Welcome back to "The Liberty Insider", 00:00:06.08\00:00:08.22 with my guest Todd McFarland, lawyer-- 00:00:08.25\00:00:12.72 Yeah, Still. 00:00:12.75\00:00:14.12 And associate on Liberty Magazine. 00:00:14.15\00:00:17.63 We worked very closely together 00:00:17.66\00:00:19.03 and so we know each others weaknesses. Yeah. 00:00:19.06\00:00:20.87 This is getting in the way here of talking about things. 00:00:20.90\00:00:23.43 But we're talking about a very serious topic. Right. 00:00:23.46\00:00:26.80 Pastor Monteiro, 00:00:26.83\00:00:28.73 the Seventh-day Adventist Minister 00:00:28.76\00:00:30.13 imprisoned for a year now on a strange charge, 00:00:30.16\00:00:34.06 which we you know we're quite confident 00:00:34.09\00:00:35.54 it will turn out it's not at all what it's seems. 00:00:35.57\00:00:39.01 But along the way his faith is being tested personally 00:00:39.04\00:00:41.73 and the church is being molined. 00:00:41.76\00:00:44.92 I know it was before your tenure 00:00:44.95\00:00:47.75 as general council at the general conference. 00:00:47.78\00:00:50.76 But there was a similar case in some ways, 00:00:50.79\00:00:53.25 a pastor Anthony Alexander, 00:00:53.28\00:00:55.51 you remember hearing about that? Right. 00:00:55.54\00:00:56.91 I'm sure you well aware of it. 00:00:56.94\00:00:59.06 But your predecessor Mitch Tyner also flew a quite a few miles. 00:00:59.09\00:01:04.79 He probably got his one case status just-- 00:01:04.82\00:01:08.77 And you're going to Sri Lanka you know. 00:01:08.80\00:01:10.17 Yeah, going Sri Lanka which at that time 00:01:10.20\00:01:12.58 was involved in a bitter civil war, 00:01:12.61\00:01:16.14 very much divided the whole country 00:01:16.17\00:01:17.78 and it only ended in 2009 00:01:17.81\00:01:19.50 with the total extermination of the Tamil Tiger gorillas. 00:01:19.53\00:01:23.68 But in the middle of all of this a Seventh-day Adventist pastor, 00:01:23.71\00:01:26.69 teacher at the school was accused of being 00:01:26.72\00:01:29.41 at the terrorist sympathizer. 00:01:29.44\00:01:30.83 This was before 9/11 and put in jail for two years 00:01:30.86\00:01:34.76 on trial for his life under terrorism charges. 00:01:34.79\00:01:37.76 And here again, you know, this Pastor Monteiro case 00:01:37.79\00:01:41.25 is not to be trivialize but terrorism, 00:01:41.28\00:01:43.98 you know, capital offense this was a huge issue 00:01:44.01\00:01:48.85 and what really impressed me 00:01:48.88\00:01:51.14 was something about his imprisonment 00:01:51.17\00:01:53.58 and I tried to extrapolate this across to Monteiro. 00:01:53.61\00:01:57.33 Pastor Alexander at no point by out figuring 00:01:57.36\00:02:01.40 was going to get out. Do you remember that? 00:02:01.43\00:02:03.25 Do you remember any of the discussion 00:02:03.28\00:02:05.44 what we didn't have any legal magic bullet to get him out-- 00:02:05.47\00:02:09.40 No I think that was it was probably 00:02:09.43\00:02:11.14 trying to put political pressure on. 00:02:11.17\00:02:12.81 And really the same in Togo even knowing the law 00:02:12.84\00:02:16.37 what--it's very hard, you know, in another country 00:02:16.40\00:02:18.17 this sort off-- 00:02:18.20\00:02:19.57 Well, the thing about Togo is when we have lawyers, 00:02:19.60\00:02:22.94 the thing is this is in the international rights 00:02:22.97\00:02:25.07 Dakin--and so forth. 00:02:25.10\00:02:26.47 They don't have a independent judiciary. 00:02:26.50\00:02:28.70 You know, we talk about, you know, brings us back to, 00:02:28.73\00:02:31.04 you know, religious liberty issues 00:02:31.07\00:02:33.01 and especially even in the United States. 00:02:33.04\00:02:34.95 You know often times, you know, we talk about, 00:02:34.98\00:02:36.93 you know, political process. 00:02:36.96\00:02:38.33 Unlike the judges making decisions 00:02:38.36\00:02:39.79 and obsess people and they make decision 00:02:39.82\00:02:41.23 that they don't like. 00:02:41.26\00:02:42.63 What they forget is, 00:02:42.66\00:02:44.03 you know, that's a consequence of having a judiciary 00:02:44.06\00:02:45.61 that's independent, you know. 00:02:45.64\00:02:48.54 I mean, if President Obama calls up a judge 00:02:48.57\00:02:51.46 he cannot call up a district court judge 00:02:51.49\00:02:53.43 and tell him to, you know, to release someone 00:02:53.46\00:02:55.27 or interfere and he could pardon so forth 00:02:55.30\00:02:56.88 but--I mean we really have an independent judiciary 00:02:56.91\00:02:59.75 and that is so important in Togo. 00:02:59.78\00:03:02.77 It is really up to the judges there 00:03:02.80\00:03:04.42 it's up to the executive branch and what they want to do 00:03:04.45\00:03:07.58 and, you know, that is the problem 00:03:07.61\00:03:09.73 with having a weak judiciaries. 00:03:09.76\00:03:12.53 Since we've headed back on to that 00:03:12.56\00:03:15.74 and it's good to discuss. 00:03:15.77\00:03:18.78 I think apart of the issue there 00:03:18.81\00:03:20.67 and I've been seen your comment 00:03:20.70\00:03:22.36 I think Togo is under-- was French Colonial influence. 00:03:22.39\00:03:25.27 Yes, yes French Colonial influence. 00:03:25.30\00:03:26.67 And the French legal system is more you're guilty 00:03:26.70\00:03:30.75 until you can prove yourself innocent. 00:03:30.78\00:03:32.84 A presumed guilty on the charge 00:03:32.87\00:03:35.29 until you can prove your innocence 00:03:35.32\00:03:36.96 where we're innocence until proven guilty. 00:03:36.99\00:03:39.07 It's the difference between the British 00:03:39.10\00:03:40.47 and the French system. 00:03:40.50\00:03:41.87 Theirs is not a presumption in the--Togo legal system 00:03:41.90\00:03:44.33 though interestingly when speaking with Togo 00:03:44.36\00:03:46.94 legal officials down there 00:03:46.97\00:03:49.27 they all sort of made their way of corsis-- 00:03:49.30\00:03:50.92 innocently proven guilty 00:03:50.95\00:03:52.32 and they said which I thought was interesting 00:03:52.35\00:03:54.04 given that's not the legal presumptions. 00:03:54.07\00:03:55.53 So but it's again it's not about illegal presumptions 00:03:55.56\00:03:59.59 it's not about the process 00:03:59.62\00:04:01.01 it's not about the falling the way emotions, 00:04:01.04\00:04:02.91 it was up to that he would been released a long time ago. 00:04:02.94\00:04:05.47 It is unfortunately, you know, turns into a political process. 00:04:05.50\00:04:09.30 You know it's a very small country ran by for-- 00:04:09.33\00:04:12.15 you know, after independence by a dictator for long time. 00:04:12.18\00:04:16.38 It is now non-democratic and had open elections 00:04:16.41\00:04:20.40 that--non-opened this is up this is up for debate 00:04:20.43\00:04:22.71 the opposition doesn't think they're too open but, 00:04:22.74\00:04:24.86 you know, then Secretary of State 00:04:24.89\00:04:26.67 Hillary Clinton visited that sort of encourages 00:04:26.70\00:04:28.40 democratic aspirations and so, you know, 00:04:28.43\00:04:31.38 but they are early in that process. 00:04:31.41\00:04:33.69 It's a reminder that United States and some other-- 00:04:33.72\00:04:37.06 mostly western countries have admirable legal systems 00:04:37.09\00:04:40.31 to defend your religious purgatives. 00:04:40.34\00:04:43.71 That's not the case in many, many countries 00:04:43.74\00:04:46.09 and so defending religious freedom 00:04:46.12\00:04:49.86 ultimately is a matter--I love this term hearts in minds. 00:04:49.89\00:04:54.45 It's a matter of working with him in the community, 00:04:54.48\00:04:56.78 working against the prejudice and of course for lot of faith. 00:04:56.81\00:05:00.88 What I want to bring out on Pastor Alexander though 00:05:00.91\00:05:02.96 and I don't know what's happening 00:05:02.99\00:05:04.84 in the prison with Monteiro 00:05:04.87\00:05:06.72 but we know as you explained that situation. 00:05:06.75\00:05:10.04 Pastor Alexander was providentially was released 00:05:10.07\00:05:13.43 after two years. 00:05:13.46\00:05:14.83 There's was no legal magic bullet we knew off 00:05:14.86\00:05:16.37 but without warning 00:05:16.40\00:05:18.26 he was suddenly released pending retrial 00:05:18.29\00:05:20.73 but he was physically released 00:05:20.76\00:05:22.24 he was speeded out of the country's in Canada now. 00:05:22.27\00:05:25.06 I spoke to him and asked him about the whole situation 00:05:25.09\00:05:28.81 and amazingly he told me that he believed that 00:05:28.84\00:05:31.70 it was Gods will that he be imprisoned. Right. 00:05:31.73\00:05:33.92 That's what blew me away. 00:05:33.95\00:05:35.73 Even as he told me a great lengths 00:05:35.76\00:05:37.86 about being tortured, tie his ankles together, 00:05:37.89\00:05:42.31 hang him upside down, beat on his feet, 00:05:42.34\00:05:45.17 hit on his head with a book to stop the marks 00:05:45.20\00:05:47.77 but it causes brain damage real things. 00:05:47.80\00:05:51.47 And yet he said it was Gods will 00:05:51.50\00:05:54.18 that's a part of the whole religious liberty dynamic 00:05:54.21\00:05:57.37 we're not used to in the western world. 00:05:57.40\00:05:59.08 Yeah, you know, and I met Pastor Alexander 00:05:59.11\00:06:01.93 and that's his view of-- 00:06:01.96\00:06:03.33 you know I mean for him that maybe. And then if I-- 00:06:03.36\00:06:05.81 Oh, I'm not saying it was not just severely God's will. 00:06:05.84\00:06:08.09 Right, yeah, and I think you know, 00:06:08.12\00:06:09.49 I think Pastor Monteiro is the one 00:06:09.52\00:06:10.89 with good voice in prison. 00:06:10.92\00:06:12.29 I mean you got to understand the meaning-- 00:06:12.32\00:06:13.69 you know when I was in Togo 00:06:13.72\00:06:15.10 I actually preached in Pastor Monteiro church 00:06:15.13\00:06:17.28 the one he attends there. 00:06:17.31\00:06:18.68 Is that was on the pulpit, on the platform 00:06:18.71\00:06:20.78 it turned out that there was kid maybe 19 00:06:20.81\00:06:22.87 or 11-years-old sitting next to me doing scripture reading. 00:06:22.90\00:06:25.39 It was Pastor Monteiro's son 00:06:25.42\00:06:27.37 and he has all older children two 00:06:27.40\00:06:28.97 and a wife and you know his son 00:06:29.00\00:06:31.87 his wife his older kids need him. 00:06:31.90\00:06:34.34 Absolutely, there's no tragedy-- 00:06:34.37\00:06:36.65 And, you know, and that is and he has job as a father 00:06:36.68\00:06:39.26 and as a husband and needs to be home. 00:06:39.29\00:06:41.73 You know even if he's doing there good there in prison 00:06:41.76\00:06:43.66 and you know people say God's will always done 00:06:43.69\00:06:47.55 and I don't know that I mean I think God makes the best 00:06:47.58\00:06:49.87 out of situation but God's will in this-- 00:06:49.90\00:06:52.03 Gods purposes, it's not Gods will-- 00:06:52.06\00:06:53.43 Yes, right, right. 00:06:53.46\00:06:54.83 His purpose is to witness and to change any situation 00:06:54.86\00:06:58.26 and we can do that with this-- 00:06:58.29\00:06:59.66 And you know it's God's will is rarely done. 00:06:59.69\00:07:01.90 I don't think God's will the people die 00:07:01.93\00:07:03.65 it's not God's will that sin happen, 00:07:03.68\00:07:05.48 it's not God's will that people be torched. 00:07:05.51\00:07:07.31 None of that's God's will deceased, 00:07:07.34\00:07:09.23 illness none of that's His will. 00:07:09.26\00:07:11.27 But it doesn't mean, you know, all things were together 00:07:11.30\00:07:13.08 for those who serving him 00:07:13.11\00:07:14.48 and ultimately I think this will be something 00:07:14.51\00:07:16.84 that reinforces pastor Monteiro's faith 00:07:16.87\00:07:19.87 and works for it good but it doesn't mean 00:07:19.90\00:07:21.80 it was God's will and this was a good thing that happened. 00:07:21.83\00:07:23.89 So well, I want to go to two directions from what you said 00:07:23.92\00:07:28.15 as far as Pastor Alexander he was imprisoned 00:07:28.18\00:07:32.04 and the reason he felt that that was God's will 00:07:32.07\00:07:34.38 that he be imprisoned not that all of that happen. Right. 00:07:34.41\00:07:36.71 Now God doesn't wish ill on any of us. 00:07:36.74\00:07:39.99 But given that the charge was made in prison 00:07:40.02\00:07:42.69 he was able to draw together by witness 00:07:42.72\00:07:46.11 they were the Muslims, Hindus, Buddhists 00:07:46.14\00:07:48.52 and so on a few lapse--Christians. 00:07:48.55\00:07:50.98 He was able to form a church group of 60 men 00:07:51.01\00:07:54.72 meeting every Sabbath and he was the pastor of that group. 00:07:54.75\00:07:58.76 And when time came for his release 00:07:58.79\00:08:00.65 he didn't initially want to be released, 00:08:00.68\00:08:02.87 because he was afraid that he left in there 00:08:02.90\00:08:04.83 and then he says amazingly another pastor was imprisoned 00:08:04.86\00:08:08.50 right at the moment he was released, 00:08:08.53\00:08:09.90 so he could continue it. 00:08:09.93\00:08:11.96 No, I don't think it's God's will to cause problem 00:08:11.99\00:08:14.78 but even though we're in a, you know, world 00:08:14.81\00:08:18.47 with a horrible situations 00:08:18.50\00:08:19.87 and we trust into these challenges all the time. 00:08:19.90\00:08:22.22 God will work it to good. 00:08:22.25\00:08:23.82 But-- No it is, in fact you know going back 00:08:23.85\00:08:27.38 you know this as we talked about an earlier show 00:08:27.41\00:08:29.03 about Ben Allison of liberty campaign 00:08:29.06\00:08:30.78 and if you watch this year's liberty campaign 00:08:30.81\00:08:32.24 that you have been talked about this to me, 00:08:32.27\00:08:33.65 he said you know I'm going to-- 00:08:33.68\00:08:35.29 you know if I get thrown in prison 00:08:35.32\00:08:36.69 I'm going to witness the people in the prison 00:08:36.72\00:08:38.09 who otherwise wouldn't hear what I heard I had the-- 00:08:38.12\00:08:39.65 And that's the historic what I have-- 00:08:39.68\00:08:41.41 that we run again of time but the thing 00:08:41.44\00:08:43.77 I want to remind of you as all 00:08:43.80\00:08:45.71 because I think I've mentioned it long time ago. 00:08:45.74\00:08:48.95 James Standen who used to work 00:08:48.98\00:08:50.61 as the legislative flays-- on the General Conference. 00:08:50.64\00:08:54.55 He went to India at one point of the province where 00:08:54.58\00:08:58.54 the untouchables were being prosecuted for many of them 00:08:58.57\00:09:01.55 becoming Christians and a Seventh-day Adventist pastor 00:09:01.58\00:09:04.35 was hunted down and by a mob. 00:09:04.38\00:09:06.81 This man killed, dismembered, his church burned 00:09:06.84\00:09:10.79 and James went to the church on the Sabbath, 00:09:10.82\00:09:13.23 the way it was smoldering ruins 00:09:13.26\00:09:15.05 but under a tree near by the people who worshiping 00:09:15.08\00:09:17.69 and the 12-year-old son of the pastor was there 00:09:17.72\00:09:20.85 and the widow. 00:09:20.88\00:09:22.33 Of course they were horribly distorted 00:09:22.36\00:09:24.65 at the loss of their father. 00:09:24.68\00:09:26.05 But the young boy told James, 00:09:26.08\00:09:27.98 he said that he wanted to be a pastor like his father. 00:09:28.01\00:09:30.86 And you know that's sort of thing 00:09:30.89\00:09:32.26 and I'm sure it's affecting due to see Monteiro's son 00:09:32.29\00:09:35.41 you know that's adverbial to in a family to see a parent 00:09:35.44\00:09:42.29 yes sacrificing for their faith 00:09:42.32\00:09:44.06 but being faithful in that situation. 00:09:44.09\00:09:45.90 Then again young person can be inspired to say 00:09:45.93\00:09:48.79 I want to be like my dad. 00:09:48.82\00:09:50.19 That's wonderful. Yeah it is. 00:09:50.22\00:09:51.59 I mean it you know I guess you think God 00:09:51.62\00:09:53.70 and making the best out of you know the situation 00:09:53.73\00:09:57.15 and that is you know but I don't think 00:09:57.18\00:09:59.34 it's God's will at the pastor died. 00:09:59.37\00:10:00.83 No I'm glad you're saying that I would never say that, 00:10:00.86\00:10:02.71 we should never think that. 00:10:02.74\00:10:04.18 God where as in the Bible says, 00:10:04.21\00:10:06.75 you know, Gods wishes to us a good that's all that God have, 00:10:06.78\00:10:10.14 I know my thought's showed you there you were a good-- 00:10:10.17\00:10:11.75 Right, you know, yeah by-- 00:10:11.78\00:10:13.75 Absolutely. If you-- 00:10:13.78\00:10:16.21 No we have to believe that God doesn't bring evil upon anybody, 00:10:16.24\00:10:19.62 even the evil. 00:10:19.65\00:10:21.36 Evil comes upon by their actions. Right. 00:10:21.39\00:10:24.67 But within the dynamic often a very bad situation 00:10:24.70\00:10:28.22 I believe God can use it powerfully 00:10:28.25\00:10:31.26 and so religious liberty is not always 00:10:31.29\00:10:33.00 getting out of the problem. 00:10:33.03\00:10:34.40 This is what I'm trying to make the application 00:10:34.43\00:10:36.34 Some one has the Sabbath accommodation issue 00:10:36.37\00:10:38.87 we would like to resolve it quickly. 00:10:38.90\00:10:40.33 But sometimes, when it gets more complicated 00:10:40.36\00:10:42.35 it's actually a better witness. All right it is. 00:10:42.38\00:10:44.66 You know and that's the difficult thing 00:10:44.69\00:10:46.06 that people have to understand is that, 00:10:46.09\00:10:47.66 you know, God promises to be with us 00:10:47.69\00:10:49.98 and take care of us but it doesn't mean 00:10:50.01\00:10:51.78 things are going to work out the way that we want. 00:10:51.81\00:10:54.40 God's promise is to support us. 00:10:54.43\00:10:56.78 It is not the things and we'll have an easy life. 00:10:56.81\00:10:59.70 Our reward is in heaven not on this earth. 00:10:59.73\00:11:01.55 And in defending people in religious liberty 00:11:01.58\00:11:03.23 that's an important thing to remind people 00:11:03.26\00:11:06.24 is God will be with you and He'll sustain you. 00:11:06.27\00:11:09.30 But that doesn't mean there aren't going be difficult times 00:11:09.33\00:11:11.87 and it doesn't mean you won't have to rely 00:11:11.90\00:11:13.54 upon His saving grace and His ability support us. 00:11:13.57\00:11:16.86 And as we have been talking about religious liberty 00:11:16.89\00:11:18.58 I think that's important to remember. 00:11:18.61\00:11:20.74 It was the Apostle Paul that made a statement 00:11:23.22\00:11:25.94 to the effect that whatever situation 00:11:25.97\00:11:28.30 I find myself in, I'm determined to be content. 00:11:28.33\00:11:32.42 Well, as I read this story of Paul 00:11:32.45\00:11:33.98 and his missionary journeys he was stoned, 00:11:34.01\00:11:36.50 he was imprisoned, he was harassed, 00:11:36.53\00:11:39.30 hounded out of town after town and yet he was content. 00:11:39.33\00:11:44.10 In this program we've discussed couple of specific cases 00:11:44.13\00:11:47.96 of Seventh-day Adventist in a prison 00:11:47.99\00:11:50.24 if not directly for their faith 00:11:50.27\00:11:52.42 but essentially in prisons an extended time 00:11:52.45\00:11:55.88 because of their faith. 00:11:55.91\00:11:57.47 It's worth remembering 00:11:57.50\00:11:59.00 that we have promised many things from God 00:11:59.03\00:12:01.57 and one of them is especifically 00:12:01.60\00:12:04.47 all who lived a Godly life, will suffer prosecution. 00:12:04.50\00:12:09.21 We can't solve that and what we can do though 00:12:09.24\00:12:12.20 as individuals is when we find ourselves in these situations 00:12:12.23\00:12:15.82 of course we can expect our fellow members, 00:12:15.85\00:12:18.96 our legal council if you like will help us as best they can. 00:12:18.99\00:12:23.01 But in that situation we must be determined to give things 00:12:23.04\00:12:27.52 because as we're seeing with Pastor Alexander 00:12:27.55\00:12:30.15 and perhaps seen with Pastor Monteiro. 00:12:30.18\00:12:33.10 God can work powerfully through even these desperate situations 00:12:33.13\00:12:38.17 to bring good out of it. 00:12:38.20\00:12:41.03 For Liberty Insider this is Lincoln Steed. 00:12:41.06\00:12:45.64
