45.80 because we work very closely 00:01:45.83\00:01:47.47 with various civil rights groups. 00:01:47.50\00:01:49.59 But you have stated the obvious 00:01:49.62\00:01:51.28 though that in the workplace there are certain religions 00:01:51.31\00:01:53.58 that have more particular 00:01:53.61\00:01:55.26 and regular needs for accommodation 00:01:55.29\00:01:57.11 because of the nature of their faith. True. 00:01:57.14\00:01:59.41 But it's not intended to be limited to any faith. 00:01:59.44\00:02:03.87 Well, we did that's true. 00:02:03.90\00:02:06.17 We did--there were three major things that the bill did. 00:02:06.20\00:02:09.18 Because I can remember another guest here, Bruce Cameron 00:02:09.21\00:02:12.02 presenting some accommodations 00:02:12.05\00:02:14.34 in fact I forgot what state, 00:02:14.37\00:02:16.09 in one state it was particularly stated in the statute 00:02:16.12\00:02:20.27 that this was to accommodate Seventh-day Adventist and that-- 00:02:20.30\00:02:24.91 Well, that was article 9 to section 9-- 00:02:24.94\00:02:26.63 We dimly regarded the other faiths. 00:02:26.66\00:02:28.76 Yeah, International Labor Relations Act. 00:02:28.79\00:02:31.01 Religious favoritisms consistent with the constitution 00:02:31.04\00:02:33.98 we want to write it's a plentiful. 00:02:34.01\00:02:35.43 Now, it has to-- look, religious liberty means 00:02:35.46\00:02:38.84 nothing unless it means liberty for everybody. 00:02:38.87\00:02:41.35 It's got--you know if you are not prepared 00:02:41.38\00:02:44.63 to respect the other guys beliefs than don't expect 00:02:44.66\00:02:48.38 any respect for your own. 00:02:48.41\00:02:50.31 Religious liberty is not freedom to believe the way I do. 00:02:50.34\00:02:54.14 Although, that's how too many Americans think of it. 00:02:54.17\00:02:56.58 And that's a good point that we need to reiterate. 00:02:56.61\00:03:00.45 Obviously, as Seventh-day Adventist we have-- 00:03:00.48\00:03:02.36 we come to the table with our own viewpoint 00:03:02.39\00:03:04.76 and we want to protect that viewpoint 00:03:04.79\00:03:06.64 but if you never see the bigger picture 00:03:06.67\00:03:09.13 eventually you are going to lose 00:03:09.16\00:03:11.45 and others will treat us the way we are looking at. 00:03:11.48\00:03:13.94 At the Church State Council I was taught 00:03:13.97\00:03:16.34 when I first came on board 00:03:16.37\00:03:18.15 that we will help people of any faith 00:03:18.18\00:03:20.04 who suffer religious discrimination 00:03:20.07\00:03:22.57 and that has been tested over the years 00:03:22.60\00:03:24.77 and when I say this to church members 00:03:24.80\00:03:28.40 they are all appreciative of the fact 00:03:28.43\00:03:30.95 that we represent Catholics, 00:03:30.98\00:03:32.70 we represent Mormons, Jews, Muslims, 00:03:32.73\00:03:35.70 we represent people of any faith 00:03:35.73\00:03:37.50 who suffer religious discrimination. 00:03:37.53\00:03:39.98 And we do so, you know, saying to them 00:03:40.01\00:03:42.63 you know we have our own deeply held religious convictions 00:03:42.66\00:03:46.08 and they are different from yours 00:03:46.11\00:03:47.73 but we do this because we respect 00:03:47.76\00:03:49.76 everyone's right to worship God 00:03:49.79\00:03:51.77 according to the dictates of conscience. 00:03:51.80\00:03:52.87 Now, I'm just sharing this for a reason, 00:03:52.90\00:03:53.96 when you first introduced this it was the Sikhs 00:03:53.99\00:03:56.50 who most people don't know very well. 00:03:56.53\00:03:57.99 That right. 00:03:58.02\00:03:59.05 The reason for their harassments 00:03:59.08\00:04:01.01 since 9/11 is very simple. 00:04:01.04\00:04:02.51 They are mistaken for Muslims. Correct. 00:04:02.54\00:04:04.68 And 9/11 woke up the great sleeping 00:04:04.71\00:04:07.95 American populous in particular 00:04:07.98\00:04:09.71 who knew nothing about Islam 00:04:09.74\00:04:11.60 but now they know that it's dangerous 00:04:11.63\00:04:13.30 "Now that it's dangerous." Sure. 00:04:13.33\00:04:15.13 But that's even if-- not if even 00:04:15.16\00:04:17.93 as there is a radical Islam that in its political form 00:04:17.96\00:04:21.99 is extremely dangerous 00:04:22.02\00:04:24.49 there are millions indeed billions of Muslim 00:04:24.52\00:04:28.44 who deserve to have their faith respected. 00:04:28.47\00:04:32.73 So we need to keep this view in mind 00:04:32.76\00:04:34.67 even in the war on terror, even as way you know, 00:04:34.70\00:04:37.71 we are dealing or observing radical Islam 00:04:37.74\00:04:40.85 on the rise in Egypt and so on. 00:04:40.88\00:04:43.51 People of any faith especially perhaps Islam 00:04:43.54\00:04:47.78 since this test the principle 00:04:47.81\00:04:49.59 we need to defend the right of these people to practice 00:04:49.62\00:04:54.25 peacefully their religious faith. 00:04:54.28\00:04:56.04 So what we did with the Workplace Religious Freedom Act 00:04:56.07\00:04:59.50 is three things. 00:04:59.53\00:05:00.89 Number one, put in explicit language 00:05:00.92\00:05:04.52 that religious expression 00:05:04.55\00:05:06.54 through dress and appearance is protected broadly. 00:05:06.57\00:05:10.14 So whether It's a Christian wearing a cross 00:05:10.17\00:05:12.91 or Jewish man wearing a Yarmulke, 00:05:12.94\00:05:15.22 a Sikh man wearing a beard or a turban whatever it is. 00:05:15.25\00:05:21.01 Muslim woman wearing a Hijab 00:05:21.04\00:05:23.18 that is protected in the workplace. 00:05:23.21\00:05:26.34 The second thing, which is revolutionary 00:05:26.37\00:05:29.73 never before anywhere voted is what Mariko Yamada, 00:05:29.76\00:05:34.74 testified was to Rosa Parks measure of the 21st century. 00:05:34.77\00:05:40.16 You can no longer segregate a worker 00:05:40.19\00:05:44.05 because of their religious appearance. 00:05:44.08\00:05:47.35 You can't Abercrombie and Fitch 00:05:47.38\00:05:49.24 can't take the Muslim woman 00:05:49.27\00:05:51.01 and put her in the stock room away 00:05:51.04\00:05:53.61 from the customers. 00:05:53.64\00:05:55.17 That's what they do. 00:05:55.20\00:05:56.40 You know, if you don't meet the corporate appearance code 00:05:56.43\00:05:59.55 then you're shunted away from the customers. 00:05:59.58\00:06:02.28 That's no longer illegal in California. 00:06:02.31\00:06:05.02 We are going to have a more diverse 00:06:05.05\00:06:07.90 appearing workplace, you are not going to see 00:06:07.93\00:06:11.91 corporate appearance codes 00:06:11.94\00:06:13.57 dominating over religious expression. 00:06:13.60\00:06:15.25 You know, that's something like the London Barbie 00:06:15.28\00:06:17.36 with the Sikh turban and the beard around. 00:06:17.39\00:06:20.02 Well, they are allowed in London 00:06:20.05\00:06:21.87 but why not--and in and in some cities-- 00:06:21.90\00:06:23.86 That's why I threw that in. In some cities-- 00:06:23.89\00:06:26.10 We do see that in England. Yeah, you do see. 00:06:26.13\00:06:28.84 There are places in law enforcement 00:06:28.87\00:06:31.02 where Sikhs are allowed but most places they are not. 00:06:31.05\00:06:34.01 The final thing which is of key for us as Sabbath observers, 00:06:34.04\00:06:37.60 as Seventh-day Adventists is to define the requirement 00:06:37.63\00:06:42.14 to provide religious accommodation 00:06:42.17\00:06:43.94 short of an undo hardship 00:06:43.97\00:06:45.82 in terms of a significant difficulty or expanse. 00:06:45.85\00:06:49.61 The burden on the employer 00:06:49.64\00:06:51.41 they have to show that really 00:06:51.44\00:06:53.67 we can't accommodate you 00:06:53.70\00:06:55.21 without having a serious negative impact on our business. 00:06:55.24\00:06:58.77 Well, isn't--wasn't our intend in promoting this 00:06:58.80\00:07:02.59 legislation federally, initially 00:07:02.62\00:07:04.19 and now you are carrying it on 00:07:04.22\00:07:05.88 to change the burden of proof because on this-- 00:07:05.91\00:07:08.97 Right. If you put the show in a overwhelming way 00:07:09.00\00:07:12.71 why you should have the accommodation 00:07:12.74\00:07:14.24 and the employer was let off the hook with the de minimis. 00:07:14.27\00:07:16.52 If you are to get the accommodation unless 00:07:16.55\00:07:18.62 he can show that is a burden beyond the de minimis 00:07:18.65\00:07:22.24 then you are on a safer ground. 00:07:22.27\00:07:23.53 Right, so it's not a burden of proof as such 00:07:23.56\00:07:27.49 but it is the burden is-- right the burden 00:07:27.52\00:07:30.55 is on the employer to show that really if we accommodate you 00:07:30.58\00:07:35.54 It's not gonna work for our business to do that. 00:07:35.57\00:07:38.83 And it's very rare that an employer 00:07:38.86\00:07:42.14 really cannot accommodate. 00:07:42.17\00:07:44.14 Now there was a case involving a large national company 00:07:44.17\00:07:49.42 that operates very small operations 00:07:49.45\00:07:52.54 with only half a dozen people 00:07:52.57\00:07:54.47 and they needed everybody on Saturday 00:07:54.50\00:07:56.63 and they won recently because the court said that 00:07:56.66\00:08:00.86 you know, there just weren't enough people 00:08:00.89\00:08:02.72 if you only have six employees 00:08:02.75\00:08:04.71 to regularly let the Seventh-day Adventists on work. 00:08:04.74\00:08:07.35 Yes, easily the smaller employer 00:08:07.38\00:08:08.69 with a very practical consideration 00:08:08.72\00:08:10.99 at work from the employer not the bigger ones. 00:08:11.02\00:08:13.74 Well, in most places companies know how to get the work done. 00:08:13.77\00:08:20.01 We have a case that's pending as we speak 00:08:20.04\00:08:23.68 involving a part time postal clerk 00:08:23.71\00:08:27.01 and you know, what part of the testimony 00:08:27.04\00:08:30.69 we had management talking about how, 00:08:30.72\00:08:33.91 you know, the old saying about rain, 00:08:33.94\00:08:36.02 sleet, snow whatever. 00:08:36.05\00:08:37.57 You guys, you know, you guys know 00:08:37.60\00:08:39.48 how to get the mail delivered. 00:08:39.51\00:08:40.86 Don't you, no matter what. 00:08:40.89\00:08:42.03 No matter who calls in sick, no matter, 00:08:42.06\00:08:44.02 you know who is gone, 00:08:44.05\00:08:45.42 you know how to get the job done. 00:08:45.45\00:08:47.33 So why do you think that it was such a problem 00:08:47.36\00:08:50.38 when our guy missed four Saturdays out of the year. 00:08:50.41\00:08:54.23 You know, why did he have to get fired 00:08:54.26\00:08:55.93 for missing four Saturdays. 00:08:55.96\00:08:57.99 Is their saying still true or they disavowing that? 00:08:58.02\00:09:00.92 No, they didn't disavow it you know they are proud 00:09:00.95\00:09:04.07 of their ability to get the mail delivered. 00:09:04.10\00:09:06.36 Yeah. But they think they have the right to, 00:09:06.39\00:09:09.68 you know, tell somebody you have to work on Saturdays 00:09:09.71\00:09:12.25 and if you are not going to work on Saturdays we can fire you. 00:09:12.28\00:09:15.36 Of course, in law, you know, 00:09:15.39\00:09:18.97 there is a position and then people 00:09:19.00\00:09:20.69 come to defend that they may not always 00:09:20.72\00:09:22.64 personally believe in the full logic of it 00:09:22.67\00:09:25.50 but that's this--that's their stance isn't it so that-- 00:09:25.53\00:09:28.22 I know you hear some-- It's a matter of policies. 00:09:28.25\00:09:30.30 Over the stated stuff. Well, no. 00:09:30.33\00:09:32.88 What I mean on the-- you exposed it there 00:09:32.91\00:09:35.76 on the simplest level that the post offices 00:09:35.79\00:09:38.27 they can do organization. 00:09:38.30\00:09:40.50 The problem with these companies is this military attitude 00:09:40.53\00:09:45.18 we make the rules and you have to comply with them. 00:09:45.21\00:09:48.55 Yeah, well, the rules are made first amendment, right. 00:09:48.58\00:09:51.83 We need to go back to that 00:09:51.86\00:09:53.57 and the founding principles of the United States 00:09:53.60\00:09:55.89 religious freedom is not just 00:09:55.92\00:09:58.34 a bonus on top of civil liberties. 00:09:58.37\00:10:01.74 It's so integral, you know, 00:10:01.77\00:10:03.92 on one of other programs we discussed it, 00:10:03.95\00:10:05.73 the protestant reformation and so on. 00:10:05.76\00:10:07.90 Well, but where religious liberty really meets, 00:10:07.93\00:10:11.73 you know, the rubber meets the road is in the workplace. 00:10:11.76\00:10:14.36 There's so many issues that we can talk about 00:10:14.39\00:10:16.86 and people are concerned about but every business day 00:10:16.89\00:10:20.83 there are Americans, several Americans 00:10:20.86\00:10:23.00 losing their jobs for no other crime than their faith. 00:10:23.03\00:10:26.09 Now in California we have made a dent in it 00:10:26.12\00:10:28.61 by passing the Workplace Religious Freedom Act 00:10:28.64\00:10:31.35 and we hope that other states 00:10:31.38\00:10:32.78 will take the lead from our example and do likewise. 00:10:32.81\00:10:37.66 It's rather sobering to realize 00:10:40.82\00:10:42.56 that in the Untied States as in other countries 00:10:42.59\00:10:45.34 ruled by law, the constitution stands 00:10:45.37\00:10:48.49 as a guideline and a guarantee perhaps of freedoms 00:10:48.52\00:10:52.37 but in reality day by day 00:10:52.40\00:10:54.26 those freedoms are worked out through precedent, 00:10:54.29\00:10:56.74 through application and can be challenged 00:10:56.77\00:11:00.17 and can be diluted by events. 00:11:00.20\00:11:04.62 In the Untied States much of our efforts 00:11:04.65\00:11:06.79 for religious freedom concern 00:11:06.82\00:11:08.25 protecting people in the workplace. 00:11:08.28\00:11:11.33 And as Revelation says regarding an attack 00:11:11.36\00:11:14.83 on those of faith, it may come to time 00:11:14.86\00:11:17.03 when they cannot buy nor sell. 00:11:17.06\00:11:19.70 In reality if you lose your job you can't easily buy or sell. 00:11:19.73\00:11:24.38 You may have to sell your goods to survive 00:11:24.41\00:11:26.16 for a little while but it's very important 00:11:26.19\00:11:28.29 to have a livelihood. 00:11:28.32\00:11:29.76 The Workplace Religious Freedom Act 00:11:29.79\00:11:32.13 has been an initiative on the federal level 00:11:32.16\00:11:35.21 and now worked out on the state level 00:11:35.24\00:11:37.38 to show up a deteriorating 00:11:37.41\00:11:40.12 free exercise situation in the workplace. 00:11:40.15\00:11:42.78 And I would like to encourage our viewers 00:11:42.81\00:11:44.54 to keep this in mind, keep it in your prayers 00:11:44.57\00:11:47.15 and realize that the laws are only good and protect you 00:11:47.18\00:11:51.93 as they are applied diligently and with prayer 00:11:51.96\00:11:55.81 and applied on the behalf of the faithful. 00:11:55.84\00:11:59.35 For Liberty Insider, this is Lincoln Steed. 00:11:59.38\00:12:02.35
