Trust me. 00:01:14.90\00:01:16.74 Well, I know you get a lot of that too. 00:01:16.75\00:01:19.02 But anyhow on religious liberty 00:01:19.03\00:01:23.04 you still remember some of it but I know 00:01:23.05\00:01:25.12 one thing you know very well because 00:01:25.13\00:01:26.45 your recently did an article for liberty magazine 00:01:26.46\00:01:29.26 that I think you told me was fun writing 00:01:29.27\00:01:32.25 because its one of the more bizarre story 00:01:32.26\00:01:33.96 I've seen in years. 00:01:33.97\00:01:35.14 Well I think I titled it, what I called, 00:01:35.15\00:01:37.52 "Zombie Muhammad and the parading atheists 00:01:37.53\00:01:40.47 of Mechanicsville, Pennsylvania." 00:01:40.48\00:01:43.34 And newspaper articles had much the same 00:01:43.35\00:01:45.66 sort of approach, didn't they? 00:01:45.67\00:01:47.73 Well, what it was, was they were having 00:01:47.74\00:01:49.17 a Halloween parade-- 00:01:49.18\00:01:51.04 And this was just only few months ago. 00:01:51.05\00:01:52.41 Yeah, last October, having a Halloween parade 00:01:52.42\00:01:55.61 and some group calling themselves 00:01:55.62\00:01:58.10 the parading atheists of Mechanicsville, Pennsylvania, 00:01:58.11\00:02:03.70 decided--one of them dressed up as a zombie pope 00:02:03.71\00:02:06.75 and the other one dressed up as zombieMuhammad. 00:02:06.76\00:02:10.03 You got to wonder what somebody is thinking 00:02:10.04\00:02:11.46 in this day and age to do that. 00:02:11.47\00:02:12.99 But anyway they go down, they're parading down 00:02:13.00\00:02:15.03 the street and I think they purposely, 00:02:15.04\00:02:21.32 some of these extreme atheist-- 00:02:21.33\00:02:23.27 They wanted to be insulting. 00:02:23.28\00:02:24.27 They wanted to be insulting. 00:02:24.28\00:02:25.72 You know a zombie pope, a zombie Muhammad, 00:02:25.73\00:02:28.38 how did they--they purposely, but this is America-- 00:02:28.39\00:02:32.46 First amendment, right? 00:02:32.47\00:02:33.46 This is America and if you want 00:02:33.47\00:02:35.31 there's nothing in the constitution that protects 00:02:35.32\00:02:38.80 people from being offended. 00:02:38.81\00:02:39.99 You know the whole free speech clause 00:02:40.00\00:02:42.08 doesn't mean anything if you can't offend people. 00:02:42.09\00:02:45.20 You know, I mean there's always, 00:02:45.21\00:02:46.20 there are limits to free speech. 00:02:46.21\00:02:47.20 Now was anyone offended? 00:02:47.21\00:02:48.29 Well, yeah, exactly there was, yeah. 00:02:48.30\00:02:50.99 I am sure there are lot of people offended, 00:02:51.00\00:02:52.67 sure some Catholics but there was apparently 00:02:52.68\00:02:54.56 some Muslim man, I can't even remember his name, 00:02:54.57\00:02:56.95 I can't pronounce it who supposedly got 00:02:56.96\00:03:01.22 in an altercation with zombie Muhammad. 00:03:01.23\00:03:02.90 You can see it on Youtube. 00:03:02.91\00:03:03.99 Yeah, but it's very grainy. 00:03:04.00\00:03:05.34 You can't tell what's going on. 00:03:05.35\00:03:06.34 Yes, you don't know if he laid hands on him. 00:03:06.35\00:03:07.34 Yes, so the point is this guy, this parading Atheists 00:03:07.35\00:03:10.12 of Mechanicsville, Pennsylvania dressed up as Muhammad zombie, 00:03:10.13\00:03:14.87 Muhammad zombie goes down. 00:03:14.88\00:03:16.86 He had a green face as I remember. 00:03:16.87\00:03:18.64 And he is going I am Muhammad, risen from, 00:03:18.65\00:03:21.33 zombie from the dead or some inane idiocy. 00:03:21.34\00:03:24.65 And he offends this Muslim. They get into tussle. 00:03:24.66\00:03:26.97 The Muslim is arrested, okay? Okay, that's fine. 00:03:26.98\00:03:30.92 That's understandable, you know, 00:03:30.93\00:03:32.56 even if somebody offends you, you're not allowed 00:03:32.57\00:03:34.50 to supposedly assault them or whatever. 00:03:34.51\00:03:36.93 So anyway but that might have not gone anyway 00:03:36.94\00:03:39.20 but it gets to the court. 00:03:39.21\00:03:41.00 It gets to the court. 00:03:41.01\00:03:42.00 Yeah, and this is where of course 00:03:42.01\00:03:43.35 the news media puts a spin on it 00:03:43.36\00:03:46.24 and the judge, I forgot what's his name, Mark Martin. 00:03:46.25\00:03:48.90 I think it was Judge Mark Martin, 00:03:48.91\00:03:51.27 he basically throws the case out and he just-- 00:03:51.28\00:03:55.43 He said there wasn't enough evidence. 00:03:55.44\00:03:56.75 Yeah, the bottom line was he says there wasn't enough 00:03:56.76\00:03:58.68 evidence of an assault. 00:03:58.69\00:04:00.01 They looked at the evidence. 00:04:00.02\00:04:01.46 They had testimony from other people, 00:04:01.47\00:04:04.02 whatever it was, I don't know all the intricacies of it 00:04:04.03\00:04:07.74 but he didn't have enough evidence he felt for, 00:04:07.75\00:04:12.33 you know, to go anywhere. 00:04:12.34\00:04:13.80 That would have been fine too. 00:04:13.81\00:04:15.25 But then apparently the judge decided to take it 00:04:15.26\00:04:18.55 upon himself to give a lecture to the plaintiff. 00:04:18.56\00:04:23.55 I forgot the guy's name, the one who dressed 00:04:23.56\00:04:25.89 as zombie Muhammad and really the judge would 00:04:25.90\00:04:29.37 have been better off to have kept his mouth shut. 00:04:29.38\00:04:31.71 Because he started saying, our founding fathers 00:04:31.72\00:04:33.96 didn't--You know, this was very offensive, 00:04:33.97\00:04:36.56 you were purposely offensive. 00:04:36.57\00:04:37.86 I used to live in Muslim countries, I know-- 00:04:37.87\00:04:40.17 He says first amendment is enough 00:04:40.18\00:04:41.22 but you've gone beyond. 00:04:41.23\00:04:42.22 Yeah you've gone beyond and he read this guy 00:04:42.23\00:04:44.66 and then of course the rumor even came out too 00:04:44.67\00:04:46.82 that the judge himself was a Muslim, 00:04:46.83\00:04:48.95 which turned out to be a lie. 00:04:48.96\00:04:51.60 He had been--he was a Lutheran and you look at the guy 00:04:51.61\00:04:54.21 he didn't look like a Muslim. 00:04:54.22\00:04:55.35 He looked like a Lutheran or a Methodist 00:04:55.36\00:04:57.40 or something but-- He was on two military-- 00:04:57.41\00:05:00.30 He did two or three-- 00:05:00.31\00:05:01.30 I think Afghanistan and Iraq. 00:05:01.31\00:05:02.60 And he was going back, so that's where I think 00:05:02.61\00:05:04.72 he got his sensitivity to Islamic, but the point was 00:05:04.73\00:05:08.52 the judge made this mistake and he was going off and off 00:05:08.53\00:05:11.38 about--on and on about the founders didn't want, 00:05:11.39\00:05:14.97 didn't mean free speech to be offensive 00:05:14.98\00:05:17.70 to so on and that's what made the news. 00:05:17.71\00:05:19.71 And he tells this guy, he says this country 00:05:19.72\00:05:21.38 you'd be killed for doing that, which is true. 00:05:21.39\00:05:22.51 Yeah, yeah, yeah. 00:05:22.52\00:05:23.51 But you know, what's that got to do with America? 00:05:23.52\00:05:24.80 You're not killed for first amendment rights here. 00:05:24.81\00:05:27.42 Yeah, wonder what was the whole point? 00:05:27.43\00:05:28.54 We live in America. 00:05:28.55\00:05:29.54 We don't live in Afghanistan. 00:05:29.55\00:05:30.90 We don't live in Saudi Arabia. 00:05:30.91\00:05:32.30 You are allowed to be offensive, 00:05:32.31\00:05:33.97 so I think he totally missed the point. 00:05:33.98\00:05:38.31 You know if he would have just voted-- 00:05:38.32\00:05:39.49 I mean ruled that way it would have been fine 00:05:39.50\00:05:41.39 but the news media of course they hyped it up. 00:05:41.40\00:05:43.92 You see the headlines, "Sharia Law in Pennsylvania" 00:05:43.93\00:05:47.97 you know and this kind of silliness and so forth, 00:05:47.98\00:05:50.80 but it really was--I think this was a very interesting 00:05:50.81\00:05:54.29 mix of religious freedom thought it was really more-- 00:05:54.30\00:05:58.19 it was just really in many ways it was a free speech case. 00:05:58.20\00:06:00.95 It was a free speech case, because the judge totally, 00:06:00.96\00:06:03.69 I mean I remember even when I was working on the article, 00:06:03.70\00:06:07.03 I took the judge to task, you know, 00:06:07.04\00:06:09.10 say you're not allowed to be offensive. 00:06:09.11\00:06:12.20 Why do you think of all people, 00:06:12.21\00:06:13.86 the horrible A.C.L.U., many people you know the A.C.L.U. 00:06:13.87\00:06:18.34 It's a curse you know A.C.L.U. 00:06:18.35\00:06:20.35 Many people don't realize that a lot of the freedoms, 00:06:20.36\00:06:23.93 a lot of the religious freedoms that we have today 00:06:23.94\00:06:26.85 that we take for granted it was because the A.C.L.U. 00:06:26.86\00:06:30.21 went to court battling for those freedoms. 00:06:30.22\00:06:32.37 Sure they take positions on things how to offend people 00:06:32.38\00:06:34.69 but what they did was the A.C.L.U.-- 00:06:34.70\00:06:36.77 number of years ago in Skokie, Illinois 00:06:36.78\00:06:41.06 where there are a lot of Holocaust survivors-- 00:06:41.07\00:06:43.67 Yeah, I remember that case very well. 00:06:43.68\00:06:45.72 Some bunch of jerks, American Nazis, 00:06:45.73\00:06:50.19 they wanted to march in Skokie purposely 00:06:50.20\00:06:53.71 because they knew they are Holocaust survivors. 00:06:53.72\00:06:56.06 Just to offend them. 00:06:56.07\00:06:57.06 And they wanted to--you know, people wanted to stop it 00:06:57.07\00:06:59.21 and they had a judge put in a--temporary junction 00:06:59.22\00:07:02.19 on it and the A.C.L.U. 00:07:02.20\00:07:04.15 went to court to defend 00:07:04.16\00:07:06.29 the right of the Nazis to march. 00:07:06.30\00:07:08.92 And people were horrified but that's not the point. 00:07:08.93\00:07:11.02 They were looking at the principle. 00:07:11.03\00:07:13.76 They were looking at the principle. 00:07:13.77\00:07:15.06 If you--if speech that is just offensive is a rule 00:07:15.07\00:07:19.88 that nobody can say anything. 00:07:19.89\00:07:21.04 Well, the point to the first amendment is precisely 00:07:21.05\00:07:23.04 to protect offensive speech. 00:07:23.05\00:07:24.48 Yeah, of course. 00:07:24.49\00:07:25.48 If it's not offensive you don't need a first amendment. 00:07:25.49\00:07:27.19 Everyone will be happy with it, non-offensive speech. 00:07:27.20\00:07:29.20 I mean it was--especially if you go back 00:07:29.21\00:07:31.43 and you look at we mention in another program 00:07:31.44\00:07:34.50 the political, the vitriol, we got nothing. 00:07:34.51\00:07:38.72 The patch today, the super patch and L.B.J.' s daisy ad. 00:07:38.73\00:07:44.41 They saw that was the beginning 00:07:44.42\00:07:45.76 of negative campaigning, the daisy ad. 00:07:45.77\00:07:48.01 That was nothing compare to what was going on back then. 00:07:48.02\00:07:50.82 It does seem like a lot of political speech. 00:07:50.83\00:07:52.54 This is off the topic a bit 00:07:52.55\00:07:54.18 but heads to a defamation of character. 00:07:54.19\00:07:56.16 Well but, you know, it's yeah, that's the way. 00:07:56.17\00:07:58.78 And I guess it is a public person-- 00:07:58.79\00:08:00.07 As much as they say they don't want to go negative, 00:08:00.08\00:08:03.72 they want to win, they want to win 00:08:03.73\00:08:06.05 and they're gonna go-- who can forget Willie Horton? 00:08:06.06\00:08:08.39 And Willie Horton and what was it Lee Atwater 00:08:08.40\00:08:10.71 said I am gonna make Willie Horton 00:08:10.72\00:08:13.55 Michael Dukakis' running mate. 00:08:13.56\00:08:15.28 And as stupid and as evil and as bad as it was, 00:08:15.29\00:08:18.06 it worked and when-- 00:08:18.07\00:08:20.83 By the way before he died Lee Atwater apologized--. 00:08:20.84\00:08:24.25 Oh, yeah, well, yeah, of course that fine, 00:08:24.26\00:08:26.14 that's a separate issue but it still, it works, 00:08:26.15\00:08:29.44 I mean Romney went ballistic, you know, 00:08:29.45\00:08:31.98 when Newt won those other things that Romney 00:08:31.99\00:08:34.41 didn't expect, but they went ballistic on him. 00:08:34.42\00:08:38.52 And you know the negative campaigning accused him 00:08:38.53\00:08:40.46 of a lot of stupid things and some of the stuff 00:08:40.47\00:08:42.50 they got coming out against Obama. 00:08:42.51\00:08:44.75 See it doesn't matter if it's not true. 00:08:44.76\00:08:47.94 What matter in the day and age 00:08:47.95\00:08:49.68 of sound bytes, will it turn voters away 00:08:49.69\00:08:53.44 from one and get you to vote other. 00:08:53.45\00:08:55.47 And this is again, this is the limits 00:08:55.48\00:08:57.05 of the whole democratic process. 00:08:57.06\00:08:59.51 It's a very flawed and the money that's involved 00:08:59.52\00:09:01.69 but anyway the upshot of it was if we go back to the case, 00:09:01.70\00:09:04.65 there are limits on free speech. 00:09:04.66\00:09:06.33 You know the famous shrink case 00:09:06.34\00:09:07.85 where the you know the judge said 00:09:07.86\00:09:08.85 your free speech doesn't allow you to shout, 00:09:08.86\00:09:11.86 fire in a crowded movie theater 00:09:11.87\00:09:14.32 and you know if you work for the government 00:09:14.33\00:09:16.01 you sign things believe me, the place where I live, 00:09:16.02\00:09:18.70 I know these people they are not allowed to talk 00:09:18.71\00:09:20.95 about what they do for the government-- 00:09:20.96\00:09:22.67 I think the zombie Muhammad one was interesting 00:09:22.68\00:09:24.82 not so much that he was setting an illegal precedent, 00:09:24.83\00:09:27.23 It was the just ludicrousness of the whole thing. 00:09:27.24\00:09:29.06 We'll visit that in a minute. 00:09:29.07\00:09:30.58 The Supreme Court recently a very much affirm 00:09:30.59\00:09:32.37 free speech but I think it intersects 00:09:32.38\00:09:34.80 what we've seen recently with the Danish cartoon controversy, 00:09:34.81\00:09:39.67 the burning of the Quran or the disposing 00:09:39.68\00:09:41.95 of the Qurans in Afghanistan, 00:09:41.96\00:09:43.52 the religious violence that comes 00:09:43.53\00:09:46.28 from the defamation of religion or a slight taking. 00:09:46.29\00:09:50.66 Well, here it was intended to slide. 00:09:50.67\00:09:52.43 It was an insult to religious sensibilities-- 00:09:52.44\00:09:54.58 But the point is-- 00:09:54.59\00:09:55.58 That protected under free speech. 00:09:55.59\00:09:57.34 But this is America we're allowed to do that. 00:09:57.35\00:10:00.01 And for the judge, I don't know what he was thinking 00:10:00.02\00:10:02.84 to sit there and say, you know, in other countries 00:10:02.85\00:10:05.50 you would be killed, but judge 00:10:05.51\00:10:06.86 what that has to do we-- this is America. 00:10:06.87\00:10:08.98 I've seen him on Talking Heads on TV 00:10:08.99\00:10:11.22 and he is pretty much apologizing-- 00:10:11.23\00:10:12.76 The Judge? Oh, yeah. 00:10:12.77\00:10:13.76 He know that he was-- Yeah. 00:10:13.77\00:10:15.11 I mean I wrote in the article-- 00:10:15.12\00:10:16.53 He didn't expect the national media to pick up-- 00:10:16.54\00:10:18.49 In the article I went and even though I said 00:10:18.50\00:10:20.86 he was wrong on that, I said, 00:10:20.87\00:10:22.10 look the guy is not a Muslim, 00:10:22.11\00:10:23.54 cut him some slack you know, he served this country-- 00:10:23.55\00:10:26.00 And he's received death threats-- 00:10:26.01\00:10:27.44 Yeah. Yeah. He personally feels frightened about it. 00:10:27.45\00:10:29.31 That shows the extremism on you know I am sure 00:10:29.32\00:10:32.58 some good red blooded American Protestant 00:10:32.59\00:10:34.72 or Catholic boys were gonna-- 00:10:34.73\00:10:36.59 you know try to do this judge in 00:10:36.60\00:10:38.61 because all right he made a mistake, 00:10:38.62\00:10:39.74 all right, he's a judge, he's not infallible. 00:10:39.75\00:10:41.84 Well, they thought he was a Muslim said-- 00:10:41.85\00:10:42.99 Yeah, that was because he said 00:10:43.00\00:10:44.22 at the one point in transcript or something, 00:10:44.23\00:10:46.21 if I am a Muslim I would find this, 00:10:46.22\00:10:48.60 which again is totally irrelevant. 00:10:48.61\00:10:50.05 I don't know why he did it but the transcript went out. 00:10:50.06\00:10:52.33 He said he's a Muslim. 00:10:52.34\00:10:54.07 So you got, you know a guy holding a sign 00:10:54.08\00:10:57.60 is attacked by a Muslim and then the judge 00:10:57.61\00:10:59.97 who's supposedly was a Muslim 00:10:59.98\00:11:02.36 lets the guy off and then lectures the guy 00:11:02.37\00:11:04.37 with the sign, I mean again this is easy to see, 00:11:04.38\00:11:05.95 this is how the irresponsibility of the American press. 00:11:05.96\00:11:10.25 And I am a writer but I understand, 00:11:10.26\00:11:13.50 you see how totally irresponsible 00:11:13.51\00:11:17.11 a lot of the America media. 00:11:17.12\00:11:18.85 As Rush calls drive by media 00:11:18.86\00:11:21.87 and I think Rush is a 100% correct on that. 00:11:21.88\00:11:24.95 And as one of the drive by shooters himself, 00:11:24.96\00:11:26.16 Rush Limbaugh. 00:11:26.17\00:11:27.20 But on this case we need to leave it 00:11:27.21\00:11:29.06 on a clear legal level, the Supreme Court 00:11:29.07\00:11:31.44 recently in another free speech case 00:11:31.45\00:11:34.18 where this church out of Oklahoma, wasn't it? 00:11:34.19\00:11:36.42 Oh, Phelps, those wackos, oh-- 00:11:36.43\00:11:40.66 And a military funeral particularly-- 00:11:40.67\00:11:42.24 Fred Phelps. 00:11:42.25\00:11:43.91 They were screaming abusive of the family of dead soldiers-- 00:11:43.92\00:11:47.64 God hates fags and God is killing these, 00:11:47.65\00:11:49.66 these people were dying because--your son died 00:11:49.67\00:11:52.46 in Iraq, your son died in Afghanistan-- 00:11:52.47\00:11:55.10 Because God's vengeance on the country. 00:11:55.11\00:11:57.14 And they got--they're standing at military funerals 00:11:57.15\00:12:00.63 with holding up you know saying, God killed your son, 00:12:00.64\00:12:03.76 It was a shocking social Faux Pas-- 00:12:03.77\00:12:06.06 And it's horrible, of course-- 00:12:06.07\00:12:07.06 But the Supreme Court said they have the right to do it, 00:12:07.07\00:12:09.26 it's as offensive as it is. 00:12:09.27\00:12:11.33 Yeah, that's the amazing think about free speech, 00:12:11.34\00:12:13.75 a lot of us are offended by it but when the time comes 00:12:13.76\00:12:17.32 you know when we want to say something, 00:12:17.33\00:12:19.43 we have our rights to be defended. 00:12:19.44\00:12:21.02 It's brilliant. Yes. 00:12:21.03\00:12:22.34 So I was very happy the supreme court did that 00:12:22.35\00:12:23.90 because its not that many years ago 00:12:23.91\00:12:26.91 when President Bush was in office, 00:12:26.92\00:12:29.34 the free speak had become a mockery 00:12:29.35\00:12:31.66 because if you wanted to demonstrate against 00:12:31.67\00:12:33.01 the president, there was a roped off area, 00:12:33.02\00:12:34.72 up to two miles away from the motorcade 00:12:34.73\00:12:37.05 called the free speech zone, anything but. 00:12:37.06\00:12:39.48 Well yeah, I, you know, again free speech-- 00:12:39.49\00:12:42.26 Well, we can dismiss it now as an aberration 00:12:42.27\00:12:44.29 but I think the Supreme Court's decision 00:12:44.30\00:12:46.91 fairly recently is a good restatement 00:12:46.92\00:12:50.06 of a valid principle which undergoes 00:12:50.07\00:12:52.15 the rights of religious liberty. 00:12:52.16\00:12:53.69 We will be back after a short break 00:12:53.70\00:12:55.20 to continue this discussion guest Clifford Goldstein. 00:12:55.21\00:12:58.07
